A bill to be entitled
2An act relating to medical practice; creating s. 458.3094,
3F.S.; requiring the Board of Medicine to adopt rules
4requiring physician training in cultural competency;
5specifying rules related to required training for students
6in colleges of medicine in this state and for physicians
7licensed in this state; providing exceptions; providing an
8effective date.

10Be It Enacted by the Legislature of the State of Florida:

12     Section 1.  Section 458.3094, Florida Statutes, is created
13to read:
14     458.3094  Requirements for training in cultural
15competency.--
16     (1)  The Board of Medicine shall adopt rules for physician
17training in cultural competency which include the following
18requirements:
19     (a)  The curriculum in each college of medicine in this
20state must include instruction in cultural competency which is
21designed to address race and gender-based disparities in medical
22treatment decisions. The rules shall be developed in
23consultation with the Association of American Medical Colleges
24or another nationally recognized organization that reviews
25medical school curricula.
26     (b)  A medical student must complete training in cultural
27competency before he or she may receive a diploma from a college
28of medicine in this state.
29     (c)  A college of medicine that provides instruction in
30cultural competency must also offer cultural competency training
31as continuing medical education. The training may be provided
32through classroom instruction, workshops, or other educational
33programs sponsored by the college which meet criteria
34established by the board.
35     (d)  A physician licensed to practice medicine in this
36state who has not completed instruction in cultural competency
37as part of a medical school curriculum must, as a condition of
38relicensure, complete training in cultural competency which is
39offered pursuant to this section by July 1, 2009.
40     (2)  The board may waive the educational requirements of
41this section if an applicant for relicensure demonstrates that
42he or she has received the substantial equivalent of this
43requirement through completion of a similar course in
44postsecondary education which meets criteria established by the
45board.
46     Section 2.  This act shall take effect July 1, 2006.
