1 A bill to be entitled
2 An act relating to reproductive health services
3 and family planning; creating the Prevention
4 First Act; requiring the Secretary of Health to
5 develop and maintain certain information
6 concerning family planning and resources on the
7 website of the Department of Health; requiring
8 that the website contain certain information
9 concerning family planning and health services;
10 requiring the Department of Education to
11 develop a comprehensive family life and
12 sexuality education plan; providing
13 definitions; providing duties of licensed
14 health care facilities and practitioners
15 relating to treatment of rape survivors;
16 providing an effective date.

18 WHEREAS, the Legislature finds that many Florida women
19 and teens do not have access to birth control and information
20 about family planning, and
21 WHEREAS, the Legislature finds that the victimization
22 of women through rape is compounded by the possibility that
23 the rape survivors may suffer unintended pregnancies, and half
24 of such pregnancies end in abortion, and
25 WHEREAS, the Legislature further finds that providing
26 access to family planning information, services, and birth
27 control will prevent abortions and unintended pregnancies,
28 thereby significantly reducing the number of women and teens
29 who need medical assistance, Medicaid, KidCare, and other
30 social services, and

1 WHEREAS, the Legislature recognizes that the most
2 recent study of women in need of family planning services by
3 the Florida State University Center for Prevention and Early
4 Intervention Policy found that only 26 percent of women in
5 this state who are in need of such services are currently
6 receiving them, and
7 WHEREAS, according to the Department of Health's Family
8 Planning Program, for every dollar spent in family planning
9 services, up to $24 is saved as a result of averting
10 expenditures for public programs that support women who have
11 unintended pregnancies and their infants, NOW, THEREFORE,
12
13 Be It Enacted by the Legislature of the State of Florida:
14
15 Section 1. This act may be cited as the "Prevention
16 First Act."
17 Section 2. The Secretary of Health shall develop and
18 maintain, as part of the Department of Health's website,
19 information on family planning and referrals to local
20 community resources to assist women and families in preventing
21 unintended pregnancies. The website must provide information
22 on:
23 (1) Family planning methods, including all methods of
24 contraception and natural family planning approved by the
25 federal Food and Drug Administration;
26 (2) Basic reproductive health procedures, including
27 breast and pelvic examinations; cervical cancer screenings;
28 screenings for sexually transmitted diseases and the human
29 immunodeficiency virus; and pregnancy diagnosis and
30 counseling; and

1 (3) Referrals to local community providers, including
2 subsidized family planning providers, which provide family
3 planning services and counseling and basic contraceptive,
4 pregnancy-preventive, and reproductive health services.
5 Section 3. Comprehensive family life and sexuality
6 education.--
7 (1) The Department of Education shall develop a plan
8 to provide comprehensive family life and sexuality education
9 no later than the 2010-2011 school year and shall implement
10 such plan by the following school year.
11 (2) As used in this section, the term "comprehensive
12 family life and sexuality education" means education in
13 kindergarten through grade 12 which:
14 (a) Respects community values and encourages family
15 communication.
16 (b) Develops skills in goal setting, communication,
17 decisionmaking, and conflict resolution.
18 (c) Contributes to healthy relationships.
19 (d) Provides education in human development and
20 sexuality which is medically accurate and age-appropriate.
21 (e) Promotes responsible behavior, including, but not
22 limited to, the promotion of abstinence.
23 (f) Addresses the medically accurate use of
24 contraception measures including, but not limited to, the rate
25 of efficacy and responsible decisionmaking skills.
26 (g) Promotes individual responsibility.
27 Section 4. Treatment for survivors of rape.--
28 (1) DEFINITIONS.--As used in this section, the term:
29 (a) "Care to a rape survivor" means medical
30 examinations, procedures, and services provided to a rape
31 survivor.

1 (b) "Incest" means a sexual offense described in s.
2 826.04, Florida Statutes.
3 (c) "Emergency birth control" means any drug or device
4 approved by the federal Food and Drug Administration which
5 prevents pregnancy after sexual intercourse.
6 (d) "Rape" means sexual battery as described in ss.
7 794.011 and 827.071, Florida Statutes.
8 (e) "Rape survivor" means a person who alleges or is
9 alleged to have been raped or is the victim of alleged incest
10 and because of the alleged offense seeks treatment as a
11 patient.
12 (2) DUTIES OF LICENSED PRACTITIONERS AND FACILITIES.--
13 (a) A health care practitioner licensed under chapter
14 458, chapter 459, or chapter 464, Florida Statutes, or a
15 health care facility licensed under chapter 395, Florida
16 Statutes, which provides care to a rape survivor shall:
17 1. Provide each rape survivor with medically and
18 factually accurate, clear, and concise information concerning
19 emergency birth control, including its indications and
20 contraindications and risks associated with its use.
21 2. Inform each female rape survivor of her medical
22 option to receive emergency birth control.
23 (b) If the emergency birth control is requested, the
24 health care practitioner shall immediately prescribe or
25 provide the rape survivor with the emergency birth control if
26 it is determined by the practitioner to be medically
27 appropriate.
28 Section 5. This act shall take effect upon becoming a
29 law.
