11 The Committee on Criminal Justice (Argenziano) recommended the
12 following amendment:

14 Senate Amendment (with title amendment)
15 On page 3, between lines 3 and 4,
16
17 insert:
18 Section 2. A new subsection (12) is added to section
19 938.30, Florida Statutes, to read:
20 938.30 Financial obligations in criminal cases;
21 supplementary proceedings.--
22 (12) The court shall not enter an order sealing or
23 expunging criminal history records under Rule 3.692, Florida
24 Rules of Criminal Procedure, and ss. 943.0585 and 943.059,
25 until the person has paid all outstanding criminal costs and
26 fines assessed against the moving party, unless the court
27 makes written findings about the appropriateness of sealing or
28 expunging despite the outstanding costs and fines.
29 (13) (12) The provisions of this section may be used
30 in addition to, or in lieu of, other provisions of law for
31 enforcing payment of court-imposed financial obligations in

1 criminal cases. The court may enter any orders necessary to
2 carry out the purposes of this section.

12 amending s. 938.30, F.S., requiring defendants
