  1                      A bill to be entitled

  2         An act relating to homestead exemptions for

  3         totally and permanently disabled persons;

  4         amending s. 196.101, F.S.; providing a

  5         homestead exemption for real estate used by a

  6         person who is totally and permanently disabled

  7         due to paraplegia or hemiplegia; removing a

  8         requirement that a totally and permanently

  9         disabled person must be in a wheelchair;

10         providing an effective date.

12  Be It Enacted by the Legislature of the State of Florida:

13  

14         Section 1.  Subsection (2) of section 196.101, Florida

15  Statutes, is amended to read:

16         196.101  Exemption for totally and permanently disabled

17  persons.--

18         (2)  Any real estate used and owned as a homestead by a

19  person who is totally and permanently disabled due to

20  paraplegia or hemiplegia paraplegic, hemiplegic, or other

21  totally and permanently disabled person, as defined in s.

22  196.012(11), who must use a wheelchair for mobility or by a

23  person who is legally blind, is exempt from taxation.

24         Section 2.  This act shall take effect January 1, 2008.

27                          SENATE SUMMARY

28    Provides a homestead exemption for real estate used by a
      person who is totally and permanently disabled due to
29    paraplegia or hemiplegia. Removes a requirement that a
      totally and permanently disabled person must be in a
30    wheelchair.
