18 Section 1. Section 267.175, Florida Statutes, is
19 created to read:
20 267.175 Florida African-American Culture and Heritage
21 Coordinating Council.--
22 (1)(a) There is created within the Department of State
23 the Florida African-American Culture and Heritage Coordinating
24 Council, a coordinating council as defined in s. 20.03. The
25 council is subject to the requirements and restrictions of s.
26 20.052.
27 (b) The council is administratively housed within the
28 Department of State, but it shall perform its duties and
29 responsibilities independently of the department.
30 (c) The Secretary of State shall include the council's
31 request for funding in the legislative budget request of the

1 department.
2 (d) Subject to appropriations, the department shall
3 provide administrative support and consulting services to the
4 council for the council's activities and duties as provided in
5 this section.
6 (2)(a) The council shall consist of 11 members
7 appointed by, and serving at the pleasure of, the Governor.
8 Council members must be confirmed by the Senate.
9 (b) Council members must be representative of the
10 public and represent a broad cross section of the views and
11 interests of the community, including educators, clergy, and
12 civic and business leaders; philanthropists; visual, creative,
13 and performing artists; representatives of African-American
14 arts, history, and cultural organizations; and persons having
15 knowledge of, expertise in, or commitment to preserving the
16 state's African-American culture and heritage.
17 (c) Each council member shall be appointed to a term
18 of 4 years, except that initial terms may be for less than 4
19 years to ensure staggered terms. Members are eligible for
20 reappointment. If a position becomes vacant, a successor shall
21 be appointed in the manner of the original appointment for the
22 position.
23 (d) The council shall elect from among its members a
24 chair, a vice chair, and such other officers as the commission
25 considers necessary or expedient in the performance of its
26 duties. Election of officers shall occur at the first meeting
27 of the council and every 4 years thereafter or sooner if a
28 vacancy occurs.
29 (e) A majority of the total membership constitutes a
30 quorum. A vacancy in the membership does not impair the right
31 of a quorum to exercise all of the functions and duties of the

1 council. All action taken by the council shall be by a
2 majority vote of those members present.
3 (f) The initial meeting of the council shall be held
4 no later than October 1, 2007. Subsequent meetings shall be
5 held upon the call of the chair or vice chair, acting in the
6 absence of the chair.
7 (3) Members shall serve without compensation, except
8 that members are entitled to reimbursement for per diem and
9 travel expenses incurred in the performance of their duties as
10 provided in s. 112.061.
11 (4) The council is established to:
12 (a) Assist in the coordination of programs and
13 activities of state agencies, educational institutions, local
14 governments, public-private partnerships, museums, arts,
15 historical, and cultural organizations, and
16 economic-development and tourism organizations that encourage,
17 promote, or facilitate the development of knowledge in, and
18 appreciation for, African-American arts, culture, and history
19 in this state;
20 (b) Review the educational institutions in this state
21 to determine if they are complying with the requirements of s.
22 1003.42 regarding the teaching of the history of Africans and
23 African-Americans;
24 (c) Review whether the state is maximizing
25 opportunities for tourism and economic development based on
26 Florida's African-American history; and
27 (d) Develop a Florida African-American culture and
28 heritage initiative plan, which shall include recommendations
29 on how to:
30 1. Encourage and promote compliance with the
31 requirements of s. 1003.42 by incorporating African-American

1 arts, culture, and history into the curriculum of each
2 district school board;
3 2. Develop and improve tourism and economic
4 development based upon the arts, culture, and history of
5 African-Americans in this state;
6 3. Promote understanding and appreciation of the
7 historic, artistic, and cultural contributions of people of
8 African descent;
9 4. Provide guidance, support, and resources for new
10 and emerging African-American arts and historical groups and
11 increase the level of organizational capacity and program
12 administration of established groups;
13 5. Increase and attract corporate sponsorship and
14 participation in African-American culture and heritage
15 programming and tourism;
16 6. Increase opportunities for young people to learn
17 about and experience African-American arts, history, and
18 culture in the schools and youth organizations;
19 7. Invest in future generations of African-American
20 artists and historians by providing leadership-development
21 activities, apprenticeships, mentorship, scholarships, and
22 cultural programs;
23 8. Enhance computer and Internet access and usage
24 within the African-American community;
25 9. Coordinate efforts with the Commissioner of
26 Education's Task Force on African-American History and other
27 similar organizations which preserve African-American history
28 and culture; and
29 10. Recommend any legislation necessary to implement
30 the recommendations contained in the Florida African-American
31 culture and heritage initiative plan, including requested

1 appropriations.
2 (5) The council shall submit the initial Florida
3 African-American culture, and heritage initiative plan to the
4 Governor, the President of the Senate, and the Speaker of the
5 House of Representatives no later than January 1, 2009. The
6 plan shall be revised and resubmitted to the Governor and the
7 Legislature no later than January 1 of each succeeding year.
8 (6)(a) The council may support the establishment of a
9 citizen support organization to provide assistance, funding,
10 and promotional support to develop organizations,
11 institutions, and programs dedicated to expanding knowledge
12 of, and appreciation for, African-American arts, culture and
13 history in this state, as provided in the Florida
14 African-American culture and heritage initiative plan.
15 (b) The citizen support organization shall meet the
16 requirements of s. 267.17.
17 (c) The citizen support organization may receive funds
18 from individuals and from public or private sources in order
19 to fund the council's activities and implement the provisions
20 of this section. In addition to these funds, the citizen
21 support organization may receive funds from state agencies at
22 such times and in such amounts as may be appropriated by the
23 Legislature. All funds received by the citizen support
24 organization other than those necessary to pay the expenses of
25 the council shall be used exclusively to establish, support,
26 and promote the Florida African-American culture and heritage
27 initiative plan.
28 (7) The Secretary of State may appoint subcommittees
29 or advisory committees as requested by the council, which may
30 include persons who are not members of the council. Such
31 persons shall serve without compensation, except that they are

1 entitled to reimbursement for per diem and travel expenses
2 incurred in the performance of their duties as provided in s.
3 112.061.
4 (8) Each executive branch agency of the state is
5 directed to, and each local government is requested to,
6 cooperate with the council in the performance of its duties
7 under this section.
8 Section 2. The sum of $650,000 is appropriated from
9 the General Revenue Fund to the Department of State to carry
10 out the provisions of this act for the 2007-2008 fiscal year.
11 Section 3. This act shall take effect July 1, 2007.
