4     Amendment (with title amendment)
5     Remove everything after the enacting clause and insert:
6     Section 1.  Section 1012.225, Florida Statutes, is created
7to read:
8     1012.225  Merit award program for instructional
9personnel.--
10     (1)  Subject to appropriation by the Legislature, any funds
11appropriated for the purposes of this section shall be used for
12a merit award program plan for all teachers who do not have a
13negative evaluation to receive annual merit awards to bring
14their salaries up to the national average salaries, as
15determined by the United States Department of Education, within
165 years.
17     (a)  By July 1, 2012, the beginning salary for full-time
18public school teachers shall be no less than the national
19average beginning salary for full-time public school teachers.
20     (b)  By July 1 2012, the average salary for full-time
21public school teachers shall be no less than the national
22average salary for full-time public school teachers.
23     (c)  The increases in the beginning and the average full-
24time public school teacher salaries shall be independent of
25employee benefits and shall not alter, jeopardize, or decrease
26existing employee benefits. Payment of the costs associated with
27increasing beginning and average teacher salaries is the
28responsibility of the state and not of school districts.
29     (2)  Nothing in this section shall impair collective
30bargaining.
31     Section 2.  Proviso language in Specific Appropriation 91
32of the 2006-2007 General Appropriations Act, chapter 2006-25,
33Laws of Florida, and section 3 of chapter 2006-26, Laws of
34Florida, relating to the Special Teachers Are Rewarded
35performance pay plan (STAR Plan), are repealed.
36     Section 3.  Effective June 30, 2007, s. 1012.22(1)(c)4.,
37Florida Statutes, is repealed. Rules adopted by the State Board
38of Education pursuant to s. 1012.22, Florida Statutes, which are
39in conflict with this act are suspended.
40     Section 4.  Except as otherwise expressly provided in this
41act, this act shall take effect upon becoming a law.

53of Florida, relating to implementing provisions for the
54Special Teachers Are Rewarded performance pay plan (STAR
55Plan); repealing s. 1012.22(1)(c)4., F.S., relating to a
56performance-pay policy for school administrators and
57instructional personnel; suspending rules adopted by the
58State Board of Education that are in conflict with the
59act; providing effective dates.
