17 Section 1. Section 627.42395, Florida Statutes, is
18 amended to read:
19 627.42395 Coverage for certain prescription and
20 nonprescription enteral or amino acid formulas.--
21 (1) Notwithstanding any other provision of law, any
22 health insurance policy delivered or issued for delivery, to
23 any person in this state or any group, blanket, or franchise
24 health insurance policy delivered or issued for delivery in
25 this state shall make available to the policyholder as part of
26 the application, for an appropriate additional premium,
27 coverage for:
28 (a) Prescription and nonprescription enteral formulas
29 for home use which are physician prescribed as medically
30 necessary for the treatment of inherited diseases of amino
31 acid, organic acid, carbohydrate, or fat metabolism as well as

1 malabsorption originating from congenital defects present at
2 birth or acquired during the neonatal period. Such coverage
3 for inherited diseases of amino acids and organic acids shall
4 include food products modified to be low protein, in an amount
5 not to exceed $2,500 annually for any insured individual,
6 through the age of 24.
7 (b) Amino-acid-based elemental formulas, regardless of
8 the method of intake, for the medically necessary treatment of
9 medically diagnosed conditions such as severe multiple
10 allergies, gastroesophageal reflux, and eosinophilic disorders
11 when ordered by a licensed physician.
12 (2) This section applies to any person or family
13 notwithstanding the existence of any preexisting condition.
14 Section 2. Sections 2 through 4 of this act may be
15 cited as the "Mary B. Hooks
