A bill to be entitled
2An act relating to law enforcement vehicles; creating s.
3316.21265, F.S.; authorizing law enforcement agencies to
4use specific off-road vehicles on the streets, roads, and
5highways of this state; providing requirements for such
6vehicles; providing an effective date.

8Be It Enacted by the Legislature of the State of Florida:

10     Section 1.  Section 316.21265, Florida Statutes, is created
11to read:
12     316.21265  Use of all-terrain vehicles, golf carts, low-
13speed vehicles, or utility vehicles by law enforcement
14agencies.--
15     (1)  Notwithstanding any provision of law to the contrary,
16any law enforcement agency in this state may operate all-terrain
17vehicles as defined in s. 316.2074, golf carts as defined in s.
18320.01(22), low-speed vehicles as defined in s. 320.01(42), or
19utility vehicles as defined in s. 320.01(43) on any street,
20road, or highway in this state while carrying out its official
21duties.
22     (2)  Such vehicles must be clearly marked as vehicles of a
23law enforcement agency and may be equipped with special warning
24lights, signaling devices, or other equipment approved or
25authorized for use on law enforcement vehicles.
26     (3)  The vehicle operator and passengers must wear safety
27gear, such as helmets, which is ordinarily required or
28recommended for use by operators or passengers on such vehicles.
29     Section 2.  This act shall take effect July 1, 2007.
