1 A bill to be entitled
2 An act relating to child safety; requiring
3 school boards to adopt policies regarding
4 release of children; providing a definition;
5 requiring that copies of the policies be
6 provided to the Department of Education;
7 requiring nonpublic schools, private schools,
8 and certain child care facilities to adopt
9 policies regarding release of children;
10 requiring that copies of such policies be
11 available on the premises of the schools or
12 child care facilities; defining the term
13 "picture identification"; providing an
14 effective date.

16 Be It Enacted by the Legislature of the State of Florida:

18 Section 1. By July 1, 2008, the school board of each
19 public school district must adopt policies that will ensure
20 that the students in that school district are not released
21 from the schools to persons who are not authorized to retrieve
22 them. These policies must include a requirement that a person
23 attempting to retrieve a student present a picture
24 identification to the school principal or his or her designee
25 before the student is released to the person. As used in this
26 section, the term "picture identification" means a valid state
27 driver's license, a valid state identification card, a valid
28 United States military identification card, a valid student
29 identification card from a postsecondary institution, or a
30 valid employee identification card. Copies of the policies
31 must be provided to the Department of Education.

1 Section 2. By July 1, 2008, each nonpublic school
2 exempt from licensure under s. 402.3025(2), Florida Statutes,
3 child care facility licensed under s. 402.305, Florida
4 Statutes, family day care home licensed or registered under s.
5 402.313, Florida Statutes, large family day care home licensed
6 under s. 402.3131, Florida Statutes, private school as defined
7 in s. 1002.01, Florida Statutes, and faith-based child care
8 provider exempt from licensure under s. 402.316, Florida
9 Statutes, must adopt policies that will ensure that the
10 children in that nonpublic school, child care facility, day
11 care home, private school, or faith-based child care provider
12 facility are not released to persons who are not authorized to
13 retrieve them. These policies must include a requirement that
14 the person attempting to retrieve a child must present a
15 picture identification to the appropriate school or child care
16 official or his or her designee before the child is released
17 to the person. As used in this section, the term "picture
18 identification" means a valid state driver's license, a valid
19 state identification card, a valid student identification card
20 from a postsecondary institution, a valid employee
21 identification card, or a valid United States military
22 identification card. Copies of these policies must be
23 maintained on the premises of each entity covered by this
24 section and must be readily available for inspection.
25 Section 3. This act shall take effect upon becoming a
26 law.
