9 | Be It Enacted by the Legislature of the State of Florida: |
10 |
|
11 | Section 1. Subsection (1) of section 893.147, Florida |
12 | Statutes, is amended to read: |
13 | 893.147 Use, possession, manufacture, delivery, |
14 | transportation, or advertisement of drug paraphernalia.-- |
15 | (1) USE OR POSSESSION OF DRUG PARAPHERNALIA.--A It is |
16 | unlawful for any person who uses, or possesses to use, or to |
17 | possess with intent to use, drug paraphernalia: |
18 | (a) To plant, propagate, cultivate, grow, harvest, |
19 | manufacture, compound, convert, produce, process, prepare, test, |
20 | analyze, pack, repack, store, contain, or conceal a controlled |
21 | substance in violation of this chapter commits a misdemeanor of |
22 | the first degree, punishable as provided in s. 775.082 or s. |
23 | 775.083. ; or |
24 | (b) To inject, ingest, inhale, or otherwise introduce into |
25 | the human body a controlled substance in violation of this |
26 | chapter commits a misdemeanor of the first degree, punishable as |
27 | provided in s. 775.082 or s. 775.083. |
28 | (c) To manufacture, compound, convert, produce, process, |
29 | or prepare methamphetamine in violation of this chapter commits |
30 | a felony of the second degree, punishable as provided in s. |
31 | 775.082, s. 775.083, or s. 775.084. |

33 | Any person who violates this subsection is guilty of a |
34 | misdemeanor of the first degree, punishable as provided in s. |
35 | 775.082 or s. 775.083. |
36 | Section 2. This act shall take effect July 1, 2007. |
