| 1 | A bill to be entitled | 
| 2 | An act relating to the Florida Highway Patrol Auxiliary;  | 
| 3 | amending s. 321.24, F.S.; incorporating a definition of  | 
| 4 | "auxiliary law enforcement officer"; conforming text;  | 
| 5 | authorizing the director of the Florida Highway Patrol to  | 
| 6 | issue certain items to a retiring auxiliary officer;  | 
| 7 | providing an effective date. |

| 9 | Be It Enacted by the Legislature of the State of Florida: | 
| 10 | 
  | 
| 11 |      Section 1.  Subsection (1) of section 321.24, Florida  | 
| 12 | Statutes, is amended, and subsection (6) is added to that  | 
| 13 | section, to read: | 
| 14 |      321.24  Members of an auxiliary to Florida Highway  | 
| 15 | Patrol.-- | 
| 16 |      (1)  The director of the Florida Highway Patrol is hereby  | 
| 17 | authorized to establish an auxiliary to the Florida Highway  | 
| 18 | Patrol to be composed of such persons who may volunteer to serve  | 
| 19 | as members of an auxiliary to the Florida Highway Patrol as  | 
| 20 | defined in s. 943.10(8). Such service to be without compensation  | 
| 21 | to the individual so volunteering. | 
| 22 |      (6)  The director of the Florida Highway Patrol may present  | 
| 23 | to an officer who retires from the Florida Highway Patrol  | 
| 24 | Auxiliary after a minimum of 20 years of service one complete  | 
| 25 | uniform, including the badge worn by that officer; the officer's  | 
| 26 | service handgun, if one was issued as part of the officer's  | 
| 27 | equipment; and an identification card clearly marked "RETIRED." | 
| 28 |      Section 2.  Subsection (8) of section 943.10, Florida  | 
| 29 | Statutes, reads: | 
| 30 |      943.10  Definitions; ss. 943.085-943.255.--The following  | 
| 31 | words and phrases as used in ss. 943.085-943.255 are defined as  | 
| 32 | follows: | 
| 33 |      (8)  "Auxiliary law enforcement officer" means any person  | 
| 34 | employed or appointed, with or without compensation, who aids or  | 
| 35 | assists a full-time or part-time law enforcement officer and  | 
| 36 | who, while under the direct supervision of a full-time or part- | 
| 37 | time law enforcement officer, has the authority to arrest and  | 
| 38 | perform law enforcement functions. | 
| 39 |      Section 3.  This act shall take effect July 1, 2007. |
