1 A bill to be entitled
2 An act relating to rehabilitation of children
3 who have moderate to severe brain injury;
4 requiring development of a program to make
5 available financial support for rehabilitation
6 of children who have moderate or severe brain
7 injury; specifying minimum criteria for
8 inpatient care; authorizing provision of
9 financial support pending institution of the
10 program; requiring the Office of Trauma in the
11 Department of Health's Division of Emergency
12 Medical Operations to conduct a survey
13 concerning trauma centers designated to care
14 for injured children; requiring the department
15 to estimate the demand for, and a per diem
16 payment for, rehabilitation services for
17 children who have moderate or severe brain
18 injury; requiring the Agency for Health Care
19 Administration to identify and commit certain
20 funds from current Medicaid payments which may
21 be used to support the availability of such
22 rehabilitation services; specifying the manner
23 by which the Department of Health must ensure
24 that certain rehabilitation services and
25 outcomes are recorded in the trauma registry;
26 authorizing rulemaking by the agency and the
27 department; providing an effective date.

29 Be It Enacted by the Legislature of the State of Florida:

1 Section 1. (1) The Agency for Health Care
2 Administration and the Department of Health shall develop and
3 administer a program to make available financial support for
4 timely and comprehensive inpatient and outpatient
5 rehabilitation for each child in this state who has a moderate
6 to severe traumatic brain injury. The inpatient care shall be
7 provided for at least 4 weeks to ensure that all potential for
8 recovery is addressed and to identify and provide for seamless
9 continuation of the appropriate level of care for the child.
10 (2) The Office of Trauma in the Department of Health's
11 Division of Emergency Medical Operations shall conduct a
12 survey of all existing trauma centers that are designated to
13 care for injured children in this state. Based on the survey
14 results, the department shall:
15 (a) Develop an inventory of regionally available
16 rehabilitation facilities and estimate the potential annual
17 volume of the rehabilitation services described in subsection
18 (1); and
19 (b) Define an acceptable per diem payment for such
20 rehabilitation services which reflects local costs and
21 appropriate economic indicators.
22 (3) The Agency for Health Care Administration shall
23 identify funds from current Medicaid payments that are
24 designed to enhance the care of children and that may be used
25 to support the availability of the rehabilitation services
26 specified in subsection (1) and, based on the results of the
27 survey, commit any such funds to support the availability of
28 rehabilitation services. The agency may seek additional funds
29 if necessary.
30 (4) The Department of Health shall ensure that the
31 rehabilitation services required by this section and the

1 clinical outcomes of such services are recorded in the trauma
2 registry in a manner that integrates the management of data
3 between the rehabilitation facility and designated trauma
4 center and allows an annual audit of outcome trends and system
5 performance.
6 (5) The Agency for Health Care Administration and the
7 Department of Health may adopt rules pursuant to ss.
8 120.536(1) and 120.54 to administer this section.
9 Section 2. This act shall take effect July 1, 2007.
