| 2 | An act relating to Hillsboro Inlet District, Broward  | 
| 3 | County; amending chapter 99-433, Laws of Florida;  | 
| 4 | decreasing the number of members on the board of  | 
| 5 | commissioners; revising the qualifications for appointment  | 
| 6 | to the board of commissioners; providing an effective  | 
| 7 | date. |

| 9 | Be It Enacted by the Legislature of the State of Florida: | 
| 10 | 
  | 
| 11 |      Section 1.  Section 4 of chapter 99-433, Laws of Florida,  | 
| 12 | is amended to read: | 
| 13 |      Section 4.  Board of commissioners.-- | 
| 14 |      (1)  The governing body of the Hillsboro Inlet  | 
| 15 | District shall consist of eight nine commissioners, who  | 
| 16 | shall serve without compensation, except as provided for in  | 
| 17 | section 11. One representative on the governing body or  | 
| 18 | Board of Commissioners of the Hillsboro Inlet District  | 
| 19 | shall be appointed by each of the City Commissions  | 
| 20 | Commissioners or Town Councils of the following  | 
| 21 | municipalities: the City Cities of Deerfield Beach,  | 
| 22 | Florida; the Town of Hillsboro Beach, Florida; the City of  | 
| 23 | Pompano Beach, Florida; the Town of Lauderdale-By-The-Sea,;  | 
| 24 | Florida; the City of Lighthouse Point, Florida; the City of  | 
| 25 | Fort Lauderdale, Florida; and, the Village of Sea Ranch  | 
| 26 | Lakes, Florida. The Board of County Commissioners, and two  | 
| 27 | representatives shall be appointed by the County Commission  | 
| 28 | of Broward County, Florida shall appoint one representative  | 
| 29 | to the Board of Commissioners of the Hillsboro Inlet  | 
| 30 | District. Each representative so appointed by the  | 
| 31 | aforementioned governmental entities municipalities shall  | 
| 32 | represent the respective governmental entity municipality  | 
| 33 | making such appointment, and the representatives appointed  | 
| 34 | by the county commission shall represent the unincorporated  | 
| 35 | areas. The duties, functions, and responsibilities of the  | 
| 36 | district shall continue as provided for herein in the event  | 
| 37 | that any municipality represented hereby is dissolved,  | 
| 38 | merged, or fails to appoint representatives to the district  | 
| 39 | board. Said representatives appointed by the respective  | 
| 40 | municipalities shall be qualified electors, residing in the  | 
| 41 | municipality district from which they are appointed for  | 
| 42 | more than six months prior to appointment. Effective  | 
| 43 | October 1, 2007, any new representatives appointed to the  | 
| 44 | district board shall also reside within the district  | 
| 45 | boundaries, as described in section 3. Effective October 1,  | 
| 46 | 2007, any new representative appointed by the Board of  | 
| 47 | County Commissioners of Broward County shall be a qualified  | 
| 48 | elector, shall reside within Broward County, and shall  | 
| 49 | reside within the district's boundaries for more than 6  | 
| 50 | months prior to appointment. Notwithstanding any other  | 
| 51 | provision of this subsection, any representative on the  | 
| 52 | district board as of October 1, 2006, shall be exempt from  | 
| 53 | the requirement that the representative must reside within  | 
| 54 | the district's boundaries. | 
| 55 |      (2)  A majority of the quorum at a regular or special  | 
| 56 | meeting shall be sufficient for any legal action to be  | 
| 57 | taken by the governing body of the district. Said  | 
| 58 | commissioners shall be known and designated as the "Board  | 
| 59 | of Commissioners of the Hillsboro Inlet District." | 
| 60 |      (3)  All members currently qualified and holding  | 
| 61 | office as commissioners shall continue in office until  | 
| 62 | their terms expire or as otherwise provided by law. The  | 
| 63 | said commissioners shall hold office for a term of 5 years  | 
| 64 | from the date of their respective appointments from the  | 
| 65 | appointing municipality or until their successors are  | 
| 66 | appointed and qualified. To the extent that any members of  | 
| 67 | the board of commissioners are members at the time of the  | 
| 68 | adoption of this act as appointees of the Board of County  | 
| 69 | Commissioners of Broward County, such members shall  | 
| 70 | continue as members until the expiration of their  | 
| 71 | respective appointment. No later than October 1, 2007, the  | 
| 72 | board of county commissioners shall determine which of its  | 
| 73 | appointees shall continue to serve as the county  | 
| 74 | representative. The Governor of the State of Florida shall  | 
| 75 | have the power to remove any member of said board of  | 
| 76 | commissioners for cause and shall fill any vacancies that  | 
| 77 | may at any time occur therein. Each member shall give bond  | 
| 78 | to the Governor of the State of Florida for the faithful  | 
| 79 | performance of his or her duties in the sum of $10,000 with  | 
| 80 | a surety company qualified to do business in the State of  | 
| 81 | Florida, as surety, which bond shall be approved and kept  | 
| 82 | by the Clerk of the Circuit Court of Broward County,  | 
| 83 | Florida. The premiums on said bonds shall be paid as part  | 
| 84 | of the expenses of said district. | 
| 85 |      Section 2.  This act shall take effect upon becoming a law. |
