A bill to be entitled
2An act relating to instructional materials for public
3school education; amending s. 1006.28, F.S.; requiring
4district school boards to issue additional textbooks for
5use in the classroom in grades 6 through 8; providing an
6effective date.

8     WHEREAS, because of the elimination of lockers in many
9middle schools, students must carry their issued textbooks
10throughout the school day, and
11     WHEREAS, carrying such books has the potential to lead to
12minor to severe back problems, NOW, THEREFORE,
13
14Be It Enacted by the Legislature of the State of Florida:
15
16     Section 1.  Paragraph (b) of subsection (1) of section
171006.28, Florida Statutes, is amended to read:
18     1006.28  Duties of district school board, district school
19superintendent; and school principal regarding K-12
20instructional materials.--
21     (1)  DISTRICT SCHOOL BOARD.--The district school board has
22the duty to provide adequate instructional materials for all
23students in accordance with the requirements of this part. The
24term "adequate instructional materials" means a sufficient
25number of textbooks or sets of materials serving as the basis
26for instruction for each student in the core courses of
27mathematics, language arts, social studies, science, reading,
28and literature, except for instruction for which the school
29advisory council approves the use of a program that does not
30include a textbook as a major tool of instruction. The district
31school board has the following specific duties:
32     (b)  Textbooks.--
33     1.  Provide for proper requisitioning, distribution,
34accounting, storage, care, and use of all instructional
35materials furnished by the state and furnish such other
36instructional materials as may be needed. The district school
37board shall assure that instructional materials used in the
38district are consistent with the district goals and objectives
39and the curriculum frameworks adopted by rule of the State Board
40of Education, as well as with the state and district performance
41standards provided for in s. 1001.03(1).
42     2.  Issue additional textbooks to remain in each classroom
43for use in the classroom by each student in grades 6 through 8
44who participates in the class. The issuance of textbooks
45pursuant to this subparagraph shall not affect the issuance of
46textbooks to each student.
47     Section 2.  This act shall take effect July 1, 2006.
