  1                      A bill to be entitled

  2         An act relating to regional workforce boards;

  3         amending s. 445.007, F.S.; requiring that

  4         undisbursed balances of funds in the account of

  5         a regional workforce board at the end of each

  6         fiscal year remain in the account and increase

  7         the total funds available to implement the

  8         programs for which such funds were intended;

  9         providing an effective date.

11  Be It Enacted by the Legislature of the State of Florida:

12  

13         Section 1.  Subsection (8) of section 445.007, Florida

14  Statutes, is amended to read:

15         445.007  Regional workforce boards.--

16         (8)  For purposes of procurement, regional workforce

17  boards and their administrative entities are not state

18  agencies and are exempt from chapters 120 and 287. The

19  regional workforce boards shall apply the procurement and

20  expenditure procedures required by federal law for the

21  expenditure of federal funds. Regional workforce boards, their

22  administrative entities, committees, and subcommittees, and

23  other workforce units may authorize expenditures to award

24  suitable framed certificates, pins, or other tokens of

25  recognition for performance by units of the workforce system.

26  Regional workforce boards; their administrative entities,

27  committees, and subcommittees; and other workforce units may

28  authorize expenditures for promotional items, such as

29  t-shirts, hats, or pens printed with messages promoting

30  Florida's workforce system to employers, job seekers, and

31  program participants. However, such expenditures are subject

 1  to federal regulations applicable to the expenditure of

 2  federal funds. All contracts executed by regional workforce

 3  boards must include specific performance expectations and

 4  deliverables. Notwithstanding s. 216.301 and pursuant to s.

 5  216.351, any undisbursed balance in the account of a regional

 6  workforce board and the interest accruing to such account

 7  which remains undistributed at the end of each fiscal year

 8  shall remain in the account of the regional workforce board

 9  and shall increase the total funds available to implement the

10  programs for which such funds were intended.

11         Section 2.  This act shall take effect upon becoming a

12  law.

15                          SENATE SUMMARY

16    Provides that undisbursed balances in the accounts of
      regional workforce boards at the end of the fiscal year
17    shall remain in the account and shall increase the total
      funds available to implement the programs for which such
18    funds were intended.
