  1                      A bill to be entitled

  2         An act relating to emergency management;

  3         amending s. 414.095, F.S.; requiring the

  4         Department of Children and Family Services, to

  5         the extent permitted by federal law, to

  6         expedite application procedures for persons who

  7         reside in an area damaged by a major disaster

  8         and who apply for temporary cash assistance;

  9         requiring that the application process be

10         completed within a specified time; requiring

11         the department to train its employees who are

12         responsible for determining eligibility for

13         temporary cash assistance in order to expedite

14         the application process for the victims of a

15         major disaster and to assist the victims in

16         contacting agencies that provide temporary

17         shelter, food, food stamps, and other relief;

18         amending s. 252.36, F.S.; authorizing the

19         Governor to employ such measures and give such

20         directions to certain specified agencies as are

21         necessary for the purpose of addressing the

22         needs for immediate cash, shelter, or food

23         assistance for children, families, and the

24         elderly and disabled during an emergency;

25         providing an effective date.

27  Be It Enacted by the Legislature of the State of Florida:

28  

29         Section 1.  Present subsection (18) of section 414.095,

30  Florida Statutes, is redesignated as subsection (19), and a

31  new subsection (18) is added to that section, to read:

 1         414.095  Determining eligibility for temporary cash

 2  assistance.--

 3         (18)  EXPEDITED APPLICATION PROCESS.--

 4         (1)  To the extent permitted by federal law or

 5  regulation, the department shall expedite application

 6  procedures for applicants who reside in an area damaged by a

 7  major disaster, as defined in s. 252.34. The department must

 8  complete the application process within 10 calendar days after

 9  receiving a completed application.

10         (2)  The department shall train its employees who are

11  responsible for determining eligibility for temporary cash

12  assistance in order to expedite the application process for

13  the victims of major disasters and to assist the victims in

14  contacting appropriate agencies that provide temporary

15  shelter, food, food stamps, and other relief.

16         Section 2.  Present subsections (8), (9), and (10) of

17  section 252.36, Florida Statutes, are redesignated as

18  subsections (9), (10), and (11), respectively, and a new

19  subsection (8) is added to that section, to read:

20         252.36  Emergency management powers of the Governor.--

21         (8)  The Governor shall employ such measures and give

22  such directions to the Department of Children and Family

23  Services, the Agency for Workforce Development, the Department

24  of Elderly Affairs, and the Agency for Persons with

25  Disabilities as may be reasonably necessary for the purpose of

26  securing compliance with the provisions of ss. 252.31-252.60

27  or with the findings or recommendations of such agencies

28  regarding the need for immediate cash, shelter, or food

29  assistance for children, families, and the elderly and

30  disabled during an emergency.

31         Section 3.  This act shall take effect July 1, 2007.

 3    Requires the Department of Children and Family Services,
