| 6 | Section 1. Section 1012.225, Florida Statutes, is created |
| 7 | to read: |
| 8 | 1012.225 Merit award program for instructional |
| 9 | personnel.-- |
| 10 | (1) Subject to appropriation by the Legislature, any funds |
| 11 | appropriated for the purposes of this section shall be used for |
| 12 | a merit award program plan for all teachers who do not have a |
| 13 | negative evaluation to receive annual merit awards to bring |
| 14 | their salaries up to the national average salaries, as |
| 15 | determined by the United States Department of Education, within |
| 16 | 5 years. |
| 17 | (a) By July 1, 2012, the beginning salary for full-time |
| 18 | public school teachers shall be no less than the national |
| 19 | average beginning salary for full-time public school teachers. |
| 20 | (b) By July 1 2012, the average salary for full-time |
| 21 | public school teachers shall be no less than the national |
| 22 | average salary for full-time public school teachers. |
| 23 | (c) The increases in the beginning and the average full- |
| 24 | time public school teacher salaries shall be independent of |
| 25 | employee benefits and shall not alter, jeopardize, or decrease |
| 26 | existing employee benefits. Payment of the costs associated with |
| 27 | increasing beginning and average teacher salaries is the |
| 28 | responsibility of the state and not of school districts. |
| 29 | (2) Nothing in this section shall impair collective |
| 30 | bargaining. |
| 31 | Section 2. Proviso language in Specific Appropriation 91 |
| 32 | of the 2006-2007 General Appropriations Act, chapter 2006-25, |
| 33 | Laws of Florida, and section 3 of chapter 2006-26, Laws of |
| 34 | Florida, relating to the Special Teachers Are Rewarded |
| 35 | performance pay plan (STAR Plan), are repealed. |
| 36 | Section 3. Effective June 30, 2007, s. 1012.22(1)(c)4., |
| 37 | Florida Statutes, is repealed. Rules adopted by the State Board |
| 38 | of Education pursuant to s. 1012.22, Florida Statutes, which are |
| 39 | in conflict with this act are suspended. |
| 40 | Section 4. Except as otherwise expressly provided in this |
| 41 | act, this act shall take effect upon becoming a law. |
