2An act relating to assisted living facilities; amending s.
3429.52, F.S.; requiring the Department of Elderly Affairs
4to develop a staff training curriculum; requiring trainers
5to be registered with the department; requiring trainers
6to document experience and credentials; requiring the
7adoption of rules; providing appropriations; providing an
8effective date.

10Be It Enacted by the Legislature of the State of Florida:
11
12     Section 1.  Subsection (8) of section 429.52, Florida
13Statutes, is amended, and subsections (9) through (11) are added
14to that section, to read:
15     429.52  Staff training and educational programs; core
16educational requirement.--
17     (8)  The department shall adopt rules related to these
18training requirements, the competency test, necessary
19procedures, and competency test fees and shall adopt or contract
20with another entity to develop a curriculum, which shall be used
21as the minimum core training requirements. The department shall
22consult with representatives of stakeholder associations and
23agencies in the development of the curriculum.
24     (9)  The training required by this section shall be
25conducted by persons registered with the department as having
26the requisite experience and credentials to conduct the
27training. A person seeking to register as a trainer must provide
28the department with proof of completion of the minimum core
29training education requirements, successful passage of the
30competency test established under this section, and proof of
31compliance with the continuing education requirement in
32subsection (4).
33     (10)  A person seeking to register as a trainer must also:
34     (a)  Provide proof of completion of a 4-year degree from an
35accredited college or university and must have worked in a
36management position in an assisted living facility for 3 years
37after being core certified;
38     (b)  Have worked in a management position in an assisted
39living facility for 5 years after being core certified and have
401 year of teaching experience as an educator or staff trainer
41for persons who work in assisted living facilities or other
42long-term care settings;
43     (c)  Have been previously employed for 1 year by the agency
44as a surveyor of assisted living facilities; or
45     (d)  Have been previously employed as a core trainer for
46the department.
47     (11)  The department shall adopt rules to establish trainer
48registration requirements.
49     Section 2.  For fiscal year 2007-2008, funds shall be
50appropriated to the Department of Elderly Affairs for the
51purpose of paying the salary and other administrative expenses
52for one full-time equivalent Senior Management Analyst II to
53implement the provisions of this act. Recurring funds shall be
54appropriated in the amounts of $63,079 for salary and benefits,
55$6,489 for expenses, and $401 for human resources services.
56Nonrecurring funds shall be appropriated in the amounts of
57$3,426 for expenses and $1,300 for operating capital outlay.
58     Section 3.  This act shall take effect July 1, 2007.
