24arranging certain prohibited activities; providing
25penalties; amending s. 796.07, F.S.; revising provisions
26prohibiting prostitution, lewdness, and assignation;
27amending s. 796.09, F.S.; revising provisions providing a
28civil action against persons who coerce or induce certain
29activities; providing for actions against the owner or
30operator of any adult entertainment establishment or
31unlicensed massage establishment used to facilitate
32certain prohibited activities or persons having direct
33control over or the ability to edit the content of a web
34page used to facilitate certain prohibited activities;
35creating s. 796.101, F.S.; providing that certain
36information provided by persons with knowledge relating to
37certain violations or information discovered as a result
38of such information may not be used against such persons
39in certain proceedings; providing exceptions; providing
40applicability; creating s. 796.11, F.S.; requiring the
41Department of Law Enforcement to create a website
42containing certain information about persons convicted of
43specified violations; creating s. 938.14, F.S.; providing
44for an assessment to be paid by violators of specified
45provisions; providing for disposition and use of funds;
46amending s. 938.10, F.S., relating to additional court
47costs imposed in cases of certain crimes against minors,
48to conform; amending s. 772.102, F.S.; expanding the
49definition of the term "criminal activity" to include the
50offense of facilitating certain offenses for purposes of
51seeking civil remedies for criminal offenses; amending s.
52895.02, F.S.; redefining the term "racketeering activity"
53to revise the offenses included for purposes of the
54Florida RICO Act; amending s. 932.7055, F.S.; providing
55for disposition of portions of forfeited property to
56persons providing material information concerning
57specified violations and to state attorneys prosecuting
58such violations; amending ss. 322.28, 775.21, 943.0435,
59944.606, and 944.607, F.S.; conforming cross-references;
60amending s. 921.0022, F.S.; conforming the Offense
61Severity Ranking chart of the criminal punishment code;

64Be It Enacted by the Legislature of the State of Florida:
65
66     Section 1.  Section 796.011, Florida Statutes, is created
67to read:
68     796.011  Definitions.--As used in this chapter, the term:
69     (1)  "Assignation" means the making of any appointment or
70engagement for prostitution or lewdness, or any act in
71furtherance of such appointment or engagement.
72     (2)  "Coercion" means any practice of domination or
73restraint for the purpose of or with the reasonably foreseeable
74effect of causing another person to engage in or remain in
75prostitution or to relinquish earnings derived from
76prostitution, and includes, but is not limited to:
77     (a)  Physical force or threat of physical force.
78     (b)  Physical or mental torture.
79     (c)  Kidnapping.
80     (d)  Blackmail.
81     (e)  Extortion or claims of indebtedness.
82     (f)  Threat of legal complaint or report of delinquency.
83     (g)  Threatening to interfere with parental rights or
84responsibilities, whether by judicial or administrative action
85or otherwise.
86     (h)  Restraint of speech or communication with others.
87     (i)  Exploitation of a condition of developmental
88disability, cognitive limitation, affective disorder, or
89substance dependency.
90     (j)  Exploitation of victimization by sexual abuse.
91     (k)  Exploitation of pornographic performance.
92     (l)  Exploitation of human needs for food, shelter, safety,
93or affection.
94     (3)  "Inducement" means something offered for the purpose
95of or with the reasonably foreseeable effect of causing another
96person to engage in or remain in prostitution or to relinquish
97earnings derived from prostitution, and includes, but is not
98limited to:
99     (a)  Promise of legal benefit.
100     (b)  Promise of financial or material reward.
101     (c)  Promise of marriage.
102     (4)  "Lewdness" means any indecent or obscene act.
103     (5)  "Prostitution" means the giving or receiving of the
104body for sexual activity for hire; however, the term does not
105include sexual activity between spouses.
106     (6)  "Sexual activity" means oral, anal, or vaginal
107penetration by, or union with, the sexual organ of another; anal
108or vaginal penetration of another by any other object; or the
109handling or fondling of the sexual organ of another for the
110purpose of masturbation; however, the term does not include acts
111done for bona fide medical purposes.
112     Section 2.  Section 796.03, Florida Statutes, is amended to
113read:
114     796.03  Procuring minor person under age of 18 for
115prostitution.--A person who procures for prostitution, or causes
116to be prostituted, any minor person who is under the age of 18
117years commits a felony of the first second degree, punishable as
118provided in s. 775.082, s. 775.083, or s. 775.084.
119     Section 3.  Section 796.04, Florida Statutes, is amended to
120read:
121     796.04  Forcing, compelling, or coercing another to become
122a prostitute.--
123     (1)  After May 1, 1943, It is shall be unlawful for anyone
124to force, compel, or coerce another to become a prostitute.
125     (2)  A person anyone violating this section commits shall
126be guilty of a felony of the first third degree, punishable as
127provided in s. 775.082, s. 775.083, or s. 775.084.
128     Section 4.  Section 796.035, Florida Statutes, is
129redesignated as paragraph (b) of subsection (2) of section
130796.045, Florida Statutes, and amended, and section 796.045,
131Florida Statutes, is amended, to read:
132     796.045  Sex trafficking; penalties.--
133     (1)  Except as provided subsection (2), any person who
134knowingly recruits, entices, harbors, transports, provides, or
135obtains by any means a person, knowing that force, fraud, or
136coercion will be used to cause that person to engage in
137prostitution, commits the offense of sex trafficking, a felony
138of the first second degree, punishable as provided in s.
139775.082, s. 775.083, or s. 775.084.
140     (2)(a)  Any A person who violates paragraph (a) and commits
141a felony of the first degree, punishable as provided in s.
142775.082, s. 775.083, or s. 775.084, if the offense of sex
143trafficking is committed against a minor person who is under the
144age of 14 or if the such offense results in death; or.
145     (b)  796.035  Selling or buying of minors into sex
146trafficking or prostitution; penalties.--Any parent, legal
147guardian, or other person having custody or control of a minor
148who sells or otherwise transfers custody or control of such
149minor, or offers to sell or otherwise transfer custody of such
150minor, with knowledge that, as a consequence of the sale or
151transfer, force, fraud, or coercion will be used to cause the
152minor to engage in prostitution or otherwise participate in the
153trade of sex trafficking,
154
155commits a life felony of the first degree, punishable as
156provided in s. 775.082, s. 775.083, or s. 775.084.
157     Section 5.  Subsection (1) of section 796.05, Florida
158Statutes, is amended to read:
159     796.05  Deriving support from the proceeds of
160prostitution.--
161     (1)  It shall be unlawful for any person with reasonable
162belief or knowing another person is engaged in prostitution to
163live or derive support or maintenance in whole or in part,
164directly or indirectly, from what is believed to be the earnings
165or proceeds of such person's prostitution.
166     Section 6.  Section 796.06, Florida Statutes, is amended to
167read:
168     796.06  Furthering activity prohibited under this chapter
169Renting space to be used for lewdness, assignation, or
170prostitution.--
171     (1)  Any person who owns, establishes, maintains, lets,
172rents, or operates It is unlawful to let, or rent any place,
173structure, or part thereof, or trailer or other conveyance and
174who knows or should know , with the knowledge that it will be
175used for the purpose of activity prohibited under this chapter
176commits a felony of the third degree, punishable as provided in
177s. 775.082, s. 775.083, or s. 775.084 lewdness, assignation, or
178prostitution.
179     (2)  The owner or operator of any adult entertainment
180establishment or unlicensed massage establishment as defined in
181s. 847.001 who knows or should know that the establishment is
182being used, in whole or in part, for the purpose of advertising,
183facilitating, soliciting, promoting, or arranging any activity
184prohibited under this chapter, whether or not the owner or
185operator derives income from the prohibited activity, commits a
186felony of the third degree, punishable as provided in s.
187775.082, s. 775.083, or s. 775.084.
188     (3)  Any person having direct control over or the ability
189to edit the content of a web page who places, causes to be
190placed, or allows to remain, after notification of activity
191prohibited under this chapter, any language or other content on
192such web page for the purpose of advertising, facilitating,
193soliciting, promoting, or arranging any activity prohibited by
194this chapter, whether or not the person in control derives
195income from the prohibited language, content, or activity,
196commits a felony of the third degree, punishable as provided in
197s. 775.082, s. 775.083, or s. 775.084.
198     (2)  A person who violates this section commits:
199     (a)  A misdemeanor of the second degree for a first
200violation, punishable as provided in s. 775.082 or s. 775.083.
201     (b)  A misdemeanor of the first degree for a second or
202subsequent violation, punishable as provided in s. 775.082 or s.
203775.083.
204     Section 7.  Section 796.07, Florida Statutes, is amended to
205read:
206     796.07  Prohibiting prostitution, lewdness, and assignation
207etc.; evidence; penalties; definitions.--
208     (1)  As used in this section:
209     (a)  "Prostitution" means the giving or receiving of the
210body for sexual activity for hire but excludes sexual activity
211between spouses.
212     (b)  "Lewdness" means any indecent or obscene act.
213     (c)  "Assignation" means the making of any appointment or
214engagement for prostitution or lewdness, or any act in
215furtherance of such appointment or engagement.
216     (d)  "Sexual activity" means oral, anal, or vaginal
217penetration by, or union with, the sexual organ of another; anal
218or vaginal penetration of another by any other object; or the
219handling or fondling of the sexual organ of another for the
220purpose of masturbation; however, the term does not include acts
221done for bona fide medical purposes.
222     (1)(2)  It is unlawful for a person:
223     (a)  To own, establish, maintain, or operate any place,
224structure, building, or conveyance for the purpose of lewdness,
225assignation, or prostitution.
226     (a)(b)  To offer, or to offer or agree to secure, any other
227person another for the purpose of prostitution, lewdness, or
228assignation or for any other lewd or indecent act.
229     (b)(c)  To receive, or to offer or agree to receive, any
230person into any place, structure, building, or trailer or other
231conveyance for the purpose of prostitution, lewdness, or
232assignation, or to permit any person to remain there for such
233purpose.
234     (c)(d)  To direct, take, or transport, or to offer or agree
235to direct, take, or transport, any person to any place,
236structure, or building, or trailer or other conveyance or to any
237other person, with knowledge or reasonable cause to believe that
238the purpose of such directing, taking, or transporting is
239prostitution, lewdness, or assignation.
240     (d)(e)  To offer to commit, or to commit, or to engage in,
241prostitution, lewdness, or assignation.
242     (e)(f)  To solicit, induce, entice, or procure any other
243person another to commit prostitution, lewdness, or assignation,
244other than as prohibited in ss. 796.04 and 796.045.
245     (f)(g)  To reside in, enter, or remain in, any place,
246structure, or building, or to enter or remain in any trailer or
247other conveyance, for the purpose of prostitution, lewdness, or
248assignation.
249     (g)(h)  To aid, abet, or participate, other than as
250provided in s. 796.06, in prostitution, lewdness, or assignation
251any of the acts or things enumerated in this subsection.
252     (h)(i)  To purchase the services of any person, other than
253as prohibited in s. 796.03, engaged in prostitution.
254     (2)(3)(a)  In the trial of a person charged with a
255violation of this section, testimony concerning the reputation
256of any place, structure, building, or trailer or other
257conveyance involved in the charge, testimony concerning the
258reputation of any person residing in, operating, or frequenting
259such place, structure, building, or trailer or other conveyance,
260and testimony concerning the reputation of the defendant is
261admissible in evidence in support of the charge.
262     (b)  Notwithstanding any other provision of law, a police
263officer may testify as an offended party in an action regarding
264charges filed pursuant to this section.
265     (3)(4)  A person who violates any provision of this section
266commits:
267     (a)  A misdemeanor of the second degree for a first
268violation, punishable as provided in s. 775.082 or s. 775.083.
269     (b)  A misdemeanor of the first degree for a second
270violation, punishable as provided in s. 775.082 or s. 775.083.
271     (c)  A felony of the third degree for a third or subsequent
272violation, punishable as provided in s. 775.082, s. 775.083, or
273s. 775.084.
274     (4)(5)  A person who is charged with a third or subsequent
275violation of this section shall be offered admission to a
276pretrial intervention program or a substance-abuse treatment
277program as provided in s. 948.08.
278     (5)(6)  A person who violates paragraph (1)(e) (2)(f) shall
279be assessed a civil penalty of $500 if the violation results in
280any judicial disposition other than acquittal or dismissal. The
281proceeds from penalties assessed under this subsection shall be
282paid to the circuit court administrator for the sole purpose of
283paying the administrative costs of treatment-based drug court
284programs provided under s. 397.334.
285     Section 8.  Section 796.09, Florida Statutes, is amended to
286read:
287     796.09  Coercion or inducement; civil cause of action;
288evidence; defenses; attorney's fees.--
289     (1)  A person has a cause of action for compensatory and
290punitive damages against any or all of the following:
291     (a)  A person who coerced or induced that person into
292prostitution.;
293     (b)  A person who coerces or induces that person to remain
294in prostitution.; or
295     (c)  A person who uses coercion or inducement to collect or
296receive any part of that person's earnings derived from
297prostitution.
298     (d)  The owner or operator of any adult entertainment
299establishment or unlicensed massage establishment as defined in
300s. 847.001 who knows or should know that the establishment is
301being used, in whole or in part, for the purpose of advertising,
302facilitating, soliciting, promoting, or arranging any activity
303prohibited under this chapter involving that person, whether or
304not the owner or operator derives income from the activity.
305     (e)  Any person having direct control over or the ability
306to edit the content of a web page who places, causes to be
307placed, maintains, or allows to remain, after notification of
308activity prohibited under this chapter, any language or other
309content on such web page for the purpose of advertising,
310facilitating, soliciting, promoting, or arranging any activity
311prohibited by this chapter involving that person, whether or not
312the person in control derives income from the prohibited
313language, content, or activity.
314     (2)  As used in this section, the term "prostitution" has
315the same meaning as in s. 796.07.
316     (3)  As used in this section, the term "coercion" means any
317practice of domination, restraint, or inducement for the purpose
318of or with the reasonably foreseeable effect of causing another
319person to engage in or remain in prostitution or to relinquish
320earnings derived from prostitution, and includes, but is not
321limited to:
322     (a)  Physical force or threats of physical force.
323     (b)  Physical or mental torture.
324     (c)  Kidnapping.
325     (d)  Blackmail.
326     (e)  Extortion or claims of indebtedness.
327     (f)  Threat of legal complaint or report of delinquency.
328     (g)  Threat to interfere with parental rights or
329responsibilities, whether by judicial or administrative action
330or otherwise.
331     (h)  Promise of legal benefit.
332     (i)  Promise of greater financial rewards.
333     (j)  Promise of marriage.
334     (k)  Restraint of speech or communication with others.
335     (l)  Exploitation of a condition of developmental
336disability, cognitive limitation, affective disorder, or
337substance dependency.
338     (m)  Exploitation of victimization by sexual abuse.
339     (n)  Exploitation of pornographic performance.
340     (o)  Exploitation of human needs for food, shelter, safety,
341or affection.
342     (2)(4)  In the course of litigation under this section, any
343transaction about which a plaintiff testifies or produces
344evidence does not subject such plaintiff to criminal prosecution
345or any penalty or forfeiture. Further, any testimony or
346evidence, documentary or otherwise, or information directly or
347indirectly derived from such testimony or evidence which is
348given or produced by a plaintiff or a witness for a plaintiff
349shall not be used against these persons in any other
350investigation or proceeding. Such testimony or evidence,
351however, may be used against a plaintiff or a witness for a
352plaintiff upon any criminal investigation or proceeding for
353perjury committed while giving such testimony or producing such
354evidence.
355     (3)(5)  It does not constitute a defense to a complaint
356under this section that:
357     (a)  The plaintiff was paid or otherwise compensated for
358acts of prostitution or other acts prohibited under this
359chapter;
360     (b)  The plaintiff engaged in acts of prostitution or other
361acts prohibited under this chapter prior to any involvement with
362the defendant; or
363     (c)  The plaintiff made no attempt to escape, flee, or
364otherwise terminate contact with the defendant; or.
365     (d)  The plaintiff stipulated or otherwise agreed that the
366prohibited acts did not occur as a result of coercion or
367inducement.
368     (4)(6)  Evidence of convictions for prostitution or other
369acts prohibited under this chapter or prostitution-related
370offenses are inadmissible in a proceeding brought under this
371section for purposes of attacking the plaintiff's credibility.
372     (5)(7)  In any action brought under this section, the court
373shall, in its discretion, may award prevailing plaintiffs
374reasonable attorney's fees and costs.
375     Section 9.  Section 796.101, Florida Statutes, is created
376to read:
377     796.101  Witness protection.--
378     (1)(a)  Information provided to a law enforcement agency
379from any person with knowledge of a violation of this chapter
380shall not be admissible into evidence against the declarant in
381any civil or criminal proceeding in which the declarant is a
382party, except in any proceeding against the declarant for
383perjury or making a false statement or report. However, the
384declarant may admit the information if the rules of evidence
385otherwise permit it.
386     (b)  Information discovered as a result of information
387provided under paragraph (a) shall not be admissible in evidence
388against the declarant in any civil or criminal trial in which
389the declarant is a party, except in any proceeding against the
390declarant for perjury or making false statement or report.
391However, the declarant may admit the information if the rules of
392evidence otherwise permit.
393     (2)(a)  The provisions of this section apply to an
394individual participating in an investigation or proceeding and
395disclosing information on his or her own initiative in a sworn
396statement.
397     (b)  The provisions of this section do not apply once a law
398enforcement agency has initiated a criminal investigation
399against a person and advised the person of his or her right to
400avoid self-incrimination.
401     Section 10.  Section 796.11, Florida Statutes, is created
402to read:
403     796.11  Website posting.--
404     (1)  To safeguard the public, any person who has been
405adjudicated guilty of or has had adjudication withheld for any
406violation of this chapter shall have the following information
407posted on an offender website created and maintained by the
408Department of Law Enforcement:
409     (a)  The offender's name.
410     (b)  The offender's date of birth.
411     (c)  The date of the conviction.
412     (d)  The county where the offense occurred.
413     (e)  The offense committed.
414     (f)  The booking photograph taken when the offender was
415arrested. If a photograph was not taken at the time of the
416arrest, then a digital photograph shall be taken when the
417offender enters a plea.
418     (2)  The information required in subsection (1) shall be
419provided to the Department of Law Enforcement by the clerk of
420the court for the county in which the sentence is imposed. A
421certified copy of the judgment and sentence, along with the
422required information, shall be sent within 10 days after the
423date the offender is sentenced.
424     (3)  The Department of Law Enforcement must place the
425information on the website within 5 business days after the date
426it receives the information.
427     Section 11.  Section 938.14, Florida Statutes, is created
428to read:
429     938.14  Prostitution and related offenses.--Notwithstanding
430any law to the contrary, the court shall assess any defendant
431who pleads guilty or nolo contendere to, or is convicted of, a
432violation of any provision of chapter 796, regardless of whether
433adjudication was withheld, in addition to any fine and other
434penalty provided or authorized by law, an amount of $101, to be
435paid to the clerk of the court, who shall forward it to the
436Department of Revenue for deposit in the Operating Trust Fund of
437the Department of Law Enforcement to be used for the maintenance
438of the website required by s. 796.101. The clerk of the court
439shall retain $1 of each surcharge that the clerk of the court
440collects as a service charge of the clerk's office.
441     Section 12.  Subsection (1) of section 938.10, Florida
442Statutes, is amended to read:
443     938.10  Additional court cost imposed in cases of certain
444crimes against minors.--
445     (1)  If a person pleads guilty or nolo contendere to, or is
446found guilty of, regardless of adjudication, any offense against
447a minor in violation of s. 784.085, chapter 787, chapter 794, s.
448796.03, s. 800.04, chapter 827, s. 847.0145, or s. 985.701, the
449court shall impose a court cost of $101 against the offender in
450addition to any other cost or penalty required by law.
451     Section 13.  Paragraph (a) of subsection (1) of section
452772.102, Florida Statutes, is amended to read:
453     772.102  Definitions.--As used in this chapter, the term:
454     (1)  "Criminal activity" means to commit, to attempt to
455commit, to conspire to commit, or to solicit, coerce, or
456intimidate another person to commit:
457     (a)  Any crime that is chargeable by indictment or
458information under the following provisions:
459     1.  Section 210.18, relating to evasion of payment of
460cigarette taxes.
461     2.  Section 414.39, relating to public assistance fraud.
462     3.  Section 440.105 or s. 440.106, relating to workers'
463compensation.
464     4.  Part IV of chapter 501, relating to telemarketing.
465     5.  Chapter 517, relating to securities transactions.
466     6.  Section 550.235, s. 550.3551, or s. 550.3605, relating
467to dogracing and horseracing.
468     7.  Chapter 550, relating to jai alai frontons.
469     8.  Chapter 552, relating to the manufacture, distribution,
470and use of explosives.

516     Section 14.  Paragraph (a) of subsection (1) of section
517895.02, Florida Statutes, is amended to read:
518     895.02  Definitions.--As used in ss. 895.01-895.08, the
519term:
520     (1)  "Racketeering activity" means to commit, to attempt to
521commit, to conspire to commit, or to solicit, coerce, or
522intimidate another person to commit:
523     (a)  Any crime that is chargeable by indictment or

608     Section 15.  Subsection (10) is added to section 932.7055,
609Florida Statutes, to read:
610     932.7055  Disposition of liens and forfeited property.--
611     (10)  The office of the state attorney prosecuting the
612case, and a person providing information to law enforcement
613pursuant to s. 796.101 that materially assists law enforcement
614in the investigation of a felony violation under chapter 796 and
615results in the forfeiture of property pursuant to s.
616932.701(2)(a)5. or 6. shall each be entitled to a one-third
617share of any proceeds remaining after any liens have been
618satisfied and all court costs associated with the forfeiture
619proceeding have been paid. Persons who were the subject of any
620pending warrants, indictments, or information in any
621jurisdiction or were on any community supervision at the time
622they provided the information are not entitled to receive a
623share of the proceeds of the forfeiture action. Law enforcement
624officers shall not be eligible to receive a share of the
625proceeds of the forfeiture action.
626     Section 16.  Subsection (7) of section 322.28, Florida
627Statutes, is amended to read:
628     322.28  Period of suspension or revocation.--
629     (7)  Following a second or subsequent violation of s.
630796.07(1)(e)(2)(f) which involves a motor vehicle and which
631results in any judicial disposition other than acquittal or
632dismissal, in addition to any other sentence imposed, the court
633shall revoke the person's driver's license or driving privilege,
634effective upon the date of the disposition, for a period of not
635less than 1 year. A person sentenced under this subsection may
636request a hearing under s. 322.271.
637     Section 17.  Paragraph (a) of subsection (4) and paragraph
638(b) of subsection (10) of section 775.21, Florida Statutes, are
639amended to read:
640     775.21  The Florida Sexual Predators Act.--
641     (4)  SEXUAL PREDATOR CRITERIA.--
642     (a)  For a current offense committed on or after October 1,
6431993, upon conviction, an offender shall be designated as a
644"sexual predator" under subsection (5), and subject to
645registration under subsection (6) and community and public
646notification under subsection (7) if:
647     1.  The felony is:
648     a.  A capital, life, or first-degree felony violation, or
649any attempt thereof, of s. 787.01 or s. 787.02, where the victim
650is a minor and the defendant is not the victim's parent, or of
651chapter 794, s. 800.04, or s. 847.0145, or a violation of a
652similar law of another jurisdiction; or
653     b.  Any felony violation, or any attempt thereof, of s.
654787.01, s. 787.02, or s. 787.025(2)(c), where the victim is a
655minor and the defendant is not the victim's parent; chapter 794,
656excluding ss. 794.011(10) and 794.0235; s. 796.03; former s.
657796.035; s. 796.045(2)(b); s. 800.04; s. 825.1025(2)(b); s.
658827.071; s. 847.0145; or s. 985.701(1); or a violation of a
659similar law of another jurisdiction, and the offender has
660previously been convicted of or found to have committed, or has
661pled nolo contendere or guilty to, regardless of adjudication,
662any violation of s. 787.01, s. 787.02, or s. 787.025(2)(c),
663where the victim is a minor and the defendant is not the
664victim's parent; s. 794.011(2), (3), (4), (5), or (8); s.
665794.05; s. 796.03; former s. 796.035; s. 796.045(2)(b); s.
666800.04; s. 825.1025; s. 827.071; s. 847.0133; s. 847.0135; s.
667847.0145; or s. 985.701(1); or a violation of a similar law of
668another jurisdiction;
669     2.  The offender has not received a pardon for any felony
670or similar law of another jurisdiction that is necessary for the
671operation of this paragraph; and
672     3.  A conviction of a felony or similar law of another
673jurisdiction necessary to the operation of this paragraph has
674not been set aside in any postconviction proceeding.
675     (10)  PENALTIES.--
676     (b)  A sexual predator who has been convicted of or found
677to have committed, or has pled nolo contendere or guilty to,
678regardless of adjudication, any violation, or attempted
679violation, of s. 787.01, s. 787.02, or s. 787.025(2)(c), where
680the victim is a minor and the defendant is not the victim's
681parent; s. 794.011(2), (3), (4), (5), or (8); s. 794.05; s.
682796.03; former s. 796.035; s. 796.045(2)(b); s. 800.04; s.
683827.071; s. 847.0133; s. 847.0145; or s. 985.701(1); or a
684violation of a similar law of another jurisdiction when the
685victim of the offense was a minor, and who works, whether for
686compensation or as a volunteer, at any business, school, day
687care center, park, playground, or other place where children
688regularly congregate, commits a felony of the third degree,
689punishable as provided in s. 775.082, s. 775.083, or s. 775.084.
690     Section 18.  Paragraph (a) of subsection (1) of section
691943.0435, Florida Statutes, is amended to read:
692     943.0435  Sexual offenders required to register with the
693department; penalty.--
694     (1)  As used in this section, the term:
695     (a)  "Sexual offender" means a person who meets the
696criteria in subparagraph 1., subparagraph 2., or subparagraph
6973., as follows:
698     1.a.  Has been convicted of committing, or attempting,
699soliciting, or conspiring to commit, any of the criminal
700offenses proscribed in the following statutes in this state or
701similar offenses in another jurisdiction: s. 787.01, s. 787.02,

713sanction imposed in this state or in any other jurisdiction
714includes, but is not limited to, a fine, probation, community
715control, parole, conditional release, control release, or
716incarceration in a state prison, federal prison, private
717correctional facility, or local detention facility;
718     2.  Establishes or maintains a residence in this state and
719who has not been designated as a sexual predator by a court of
720this state but who has been designated as a sexual predator, as
721a sexually violent predator, or by another sexual offender
722designation in another state or jurisdiction and was, as a
723result of such designation, subjected to registration or
724community or public notification, or both, or would be if the
725person were a resident of that state or jurisdiction, without
726regard to whether the person otherwise meets the criteria for
727registration as a sexual offender; or
728     3.  Establishes or maintains a residence in this state who
729is in the custody or control of, or under the supervision of,
730any other state or jurisdiction as a result of a conviction for
731committing, or attempting, soliciting, or conspiring to commit,
732any of the criminal offenses proscribed in the following
733statutes or similar offense in another jurisdiction: s. 787.01,
734s. 787.02, or s. 787.025(2)(c), where the victim is a minor and
735the defendant is not the victim's parent; chapter 794, excluding
736ss. 794.011(10) and 794.0235; s. 796.03; former s. 796.035; s.
737796.045(2)(b); s. 800.04; s. 825.1025; s. 827.071; s. 847.0133;
738s. 847.0135; s. 847.0137; s. 847.0138; s. 847.0145; or s.
