| 10 | Be It Enacted by the Legislature of the State of Florida: |
| 11 |

| 12 | Section 1. Subsection (10) is added to section 121.0515, |
| 13 | Florida Statutes, to read: |
| 14 | 121.0515 Special risk membership.-- |
| 15 | (10) REEMPLOYMENT OF CERTAIN DISABLED |
| 16 | MEMBERS.--Notwithstanding any other provision of law, this |
| 17 | subsection applies with respect to any person who was formerly a |
| 18 | member of the Special Risk Class, who qualified for membership |
| 19 | in the class by reason of being employed or holding office as a |
| 20 | certified law enforcement officer, and who entered the status of |
| 21 | retirement due to disability because of a disability caused by a |
| 22 | wound or injury received in the line of duty. If such a person's |
| 23 | wound or injury becomes rehabilitated to the extent that the |
| 24 | person is capable of performing the duties of a law enforcement |
| 25 | officer and the person returns to work as a law enforcement |
| 26 | officer who is a member of the Special Risk Class, that person |
| 27 | may earn credit in the class for the time he or she was retired |
| 28 | due to disability as follows: the person shall receive special |
| 29 | risk credit for the time spent retired due to disability at the |
| 30 | rate of 1 year of credit for such time for each 2 years of time |
| 31 | spent in the Special Risk Class after reemployment. A person may |
| 32 | not receive more credit under this subsection than the amount of |
| 33 | time he or she was retired due to disability. |
| 34 | Section 2. This act shall take effect upon becoming a law |
| 35 | and apply retroactively to January 1, 1990. |
