14 On page 43, lines 1-30, delete those lines

16 and insert:
17 (4) A county may not appropriate or expend any funds
18 for the offices of criminal conflict and civil regional
19 counsel, including the cost of communications services,
20 existing radio systems, existing multiagency criminal justice
21 information systems, and the cost of construction or lease,
22 maintenance, utilities, and security of facilities as
23 described in s. 29.008. Unless expressly authorized by law or
24 in the General Appropriations Act, public defenders are
25 prohibited from spending state-appropriated funds on county
26 funding obligations under s. 14, Art. V of the State
27 Constitution beginning January 1, 2005. This includes
28 expenditures on communications services and facilities as
29 defined in s. 29.008. This does not prohibit a public defender
30 from spending funds for these purposes in exceptional
31 circumstances when necessary to maintain operational

1 continuity in the form of a short-term advance pending
2 reimbursement from the county. If a public defender provides
3 short-term advance funding for a county responsibility as
4 authorized by this subsection, the public defender shall
5 request full reimbursement from the board of county
6 commissioners prior to making the expenditure or at the next
7 meeting of the board of county commissioners after the
8 expenditure is made. The total of all short-term advances
9 authorized by this subsection shall not exceed 2 percent of
10 the public defender's approved operating budget in any given
11 year. No short-term advances authorized by this subsection
12 shall be permitted until all reimbursements arising from
13 advance funding in the prior state fiscal year have been
14 received by the public defender. All reimbursement payments
15 received by the public defender shall be deposited into the
16 General Revenue Fund. Notwithstanding the provisions of this
17 subsection, the public defender may expend funds for the
18 purchase of computer systems, including associated hardware
19 and software, and for personnel related to this function.
