6An act relating to instructional materials for public
7school education; amending s. 1006.28, F.S.; requiring
8district school boards to purchase and provide a classroom
9set of textbooks for use in certain grade 6 through grade
108 classrooms; providing an effective date.

12     WHEREAS, because of the elimination of lockers in many
13middle schools, students must carry their issued textbooks
14throughout the school day, and
15     WHEREAS, carrying such books has the potential to lead to
16minor to severe back problems, NOW, THEREFORE,
17
18Be It Enacted by the Legislature of the State of Florida:
19
20     Section 1.  Paragraph (b) of subsection (1) of section
211006.28, Florida Statutes, is amended to read:
22     1006.28  Duties of district school board, district school
23superintendent; and school principal regarding K-12
24instructional materials.--
25     (1)  DISTRICT SCHOOL BOARD.--The district school board has
26the duty to provide adequate instructional materials for all
27students in accordance with the requirements of this part. The
28term "adequate instructional materials" means a sufficient
29number of textbooks or sets of materials serving as the basis
30for instruction for each student in the core courses of
31mathematics, language arts, social studies, science, reading,
32and literature, except for instruction for which the school
33advisory council approves the use of a program that does not
34include a textbook as a major tool of instruction. The district
35school board has the following specific duties:
36     (b)  Textbooks.--
37     1.  Provide for proper requisitioning, distribution,
38accounting, storage, care, and use of all instructional
39materials furnished by the state and furnish such other
40instructional materials as may be needed. The district school
41board shall assure that instructional materials used in the
42district are consistent with the district goals and objectives
43and the curriculum frameworks adopted by rule of the State Board
44of Education, as well as with the state and district performance
45standards provided for in s. 1001.03(1).
46     2.  During the first 2 years of the adoption cycle,
47beginning with the 2006-2007 school year, purchase sufficient
48textbooks to provide a classroom set of textbooks for use in
49each core curriculum classroom in grades 6 through 8. The
50purchase of textbooks pursuant to this subparagraph shall not
51affect the issuance of textbooks to each student.
52     Section 2.  This act shall take effect July 1, 2006.
