11 The Committee on Judiciary (Posey) recommended the following
12 amendment:

14 Senate Amendment (with title amendment)
15 On page 1, line 23, through page 2, line 16, delete
16 those lines

18 and insert:
19 (1) Each county in which a drug court program has been
20 established under s. 397.334 may require by ordinance the
21 assessment of a mandatory cost in the sum of $6 which shall be
22 assessed by both the circuit court and the county court in the
23 county against every person:
24 (a) who pleads guilty or nolo contendere to, or is
25 convicted of, regardless of adjudication, a violation of
26 chapter 893,
27 (b) who pleads guilty or nolo contendere to, or is
28 convicted of, regardless of adjudication, a violation of a
29 municipal ordinance or a county ordinance, involving the use
30 of alcohol or other substance use or abuse, or
31 (c) who pays a fine or civil penalty for any violation

1 of chapter 316 involving the use of alcohol or other substance
2 use or abuse.

4 The $6 assessment shall be in addition to any fine, civil
5 penalty, or other court cost and may not be deducted from the
6 proceeds of that portion of any fine or civil penalty which is
7 received by a municipality in the county or by the county in
8 accordance with ss. 316.660 and 318.21. The $6 assessment
9 shall specifically be added to any civil penalty paid for a
10 violation of chapter 316, whether such penalty is paid by
11 mail, paid in person without request for a hearing, or paid
12 after a hearing and determination by the court.

20 convicted of, certain drug abuse prevention and control

22 control laws involving alcohol or other substance use or
23 abuse; providing for collection and deposit
