1 A bill to be entitled
2 An act relating to electroconvulsive therapy
3 and psychosurgical procedures; requiring the
4 Department of Health to compile data on the
5 frequency and usage of electroconvulsive
6 therapy and psychosurgery procedures on
7 children; providing criteria for the data;
8 requiring the department to report the data to
9 the Legislature; providing an effective date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. The Department of Health shall compile data
14 concerning the frequency and usage of electroconvulsive
15 therapy and psychosurgery procedures on children under 18
16 years of age in this state. The data shall include the
17 severity of the illness requiring these procedures, any
18 adverse events resulting from the procedures, the efficacy of
19 the procedures, the number of these procedures performed over
20 a 3-year period in this state, the age of the children, and
21 the informed-consent process of each procedure. The data shall
22 also include the number of these procedures performed on
23 children who are in the custody of the Department of Children
24 and Family Services or the Department of Juvenile Justice or
25 who reside in facilities operated through the Agency for
26 Persons with Disabilities. The department shall report this
27 data to the President of the Senate and the Speaker of the
28 House of Representatives by January 1, 2008, and annually
29 thereafter.
30 Section 2. This act shall take effect July 1, 2007.

4 The committee substitute (CS) provides that the data to be
compiled by the Department of Health (DOH) must include
5 information about the number of procedures performed on
children in the custody of the Department of Children and
6 Families or the Department of Juvenile Justice, and on
children who reside in Agency for Persons with Disabilities
7 facilities. It requires DOH to report the data to the
Legislature on or before January 1, 2008, and annually
8 thereafter.
