A bill to be entitled
2An act relating to the Florida Retirement System; amending
3s. 121.0515, F.S.; prescribing conditions under which
4certain former law enforcement officer members of the
5Special Risk Class of the system who were retired for
6disability may receive credit for time spent on retirement
7for disability; providing retroactive applicability;
8providing an effective date.

10Be It Enacted by the Legislature of the State of Florida:

12     Section 1.  Subsection (10) is added to section 121.0515,
13Florida Statutes, to read:
14     121.0515  Special risk membership.--
15     (10)  REEMPLOYMENT OF CERTAIN DISABLED
16MEMBERS.--Notwithstanding any other provision of law, this
17subsection applies with respect to any person who was formerly a
18member of the Special Risk Class, who qualified for membership
19in the class by reason of being employed or holding office as a
20certified law enforcement officer, and who entered the status of
21retirement due to disability because of a disability caused by a
22wound or injury received in the line of duty. If such a person's
23wound or injury becomes rehabilitated to the extent that the
24person is capable of performing the duties of a law enforcement
25officer and the person returns to work as a law enforcement
26officer who is a member of the Special Risk Class, that person
27may earn credit in the class for the time he or she was retired
28due to disability as follows: the person shall receive special
29risk credit for the time spent retired due to disability at the
30rate of 1 year of credit for such time for each 2 years of time
31spent in the Special Risk Class after reemployment. A person may
32not receive more credit under this subsection than the amount of
33time he or she was retired due to disability.
34     Section 2.  This act shall take effect upon becoming a law
35and apply retroactively to January 1, 1990.
