A bill to be entitled
2An act relating to the Health Care Clinic Act; amending s.
3400.9905, F.S.; revising the definition of the term
4"clinic" to exclude an entity that provides certain
5neonatal or pediatric health care services from licensure
6requirements; providing that pt. X of ch. 400, F.S., does
7not apply to certain clinical facilities owned by publicly
8traded corporations; providing a definition; providing an
9effective date.

11Be It Enacted by the Legislature of the State of Florida:

13     Section 1.  Paragraph (a) of subsection (4) of section
14400.9905, Florida Statutes, is amended, and paragraph (l) is
15added to that subsection, to read:
16     400.9905  Definitions.--
17     (4)  "Clinic" means an entity at which health care services
18are provided to individuals and which tenders charges for
19reimbursement for such services, including a mobile clinic and a
20portable equipment provider. For purposes of this part, the term
21does not include and the licensure requirements of this part do
22not apply to:
23     (a)  Entities licensed or registered by the state under
24chapter 395; or entities licensed or registered by the state and
25providing only health care services within the scope of services
26authorized under their respective licenses granted under ss.
27383.30-383.335, chapter 390, chapter 394, chapter 397, this
28chapter except part X, chapter 429, chapter 463, chapter 465,
29chapter 466, chapter 478, part I of chapter 483, chapter 484, or
30chapter 651; end-stage renal disease providers authorized under
3142 C.F.R. part 405, subpart U; or providers certified under 42
32C.F.R. part 485, subpart B or subpart H; or any entity that
33provides neonatal or pediatric hospital-based health care
34services or other health care services by licensed practitioners
35solely within a hospital licensed under chapter 395.
36     (1)  Orthotic or prosthetic clinical facilities that are a
37publicly traded corporation or that are wholly owned, directly
38or indirectly, by a publicly traded corporation. As used in this
39paragraph, a "publicly traded corporation" is a corporation that
40issues securities traded on an exchange registered with the
41United States Securities and Exchange Commission as a national
42securities exchange.
43     Section 2.  This act shall take effect July 1, 2007.
