1 A bill to be entitled
2 An act relating to cardrooms; amending s.
3 849.086, F.S.; redefining the term "authorized
4 game"; authorizing certain horserace, greyhound
5 race, or jai alai permitholders licensed under
6 ch. 849, F.S., to operate a cardroom at the
7 pari-mutuel facility during designated times;
8 deleting provisions authorizing the operation
9 of a cardroom only when a live pari-mutuel
10 event is conducted at the facility or when live
11 racing is occurring within a 35-mile area;
12 prescribing a maximum amount that may be
13 wagered in any authorized game involving a
14 single wager; providing an effective date.

16 Be It Enacted by the Legislature of the State of Florida:

18 Section 1. Paragraph (a) of subsection (2), paragraph
19 (b) of subsection (7), and paragraph (b) of subsection (8) of
20 section 849.086, Florida Statutes, are amended to read:
21 849.086 Cardrooms authorized.--
22 (2) DEFINITIONS.--As used in this section:
23 (a) "Authorized game" means a game or series of games
24 of cards poker which are played in a nonbanking manner.
25 (7) CONDITIONS FOR OPERATING A CARDROOM.--
26 (b) Any horserace, greyhound race, or jai alai
27 permitholder licensed under this chapter may operate a
28 cardroom at the pari-mutuel facility on any day between the
29 hours of 12 noon and 12 midnight if the permitholder conducted
30 a full schedule of live racing or games in the preceding year.
31 A cardroom may be operated at the facility only when the

1 facility is authorized to accept wagers on pari-mutuel events
2 during its authorized meet. A cardroom may operate between the
3 hours of 12 noon and 12 midnight on any day a pari-mutuel
4 event is conducted live as a part of its authorized meet.
5 However, a permitholder who holds a valid cardroom license may
6 operate a cardroom between the hours of 12 noon and 12
7 midnight on any day that live racing of the same class of
8 permit is occurring within 35 miles of its facility if no
9 other holder of that same class of permit within 35 miles is
10 operating a cardroom at such time and if all holders of the
11 same class of permit within the 35-mile area have given their
12 permission in writing to the permitholder to operate the
13 cardroom during the designated period. Application to operate
14 a cardroom under this paragraph must be made to the division
15 as part of the annual license application.
16 (8) METHOD OF WAGERS; LIMITATION.--
17 (b) The cardroom operator may limit the amount wagered
18 in any game or series of games, but the maximum bet may not
19 exceed $2 in value. There may not be more than three raises in
20 any round of betting. The fee charged by the cardroom for
21 participation in the game may shall not be included in the
22 calculation of the limitation on the bet amount provided in
23 this paragraph. However, in any authorized game that involves
24 a single wager per hand rather than multiple rounds of
25 betting, the maximum amount that may be wagered on any hand is
26 $40.
27 Section 2. This act shall take effect July 1, 2007.
