A bill to be entitled
2An act relating to local government; amending s. 125.0101,
3F.S.; prohibiting counties from imposing certain fees or
4taxes on certain municipalities; providing an effective
5date.

7Be It Enacted by the Legislature of the State of Florida:

9     Section 1.  Subsections (2) and (5) of section 125.0101,
10Florida Statutes, are amended to read:
11     125.0101  County may contract to provide services to
12municipalities and special districts.--
13     (2)  In addition to the powers enumerated in this chapter,
14the legislative and governing body of a county shall have the
15power to contract with a municipality or special district within
16the county for fire protection, law enforcement, library
17services and facilities, beach erosion control, recreation
18services and facilities, water, streets, sidewalks, street
19lighting, garbage and trash collection and disposal, waste and
20sewage collection and disposal, drainage, transportation, and
21other essential facilities and municipal services. Such services
22shall be funded as agreed upon between the county and the
23municipality or special district. This section shall not be
24construed to authorize the county to impose any service charge
25or special assessment; or to levy any tax within the
26municipality or special district; or to require that any newly
27formed municipality or one formed since January 1, 2000, be
28required to pay any charge, assessment, tax, fee, or other
29consideration as a condition for allowing the citizens of an
30area within the county to incorporate and self-govern;, nor
31shall this section be construed to authorize the creation of a
32municipal service taxing unit within such area.
33     (5)  This section, except for the provision in subsection
34(2) prohibiting any charge, assessment, tax, fee, or other
35consideration as a condition for allowing the citizens of an
36area within the county to incorporate and self-govern, shall not
37apply to any county operating under a home rule charter adopted
38pursuant to ss. 10, 11, and 24, Art. VIII of the Constitution of
391885, as preserved by s. 6(e), Art. VIII, of the Constitution of
401968.
41     Section 2.  This act shall take effect July 1, 2006.
