| 1 | A bill to be entitled |
| 2 | An act relating to a motor vehicle safety pilot program; |
| 3 | requiring certain limited access facilities that are |
| 4 | adjacent to a canal or other water body to have a system |
| 5 | of guardrails, retention cables, or other barriers between |
| 6 | the highway and the canal or water body; providing for the |
| 7 | Department of Transportation to establish certain |
| 8 | standards governing the installation and maintenance of |
| 9 | the barriers; requiring that barriers be installed for |
| 10 | existing highways by a specified date; providing for |
| 11 | future review and repeal; providing an effective date. |

| 13 | Be It Enacted by the Legislature of the State of Florida: |
| 14 |
|
| 15 | Section 1. Barrier required between a highway and a canal |
| 16 | or a water body.-- |
| 17 | (1) Each limited access facility in Miami-Dade County that |
| 18 | is adjacent to a canal or other water body must have a system of |
| 19 | guardrails, retention cables, or other barriers between the |
| 20 | highway and the canal or water body which are installed and |
| 21 | maintained in conformance with standards established by the |
| 22 | Florida Department of Transportation. The standards should |
| 23 | consider loss of life by safely preventing out-of-control motor |
| 24 | vehicles from entering the canal or water body, as well as the |
| 25 | width or depth of the canal or water body or its proximity to |
| 26 | the traveled way of the highway. |
| 27 | (2) For a limited access facility in existence on July 1, |
| 28 | 2006, the barriers required under this section must be installed |
| 29 | on or before December 31, 2009. |
| 30 | (3) This pilot program shall stand repealed December 31, |
| 31 | 2011, unless reviewed and saved from repeal through enactment by |
| 32 | the Legislature. |
| 33 | Section 2. This act shall take effect July 1, 2006. |
