1 A bill to be entitled
2 An act relating to local government land
3 development regulation; creating s. 163.3206,
4 F.S.; providing legislative intent; providing
5 that electrical substations shall be considered
6 a permittable use in all land use categories
7 and zoning districts; creating s. 163.3208,
8 F.S.; prohibiting a local government from
9 requiring permits or other approvals for
10 vegetation management and tree trimming within
11 an established electric power line
12 right-of-way; providing an effective date.

14 Be It Enacted by the Legislature of the State of Florida:

16 Section 1. Section 163.3206, Florida Statutes, is
17 created to read:
18 163.3206 Electrical substations; permittable use.--
19 (1) It is the intent of the Legislature to maintain,
20 encourage, and ensure adequate and reliable electrical
21 infrastructure in the state. It is essential that electrical
22 infrastructure be constructed and maintained in various
23 locations in order to ensure the efficient and reliable
24 delivery of electric service.
25 (2) Electrical substations are a critical component of
26 electric transmission and distribution. Reasonable setback,
27 landscaping, buffering, or screening standards for substations
28 may be enacted by local government; however, substations shall
29 be considered a permittable use in all land use categories and
30 zoning districts.

1 Section 2. Section 163.3208, Florida Statutes, is
2 created to read:
3 163.3208 Electric power line right-of-way
4 maintenance.--After a right-of-way for any electric power line
5 has been established, a local government shall not require any
6 permits or other approvals for vegetation management and tree
7 trimming within that established right-of-way. Upon request of
8 the local government, the electric utility shall meet with the
9 local government to discuss the utility's vegetation
10 maintenance plan, including the utility's trimming
11 specifications and management practices.
12 Section 3. This act shall take effect upon becoming a
13 law.
