| 6 | Section 2. Subsection (1) of section 112.533, Florida |
| 7 | Statutes, is amended to read: |
| 8 | 112.533 Receipt and processing of complaints.-- |
| 9 | (1) (a) Every law enforcement agency and correctional |
| 10 | agency shall establish and put into operation a system for the |
| 11 | receipt, investigation, and determination of complaints received |
| 12 | by such agency from any person, which shall be the procedure for |
| 13 | investigating a complaint against a law enforcement and |
| 14 | correctional officer and for determining whether to proceed with |
| 15 | disciplinary action or to file disciplinary charges, |
| 16 | notwithstanding any other law or ordinance to the contrary. This |
| 17 | subsection does not preclude the Criminal Justice Standards and |
| 18 | Training Commission from exercising its authority under chapter |
| 19 | 943. |
| 20 | (b) Any governmental agency or political subdivision who |
| 21 | initiates or receives a complaint against a law enforcement |
| 22 | officer or correctional officer must immediately forward such |
| 23 | complaint to the employing agency of the officer who is the |
| 24 | subject of the complaint for review or investigation. |
