12 the following amendment to amendment (041916):

15 On page 12, line 23, through page 13, line 21, delete
16 those lines

18 and insert: agency in an appropriation category, other than
19 the expense appropriation category as defined in chapter 216
20 which, that the Chief Financial Officer has determined is
21 appropriate or that the Legislature has designated for payment
22 of the obligation incurred under this section.
23 Section 4. Subsections (10) and (11) of section
24 287.064, Florida Statutes, are amended to read:
25 287.064 Consolidated financing of deferred-payment
26 purchases.--
27 (10) Costs incurred pursuant to a guaranteed energy
28 performance savings contract, including the cost of efficiency
29 or energy conservation measures, each as defined in s.
30 489.145, may be financed pursuant to a master equipment
31 financing agreement; however, the costs of training,

1 operation, and maintenance may not be financed. The period of
2 time for repayment of the funds drawn pursuant to the master
3 equipment financing agreement under this subsection may exceed
4 5 years but may not exceed 20 10 years for energy-related
5 efficiency or conservation measures, excluding the costs of
6 training, operation, and maintenance. The guaranteed
7 performance savings contractor for the energy-related
8 efficiency or conservation measures shall provide for the
9 replacement of the extension of the useful life of the
10 equipment during the term of the contract.
11 (11) For purposes of consolidated financing of
12 deferred payment commodity contracts under this section by a
13 state agency, the annualized amount of any such contract must
14 be supported from available recurring funds appropriated to
15 the agency in an appropriation category, other than the
16 expense appropriation category as defined in chapter 216
