12 the following amendment:

15 Delete everything after the enacting clause

17 and insert:
18 Section 1. Section 627.638, Florida Statutes, is
19 amended to read:
20 627.638 Direct payment for ambulance, hospital,
21 medical services.--
22 (1) Any health insurance policy insuring against loss
23 or expense due to hospital confinement or to medical and
24 related services may provide for payment of benefits directly
25 to any recognized hospital, licensed basic life support or
26 advanced life support provider, doctor, or other person who
27 provided the services, in accordance with the provisions of
28 the policy. To comply with this section, the words "or to or
29 from the hospital, licensed basic life support or advanced
30 life support provider, doctor, or person rendering services
31 covered by this policy," or similar words appropriate to the

1 terms of the policy, shall be added to applicable provisions
2 of the policy.
3 (2) Whenever, in any health insurance claim form, an
4 insured specifically authorizes payment of benefits directly
5 to any recognized hospital, licensed basic life support or
6 advanced life support provider, physician, or dentist, the
7 insurer shall make such payment to the designated provider of
8 such services, unless otherwise provided in the insurance
9 contract. The insurance contract may not prohibit, and claims
10 forms must provide an option for, the payment of benefits
11 directly to a licensed hospital, licensed basic life support
12 or advanced life support provider, physician, or dentist for
13 care provided pursuant to s. 395.1041 and to a licensed basic
14 life support or advanced life support provider licensed
15 pursuant to chapter 401 for transportation or treatment. The
16 insurer may require written attestation of assignment of
17 benefits. Payment to the provider from the insurer may not be
18 more than the amount that the insurer would otherwise have
19 paid without the assignment.
20 Section 2. This act shall take effect July 1, 2007.
