A bill to be entitled
2An act relating to the Florida Highway Patrol Auxiliary;
3amending s. 321.24, F.S.; incorporating a definition of
4"auxiliary law enforcement officer"; conforming text;
5authorizing the director of the Florida Highway Patrol to
6issue certain items to a retiring auxiliary officer;
7providing an effective date.

9Be It Enacted by the Legislature of the State of Florida:

11     Section 1.  Subsection (1) of section 321.24, Florida
12Statutes, is amended, and subsection (6) is added to that
13section, to read:
14     321.24  Members of an auxiliary to Florida Highway
15Patrol.--
16     (1)  The director of the Florida Highway Patrol is hereby
17authorized to establish an auxiliary to the Florida Highway
18Patrol to be composed of such persons who may volunteer to serve
19as members of an auxiliary to the Florida Highway Patrol as
20defined in s. 943.10(8). Such service to be without compensation
21to the individual so volunteering.
22     (6)  The director of the Florida Highway Patrol may present
23to an officer who retires from the Florida Highway Patrol
24Auxiliary after a minimum of 20 years of service one complete
25uniform, including the badge worn by that officer; the officer's
26service handgun, if one was issued as part of the officer's
27equipment; and an identification card clearly marked "RETIRED."
28     Section 2.  Subsection (8) of section 943.10, Florida
29Statutes, reads:
30     943.10  Definitions; ss. 943.085-943.255.--The following
31words and phrases as used in ss. 943.085-943.255 are defined as
32follows:
33     (8)  "Auxiliary law enforcement officer" means any person
34employed or appointed, with or without compensation, who aids or
35assists a full-time or part-time law enforcement officer and
36who, while under the direct supervision of a full-time or part-
37time law enforcement officer, has the authority to arrest and
38perform law enforcement functions.
39     Section 3.  This act shall take effect July 1, 2007.
