A bill to be entitled
2An act relating to the Tohopekaliga Water Authority,
3Osceola County; amending chapter 2003-368, Laws of
4Florida; providing for additional board members to be
5appointed pursuant to an interlocal agreement with the
6authority; providing an effective date.

8Be It Enacted by the Legislature of the State of Florida:

10     Section 1.  Subsection (1) of section 6 of chapter 2003-
11368, Laws of Florida, is amended to read:
12     Section 6.  Governing Body.
13     (1)  The governing body of the Authority shall consist of
14five permanent members and one or more interlocal members, as
15may be appointed, acting as the Board of Supervisors, each of
16whom shall serve a term of 3 years commencing on October 1,
17provided the procedure for appointment of members of the Board
18of Supervisors and their initial terms of office shall be as
19follows:
20     (a)  Board Supervisor No. 1 and Board Supervisor No. 2
21shall serve for initial terms of approximately 2 years, ending
22on September 30, 2005. Board Supervisor No. 1 shall be appointed
23by the Osceola County Board of County Commissioners. Board
24Supervisor No. 2 shall be appointed by the City Commission of
25the City of Kissimmee.
26     (b)  Board Supervisor No. 3 and Board Supervisor No. 4
27shall serve initial terms of approximately 3 years, ending on
28September 30, 2006. Board Supervisor No. 3 shall be appointed by
29the Osceola Board of County Commissioners. Board Supervisor No.
304 shall be appointed by the City Commission of the City of
31Kissimmee.
32     (c)  Board Supervisor No. 5 shall serve an initial term of
33approximately 4 years, ending September 30, 2007. Board
34Supervisor No. 5 shall be collectively appointed by joint
35resolution of the Osceola County Board of County Commissioners
36and the City Commission of the City of Kissimmee and shall serve
37as the Chairperson of the Board of Supervisors.
38     (d)  By resolution, one additional Board Supervisor may be
39appointed by each additional general-purpose local government
40that has adopted a resolution authorizing the Authority to
41provide services and facilities within a service area within its
42boundaries and that has entered into an interlocal agreement
43with the Authority authorizing the Authority to provide its
44potable or nonpotable water or wastewater management or delivery
45services or programs to retail customers within such service
46area, provided such interlocal agreement expressly provides for
47the appointment of such interlocal member of the Board of
48Supervisors. Such appointment shall be effective only for so
49long as the interlocal agreement is effective. Any interlocal
50member appointed to the Board of Supervisors shall serve an
51initial term of not more than 3 years, ending on September 30 of
52the final year of the term.
53     Section 2.  This act shall take effect upon becoming a law.
