12 the following amendment:

15 Delete everything after the enacting clause

17 and insert:
18 Section 1. Section 627.64091, Florida Statutes, is
19 created to read:
20 627.64091 Coverage for prostate cancer screening.--
21 (1) A health insurance policy providing coverage to a
22 man age 40 or older must provide coverage for annual screening
23 for prostate cancer for such a man in accordance with the
24 prostate cancer early detection guidelines of the National
25 Comprehensive Cancer Network. The coverage may not be subject
26 to any deductible provision in the policy.
27 (2) The coverage for prostate cancer screening shall
28 consist, at a minimum, of the following tests:
29 (a) Prostate-specific antigen blood test; and
30 (b) Digital rectal examination.
31 (3) If a licensed medical practitioner recommends that

1 an insured undergo a prostate-specific antigen blood test,
2 coverage may not be denied because that person previously had
3 a digital rectal exam and the exam results were negative.
4 (4) The benefits required by this section do not limit
5 diagnostic benefits otherwise allowable under the policy.
6 Section 2. Paragraph (c) of subsection (2) of section
7 627.6515, Florida Statutes, is amended to read:
8 627.6515 Out-of-state groups.--
9 (2) Except as otherwise provided in this part, this
10 part does not apply to a group health insurance policy issued
11 or delivered outside this state under which a resident of this
12 state is provided coverage if:
13 (c) The policy provides the benefits specified in ss.
14 627.419, 627.6418, 627.6574, 627.6575, 627.6579, 627.6612,
15 627.66121, 627.66122, 627.6613, 627.667, 627.6675, 627.6691,
16 and 627.66911.
17 Section 3. Section 627.6418, Florida Statutes, is
18 created to read:
19 627.6418 Coverage for prostate cancer screening.--
20 (1) A group health insurance policy which provides
21 coverage to a man age 40 or older must provide coverage for
22 annual screening for prostate cancer for such a man in
23 accordance with the prostate cancer early detection guidelines
24 of the National Comprehensive Cancer Network. The coverage may
25 not be subject to any deductible provision in the policy.
26 (2) The coverage for prostate cancer screening shall
27 consist, at a minimum, of the following tests:
28 (a) Prostate-specific antigen blood test; and
29 (b) Digital rectal examination.
30 (3) If a licensed medical practitioner recommends that
31 an insured undergo a prostate-specific antigen blood test,

3 (4) The benefits required by this section do not limit
4 diagnostic benefits otherwise allowable under the policy.
5 Section 4. Subsection (41) is added to section 641.31,
6 Florida Statutes, to read:
7 641.31 Health maintenance contracts.--
8 (41)(a) A health maintenance organization contract
9 which provides coverage to a man age 40 or older must provide
10 coverage for annual screening for prostate cancer for such a
11 man in accordance with the prostate cancer early detection
12 guidelines of the National Comprehensive Cancer Network. The
13 coverage may not be subject to any deductible provision in the
14 contract.
15 (b) The coverage for prostate cancer screening shall
16 consist, at a minimum, of the following tests:
17 1. Prostate-specific antigen blood test; and
18 2. Digital rectal examination.
19 (c) If a licensed medical practitioner recommends that
20 a subscriber undergo a prostate-specific antigen blood test,
21 coverage may not be denied because that person previously had
22 a digital rectal exam and the exam results were negative.
23 (d) The benefits required by this subsection do not
24 limit diagnostic benefits otherwise allowable under the
25 contract.
26 Section 5. The Legislature finds that the provisions
27 of this act fulfill an important state interest.
28 Section 6. This act shall take effect January 1, 2008,
29 and shall apply to policies or contracts issued or renewed on
30 or after that date.

7 An act relating to health insurance; creating
8 ss. 627.64091 and 627.6418, F.S., and amending
9 s. 641.31, F.S.; requiring that health
10 insurance policies, group health insurance
11 policies, and health maintenance contracts
12 provide coverage for an annual screening for
13 prostate cancer for men of a specified age or
14 older; providing requirements for the
15 screening; providing that coverage for prostate
16 cancer screening does not limit diagnostic
17 benefits otherwise allowed under the policy;
18 amending s. 627.6515, F.S.; providing for the
19 benefit requirement to apply to a group health
20 insurance policy issued or delivered outside
21 the state; providing a finding that the act
22 fulfills an important state interest; providing
23 for application of the act; providing an
24 effective date.
