| 5 | amount at which certain contracts are subject to |
| 6 | competitive bidding or require sureties; providing an |
| 7 | effective date. |

| 9 | Be It Enacted by the Legislature of the State of Florida: |
| 10 |
|
| 11 | Section 1. Paragraphs (a), (b), and (c) of subsection (1) |
| 12 | of section 11 of section 3 of chapter 2003-370, Laws of Florida, |
| 13 | are amended to read: |
| 14 | Section 11. Award of contracts.-- |
| 15 | (1)(a) Except when done by employees of the Authority or |
| 16 | by labor supplied under agreement with the federal, state, or |
| 17 | local government or when required by or using the Consultants' |
| 18 | Competitive Negotiation Act, all construction, improvements, |
| 19 | repairs, or work of any nature done by the Authority, where the |
| 20 | entire cost or value exceeds $30,000 $15,000, shall be done only |
| 21 | under contract or contracts entered into by the Authority with |
| 22 | the lowest responsive bid from a qualified responsible bidder |
| 23 | upon proper terms, after advertisement has been given asking for |
| 24 | competitive bids, provided that the Authority may reject any and |
| 25 | all bids. |
| 26 | (b) Any contract subject to section 255.05, Florida |
| 27 | Statutes, as may be amended from time to time, in excess of |
| 28 | $50,000 $15,000 shall not be entered into for construction, |
| 29 | improvement, or repair of Authority facilities unless the |
| 30 | contractor has sufficient surety or sureties, approved by the |
| 31 | Authority, and in an amount fixed by the Authority, for the |
| 32 | faithful performance of the contract. Any such contract shall |
| 33 | include provisions that the person entering into the contract |
| 34 | with the Authority will pay for all materials furnished and |
| 35 | services rendered for the performance of the contract and may |
| 36 | maintain an action to recover for the same against the obligor |
| 37 | in the undertaking, as though such person was named therein, |
| 38 | provided the action is brought within 1 year after the time the |
| 39 | cause of action accrued. Nothing in this section shall be |
| 40 | construed to limit the power of the Authority to construct, |
| 41 | repair, or improve Authority facilities or any addition, |
| 42 | betterment, or extension thereto, directly by the officers, |
| 43 | agents, and employees of the Authority, or otherwise than by |
| 44 | contract. |
| 45 | (c) All supplies and materials costing in excess of |
| 46 | $30,000 $15,000 shall be purchased only after advertisement. The |
| 47 | Authority shall accept the lowest responsive bid from a |
| 48 | responsible bidder, kind, quality, and material being equal, but |
| 49 | the Authority has the right to reject any or all bids or select |
| 50 | a single item from any bid. |
| 51 | Section 2. This act shall take effect upon becoming a law. |
