10 | Be It Enacted by the Legislature of the State of Florida: |

12 | Section 1. Section 458.3094, Florida Statutes, is created |
13 | to read: |
14 | 458.3094 Requirements for training in cultural |
15 | competency.-- |
16 | (1) The Board of Medicine shall adopt rules for physician |
17 | training in cultural competency which include the following |
18 | requirements: |
19 | (a) The curriculum in each college of medicine in this |
20 | state must include instruction in cultural competency which is |
21 | designed to address race and gender-based disparities in medical |
22 | treatment decisions. The rules shall be developed in |
23 | consultation with the Association of American Medical Colleges |
24 | or another nationally recognized organization that reviews |
25 | medical school curricula. |
26 | (b) A medical student must complete training in cultural |
27 | competency before he or she may receive a diploma from a college |
28 | of medicine in this state. |
29 | (c) A college of medicine that provides instruction in |
30 | cultural competency must also offer cultural competency training |
31 | as continuing medical education. The training may be provided |
32 | through classroom instruction, workshops, or other educational |
33 | programs sponsored by the college which meet criteria |
34 | established by the board. |
35 | (d) A physician licensed to practice medicine in this |
36 | state who has not completed instruction in cultural competency |
37 | as part of a medical school curriculum must, as a condition of |
38 | relicensure, complete training in cultural competency which is |
39 | offered pursuant to this section by July 1, 2009. |
40 | (2) The board may waive the educational requirements of |
41 | this section if an applicant for relicensure demonstrates that |
42 | he or she has received the substantial equivalent of this |
43 | requirement through completion of a similar course in |
44 | postsecondary education which meets criteria established by the |
45 | board. |
46 | Section 2. This act shall take effect July 1, 2006. |
