33facilitate certain prohibited activities; requiring the

36certain information provided by persons with knowledge
37relating to certain violations or information discovered
38as a result of such information may not be used against
39such persons in certain proceedings; providing exceptions;

41requiring the Department of Law Enforcement to create a
42website containing certain information about persons
43convicted of specified violations; prohibiting disclosure
44of otherwise confidential and exempt information;

47violators of specified provisions; providing for
48disposition and use of funds; amending s. 938.10, F.S.,
49relating to additional court costs imposed in cases of

52"criminal activity" to include the offense of facilitating
53certain offenses for purposes of seeking civil remedies

58specified trust fund to persons who provide information
59that materially assists law enforcement in the

63ss. 322.28, 775.21, 943.0435, 944.606, and 944.607, F.S.;
64conforming cross-references; amending s. 921.0022, F.S.;
65conforming the offense severity ranking chart of the
66Criminal Punishment Code; providing an effective date.

68Be It Enacted by the Legislature of the State of Florida:
69
70     Section 1.  Section 796.011, Florida Statutes, is created
71to read:
72     796.011  Definitions.--As used in this chapter, the term:
73     (1)  "Assignation" means the making of any appointment or
74engagement for prostitution or lewdness, or any act in
75furtherance of such appointment or engagement.
76     (2)  "Coercion" means any practice of domination or
77restraint for the purpose of or with the reasonably foreseeable
78effect of causing another person to engage in or remain in
79prostitution or to relinquish earnings derived from
80prostitution, and includes, but is not limited to:
81     (a)  Physical force or threat of physical force.
82     (b)  Physical or mental torture.
83     (c)  Kidnapping.
84     (d)  Blackmail.
85     (e)  Extortion or claims of indebtedness.
86     (f)  Threat of legal complaint or report of delinquency.
87     (g)  Threat to interfere with parental rights or
88responsibilities, whether by judicial or administrative action
89or otherwise.
90     (h)  Restraint of speech or communication with others.
91     (i)  Exploitation of a condition of developmental
92disability, cognitive limitation, affective disorder, or
93substance dependency.
94     (j)  Exploitation of victimization by sexual abuse.
95     (k)  Exploitation of pornographic performance.
96     (l)  Exploitation of human needs for food, shelter, safety,
97or affection.
98     (3)  "Inducement" means something offered for the purpose
99of or with the reasonably foreseeable effect of causing another
100person to engage in or remain in prostitution or to relinquish
101earnings derived from prostitution, and includes, but is not
102limited to:
103     (a)  Promise of legal benefit.
104     (b)  Promise of financial or material reward.
105     (c)  Promise of marriage.
106     (4)  "Lewdness" means any indecent or obscene act.
107     (5)  "Prostitution" means the giving or receiving of the
108body for sexual activity for hire; however, the term does not
109include sexual activity between spouses.
110     (6)  "Sexual activity" means oral, anal, or vaginal
111penetration by, or union with, the sexual organ of another; anal
112or vaginal penetration of another by any other object; or the
113handling or fondling of the sexual organ of another for the
114purpose of masturbation; however, the term does not include acts
115done for bona fide medical purposes.
116     Section 2.  Section 796.03, Florida Statutes, is amended to
117read:
118     796.03  Procuring minor person under age of 18 for
119prostitution.--A person who procures for prostitution, or causes
120to be prostituted, any minor person who is under the age of 18
121years commits a felony of the first second degree, punishable as
122provided in s. 775.082, s. 775.083, or s. 775.084.
123     Section 3.  Section 796.04, Florida Statutes, is amended to
124read:
125     796.04  Forcing, compelling, or coercing another to become
126a prostitute.--
127     (1)  After May 1, 1943, It is shall be unlawful for anyone
128to force, compel, or coerce another to become a prostitute.
129     (2)  A person anyone violating this section commits shall
130be guilty of a felony of the first third degree, punishable as
131provided in s. 775.082, s. 775.083, or s. 775.084.
132     Section 4.  Section 796.035, Florida Statutes, is
133redesignated as paragraph (b) of subsection (2) of section
134796.045, Florida Statutes, and amended, and section 796.045,
135Florida Statutes, is amended, to read:
136     796.045  Sex trafficking; penalties.--
137     (1)  Except as provided subsection (2), any person who
138knowingly recruits, entices, harbors, transports, provides, or
139obtains by any means a person, knowing that force, fraud, or
140coercion will be used to cause that person to engage in
141prostitution, commits the offense of sex trafficking, a felony
142of the first second degree, punishable as provided in s.
143775.082, s. 775.083, or s. 775.084.
144     (2)(a)  Any A person who violates subsection (1) and
145commits a felony of the first degree, punishable as provided in
146s. 775.082, s. 775.083, or s. 775.084, if the offense of sex
147trafficking is committed against a minor person who is under the
148age of 14 or if the such offense results in death; or.
149     (b)  796.035  Selling or buying of minors into sex
150trafficking or prostitution; penalties.--Any parent, legal
151guardian, or other person having custody or control of a minor
152who sells or otherwise transfers custody or control of such
153minor, or offers to sell or otherwise transfer custody of such
154minor, with knowledge that, as a consequence of the sale or
155transfer, force, fraud, or coercion will be used to cause the
156minor to engage in prostitution or otherwise participate in the
157trade of sex trafficking,
158
159commits a life felony of the first degree, punishable as
160provided in s. 775.082, s. 775.083, or s. 775.084.
161     Section 5.  Subsection (1) of section 796.05, Florida
162Statutes, is amended to read:
163     796.05  Deriving support from the proceeds of
164prostitution.--
165     (1)  It shall be unlawful for any person with reasonable
166belief or knowing another person is engaged in prostitution to
167live or derive support or maintenance in whole or in part,
168directly or indirectly, from what is believed to be the earnings
169or proceeds of such person's prostitution.
170     Section 6.  Section 796.06, Florida Statutes, is amended to
171read:
172     796.06  Furthering activity prohibited under this chapter
173Renting space to be used for lewdness, assignation, or
174prostitution.--
175     (1)  Any person who owns, establishes, maintains, lets,
176rents, or operates It is unlawful to let, or rent any place,
177structure, or part thereof, or trailer or other conveyance and
178who knows or should know, with the knowledge that it will be
179used for the purpose of activity prohibited under this chapter
180commits a felony of the third degree, punishable as provided in
181s. 775.082, s. 775.083, or s. 775.084 lewdness, assignation, or
182prostitution.
183     (2)  The owner or operator of any adult entertainment
184establishment as defined in s. 847.001 who knows or should know
185that the establishment is being used, in whole or in part, for
186the purpose of advertising, facilitating, soliciting, promoting,
187or arranging any activity prohibited under this chapter, whether
188or not the owner or operator derives income from the prohibited
189activity, commits a felony of the third degree, punishable as
190provided in s. 775.082, s. 775.083, or s. 775.084.
191     (3)  Any person having direct control over or the ability
192to edit the content of a web page who places, causes to be
193placed, or allows to remain, after notification of activity
194prohibited under this chapter, any language or other content on
195such web page for the purpose of advertising, facilitating,
196soliciting, promoting, or arranging any activity prohibited by
197this chapter, whether or not the person in control derives
198income from the prohibited language, content, or activity,
199commits a felony of the third degree, punishable as provided in
200s. 775.082, s. 775.083, or s. 775.084.
201     (2)  A person who violates this section commits:
202     (a)  A misdemeanor of the second degree for a first
203violation, punishable as provided in s. 775.082 or s. 775.083.
204     (b)  A misdemeanor of the first degree for a second or
205subsequent violation, punishable as provided in s. 775.082 or s.
206775.083.
207     Section 7.  Section 796.07, Florida Statutes, is amended to
208read:
209     796.07  Prohibiting prostitution, lewdness, and assignation
210etc.; evidence; penalties; definitions.--
211     (1)  As used in this section:
212     (a)  "Prostitution" means the giving or receiving of the
213body for sexual activity for hire but excludes sexual activity
214between spouses.
215     (b)  "Lewdness" means any indecent or obscene act.
216     (c)  "Assignation" means the making of any appointment or
217engagement for prostitution or lewdness, or any act in
218furtherance of such appointment or engagement.
219     (d)  "Sexual activity" means oral, anal, or vaginal
220penetration by, or union with, the sexual organ of another; anal
221or vaginal penetration of another by any other object; or the
222handling or fondling of the sexual organ of another for the
223purpose of masturbation; however, the term does not include acts
224done for bona fide medical purposes.
225     (1)(2)  It is unlawful for a person:
226     (a)  To own, establish, maintain, or operate any place,
227structure, building, or conveyance for the purpose of lewdness,
228assignation, or prostitution.
229     (a)(b)  To offer, or to offer or agree to secure, any other
230person another for the purpose of prostitution, lewdness, or
231assignation or for any other lewd or indecent act.
232     (b)(c)  To receive, or to offer or agree to receive, any
233person into any place, structure, building, or trailer or other
234conveyance for the purpose of prostitution, lewdness, or
235assignation, or to permit any person to remain there for such
236purpose.
237     (c)(d)  To direct, take, or transport, or to offer or agree
238to direct, take, or transport, any person to any place,
239structure, or building, or trailer or other conveyance or to any
240other person, with knowledge or reasonable cause to believe that
241the purpose of such directing, taking, or transporting is
242prostitution, lewdness, or assignation.
243     (d)(e)  To offer to commit, or to commit, or to engage in,
244prostitution, lewdness, or assignation.
245     (e)(f)  To solicit, induce, entice, or procure any other
246person another to commit prostitution, lewdness, or assignation,
247other than as prohibited in ss. 796.04 and 796.045.
248     (f)(g)  To reside in, enter, or remain in, any place,
249structure, or building, or to enter or remain in any trailer or
250other conveyance, for the purpose of prostitution, lewdness, or
251assignation.
252     (g)(h)  To aid, abet, or participate, other than as
253provided in s. 796.06, in prostitution, lewdness, or assignation
254any of the acts or things enumerated in this subsection.
255     (h)(i)  To purchase the services of any person, other than
256as prohibited in s. 796.03, engaged in prostitution.
257     (2)(3)(a)  In the trial of a person charged with a
258violation of this section, testimony concerning the reputation
259of any place, structure, building, or trailer or other
260conveyance involved in the charge, testimony concerning the
261reputation of any person residing in, operating, or frequenting
262such place, structure, building, or trailer or other conveyance,
263and testimony concerning the reputation of the defendant is
264admissible in evidence in support of the charge.
265     (b)  Notwithstanding any other provision of law, a police
266officer may testify as an offended party in an action regarding
267charges filed pursuant to this section.
268     (3)(4)  A person who violates any provision of this section
269commits:
270     (a)  A misdemeanor of the second degree for a first
271violation, punishable as provided in s. 775.082 or s. 775.083.
272     (b)  A misdemeanor of the first degree for a second
273violation, punishable as provided in s. 775.082 or s. 775.083.
274     (c)  A felony of the third degree for a third or subsequent
275violation, punishable as provided in s. 775.082, s. 775.083, or
276s. 775.084.
277     (4)(5)  A person who is charged with a third or subsequent
278violation of this section shall be offered admission to a
279pretrial intervention program or a substance-abuse treatment
280program as provided in s. 948.08.
281     (5)(6)  A person who violates paragraph (1)(e) (2)(f) shall
282be assessed a civil penalty of $500 if the violation results in
283any judicial disposition other than acquittal or dismissal. The
284proceeds from penalties assessed under this subsection shall be
285paid to the circuit court administrator for the sole purpose of
286paying the administrative costs of treatment-based drug court
287programs provided under s. 397.334.
288     Section 8.  Section 796.09, Florida Statutes, is amended to
289read:
290     796.09  Coercion or inducement; civil cause of action;
291evidence; defenses; attorney's fees.--
292     (1)  A person has a cause of action for compensatory and
293punitive damages against any or all of the following:
294     (a)  A person who coerced or induced that person into
295prostitution.;
296     (b)  A person who coerces or induces that person to remain
297in prostitution.; or
298     (c)  A person who uses coercion or inducement to collect or
299receive any part of that person's earnings derived from
300prostitution.
301     (d)  The owner or operator of any adult entertainment
302establishment as defined in s. 847.001 who knows or should know
303that the establishment is being used, in whole or in part, for
304the purpose of advertising, facilitating, soliciting, promoting,
305or arranging any activity prohibited under this chapter
306involving that person, whether or not the owner or operator
307derives income from the activity.
308     (e)  Any person having direct control over or the ability
309to edit the content of a web page who places, causes to be
310placed, maintains, or allows to remain, after notification of
311activity prohibited under this chapter, any language or other
312content on such web page for the purpose of advertising,
313facilitating, soliciting, promoting, or arranging any activity
314prohibited by this chapter involving that person, whether or not
315the person in control derives income from the prohibited
316language, content, or activity.
317     (2)  As used in this section, the term "prostitution" has
318the same meaning as in s. 796.07.
319     (3)  As used in this section, the term "coercion" means any
320practice of domination, restraint, or inducement for the purpose
321of or with the reasonably foreseeable effect of causing another
322person to engage in or remain in prostitution or to relinquish
323earnings derived from prostitution, and includes, but is not
324limited to:
325     (a)  Physical force or threats of physical force.
326     (b)  Physical or mental torture.
327     (c)  Kidnapping.
328     (d)  Blackmail.
329     (e)  Extortion or claims of indebtedness.
330     (f)  Threat of legal complaint or report of delinquency.
331     (g)  Threat to interfere with parental rights or
332responsibilities, whether by judicial or administrative action
333or otherwise.
334     (h)  Promise of legal benefit.
335     (i)  Promise of greater financial rewards.
336     (j)  Promise of marriage.
337     (k)  Restraint of speech or communication with others.
338     (l)  Exploitation of a condition of developmental
339disability, cognitive limitation, affective disorder, or
340substance dependency.
341     (m)  Exploitation of victimization by sexual abuse.
342     (n)  Exploitation of pornographic performance.
343     (o)  Exploitation of human needs for food, shelter, safety,
344or affection.
345     (2)(4)  In the course of litigation under this section, any
346transaction about which a plaintiff testifies or produces
347evidence does not subject such plaintiff to criminal prosecution
348or any penalty or forfeiture. Further, any testimony or
349evidence, documentary or otherwise, or information directly or
350indirectly derived from such testimony or evidence which is
351given or produced by a plaintiff or a witness for a plaintiff
352shall not be used against these persons in any other
353investigation or proceeding. Such testimony or evidence,
354however, may be used against a plaintiff or a witness for a
355plaintiff upon any criminal investigation or proceeding for
356perjury committed while giving such testimony or producing such
357evidence.
358     (3)(5)  It does not constitute a defense to a complaint
359under this section that:
360     (a)  The plaintiff was paid or otherwise compensated for
361acts of prostitution or other acts prohibited under this
362chapter;
363     (b)  The plaintiff engaged in acts of prostitution or other
364acts prohibited under this chapter prior to any involvement with
365the defendant; or
366     (c)  The plaintiff made no attempt to escape, flee, or
367otherwise terminate contact with the defendant.
368     (4)(6)  Evidence of convictions for prostitution or other
369acts prohibited under this chapter or prostitution-related
370offenses are inadmissible in a proceeding brought under this
371section for purposes of attacking the plaintiff's credibility.
372     (5)(7)  In any action brought under this section, the court
373shall, in its discretion, may award prevailing plaintiffs
374reasonable attorney's fees and costs.
375     Section 9.  Section 796.101, Florida Statutes, is created
376to read:
377     796.101  Witness protection.--
378     (1)(a)  Information provided to a law enforcement agency
379from any person with knowledge of a violation of this chapter
380shall not be admissible into evidence against the declarant in
381any civil or criminal proceeding relating to a violation of this
382chapter in which the declarant is a party, except in any
383proceeding against the declarant for perjury or making a false
384statement or report. However, the declarant may admit the
385information if the rules of evidence otherwise permit it.
386     (b)  Information discovered as a result of information
387provided under paragraph (a) shall not be admissible in evidence
388against the declarant in any civil or criminal proceeding
389relating to a violation of this chapter in which the declarant
390is a party, except in any proceeding against the declarant for
391perjury or making false statement or report. However, the
392declarant may admit the information if the rules of evidence
393otherwise permit.
394     (2)(a)  The provisions of this section apply to an
395individual participating in an investigation or proceeding and
396disclosing information on his or her own initiative in a sworn
397statement.
398     (b)  The provisions of this section do not apply once a law
399enforcement agency has initiated a criminal investigation
400against a person and advised the person of his or her right to
401avoid self-incrimination.
402     Section 10.  Section 796.11, Florida Statutes, is created
403to read:
404     796.11  Website posting.--
405     (1)  To safeguard the public, any person 18 years of age or
406older who has been adjudicated guilty of or has had adjudication
407withheld for any felony violation of this chapter shall have the
408following information posted on an offender website created and
409maintained by the Department of Law Enforcement:
410     (a)  The offender's name.
411     (b)  The offender's date of birth.
412     (c)  The date of the conviction.
413     (d)  The county where the offense occurred.
414     (e)  The offense committed.
415     (f)  The booking photograph taken when the offender was
416arrested.
417     (2)  The information required in subsection (1) shall be
418provided to the Department of Law Enforcement electronically by
419the clerk of the court for the county in which the sentence is
420imposed within 10 days after the date the offender is sentenced.
421     (3)  The Department of Law Enforcement must place the
422information on the website within 5 business days after the date
423it receives the information. The information shall remain on the
424website for 5 years after the date of posting.
425     (4)  The department shall not allow the public to access
426information in the database that is confidential and exempt from
427public disclosure under s. 119.07(1) and s. 24(a), Art. I of the
428State Constitution.
429     (5)  The department, its personnel, and any individual or
430entity acting at the request or upon the direction of the
431department are immune from civil liability for damages for good
432faith compliance with this section and will be presumed to have
433acted in good faith by reporting information. The presumption of
434good faith is not overcome if technical or clerical errors are
435made by the department, its personnel, or any individual or
436entity acting at the request or upon the direction of the
437department in reporting the information; if the department and
438its personnel are unable to report information because the
439information has not been provided or reported by a person or
440agency required to provide or report the information to the
441department; or if the department, its personnel, or any
442individual or entity acting at the request or upon the direction
443of the department reports information that was falsely reported
444without the knowledge of the department, its personnel, or such
445individual or entity.
446     Section 11.  Section 938.14, Florida Statutes, is created
447to read:
448     938.14  Prostitution and related offenses.--Notwithstanding
449any law to the contrary, the court shall assess any defendant
450who pleads guilty or nolo contendere to, or is convicted of, a
451violation of any provision of chapter 796, regardless of whether
452adjudication was withheld, in addition to any fine and other
453penalty provided or authorized by law, an amount of $101, to be
454paid to the clerk of the court, who shall forward $100 to the
455Department of Revenue for deposit in the Operating Trust Fund of
456the Department of Law Enforcement to be used for the maintenance
457of the website required by s. 796.101. The clerk of the court
458shall retain the remaining $1 of each surcharge that the clerk
459of the court collects as a service charge of the clerk's office.
460     Section 12.  Subsection (1) of section 938.10, Florida
461Statutes, is amended to read:
462     938.10  Additional court cost imposed in cases of certain
463crimes against minors.--
464     (1)  If a person pleads guilty or nolo contendere to, or is
465found guilty of, regardless of adjudication, any offense against
466a minor in violation of s. 784.085, chapter 787, chapter 794, s.
467796.03, s. 800.04, chapter 827, s. 847.0145, or s. 985.701, the
468court shall impose a court cost of $101 against the offender in
469addition to any other cost or penalty required by law.
470     Section 13.  Paragraph (a) of subsection (1) of section
471772.102, Florida Statutes, is amended to read:
472     772.102  Definitions.--As used in this chapter, the term:
473     (1)  "Criminal activity" means to commit, to attempt to
474commit, to conspire to commit, or to solicit, coerce, or
475intimidate another person to commit:
476     (a)  Any crime that is chargeable by indictment or
477information under the following provisions:
478     1.  Section 210.18, relating to evasion of payment of
479cigarette taxes.
480     2.  Section 414.39, relating to public assistance fraud.
481     3.  Section 440.105 or s. 440.106, relating to workers'
482compensation.
483     4.  Part IV of chapter 501, relating to telemarketing.
484     5.  Chapter 517, relating to securities transactions.
485     6.  Section 550.235, s. 550.3551, or s. 550.3605, relating
486to dogracing and horseracing.
487     7.  Chapter 550, relating to jai alai frontons.
488     8.  Chapter 552, relating to the manufacture, distribution,
489and use of explosives.
490     9.  Chapter 562, relating to beverage law enforcement.

627     Section 15.  Section 796.12, Florida Statutes, is created
628to read:
629     796.12  Payment for information pertaining to a violation
630of chapter.--Any person providing information to a law
631enforcement agency pursuant to s. 796.101 that materially
632assists the law enforcement agency in the investigation of a
633violation of this chapter that leads to a felony conviction or
634withholding of adjudication shall be eligible for a $5,000
635payment from the Crime Stoppers Trust Fund within the Department
636of Legal Affairs in furtherance of the crime fighting goals of
637s. 16.555. Persons who were subject to any pending warrants,
638indictments, or informations in any jurisdiction or were on any
639community supervision at the time they provided the information
640are not entitled to the payment. Law enforcement officers shall
641not be eligible for the payment. Notwithstanding s. 16.555(5),
642funds deposited in the Crime Stoppers Trust Fund within the
643Department of Legal Affairs shall be available for the payments
644authorized in this section, subject to any restrictions placed
645on grants provided by a federal, state, or private entity
646providing grant funds.
647     Section 16.  Subsection (7) of section 322.28, Florida
648Statutes, is amended to read:
649     322.28  Period of suspension or revocation.--
650     (7)  Following a second or subsequent violation of s.
651796.07(1)(e)(2)(f) which involves a motor vehicle and which
652results in any judicial disposition other than acquittal or
653dismissal, in addition to any other sentence imposed, the court
654shall revoke the person's driver's license or driving privilege,
655effective upon the date of the disposition, for a period of not
656less than 1 year. A person sentenced under this subsection may
657request a hearing under s. 322.271.
658     Section 17.  Paragraph (a) of subsection (4) and paragraph
659(b) of subsection (10) of section 775.21, Florida Statutes, are
660amended to read:
661     775.21  The Florida Sexual Predators Act.--
662     (4)  SEXUAL PREDATOR CRITERIA.--
663     (a)  For a current offense committed on or after October 1,
6641993, upon conviction, an offender shall be designated as a
665"sexual predator" under subsection (5), and subject to
666registration under subsection (6) and community and public
667notification under subsection (7) if:
668     1.  The felony is:
669     a.  A capital, life, or first-degree felony violation, or
670any attempt thereof, of s. 787.01 or s. 787.02, where the victim
671is a minor and the defendant is not the victim's parent, or of
672chapter 794, s. 800.04, or s. 847.0145, or a violation of a
673similar law of another jurisdiction; or
674     b.  Any felony violation, or any attempt thereof, of s.

677excluding ss. 794.011(10) and 794.0235; s. 796.03; former s.
678796.035; s. 796.045(2)(b); s. 800.04; s. 825.1025(2)(b); s.
679827.071; s. 847.0145; or s. 985.701(1); or a violation of a
680similar law of another jurisdiction, and the offender has
681previously been convicted of or found to have committed, or has
682pled nolo contendere or guilty to, regardless of adjudication,
683any violation of s. 787.01, s. 787.02, or s. 787.025(2)(c),
684where the victim is a minor and the defendant is not the
685victim's parent; s. 794.011(2), (3), (4), (5), or (8); s.
686794.05; s. 796.03; former s. 796.035; s. 796.045(2)(b); s.
687800.04; s. 825.1025; s. 827.071; s. 847.0133; s. 847.0135; s.
688847.0145; or s. 985.701(1); or a violation of a similar law of
689another jurisdiction;
690     2.  The offender has not received a pardon for any felony
691or similar law of another jurisdiction that is necessary for the
692operation of this paragraph; and
693     3.  A conviction of a felony or similar law of another
694jurisdiction necessary to the operation of this paragraph has
695not been set aside in any postconviction proceeding.
696     (10)  PENALTIES.--
697     (b)  A sexual predator who has been convicted of or found
698to have committed, or has pled nolo contendere or guilty to,
699regardless of adjudication, any violation, or attempted
700violation, of s. 787.01, s. 787.02, or s. 787.025(2)(c), where
701the victim is a minor and the defendant is not the victim's
702parent; s. 794.011(2), (3), (4), (5), or (8); s. 794.05; s.
703796.03; former s. 796.035; s. 796.045(2)(b); s. 800.04; s.
704827.071; s. 847.0133; s. 847.0145; or s. 985.701(1); or a
705violation of a similar law of another jurisdiction when the
706victim of the offense was a minor, and who works, whether for
707compensation or as a volunteer, at any business, school, day
708care center, park, playground, or other place where children
709regularly congregate, commits a felony of the third degree,
710punishable as provided in s. 775.082, s. 775.083, or s. 775.084.
711     Section 18.  Paragraph (a) of subsection (1) of section
712943.0435, Florida Statutes, is amended to read:
713     943.0435  Sexual offenders required to register with the
714department; penalty.--
715     (1)  As used in this section, the term:
716     (a)  "Sexual offender" means a person who meets the
717criteria in subparagraph 1., subparagraph 2., or subparagraph
7183., as follows:
719     1.a.  Has been convicted of committing, or attempting,
720soliciting, or conspiring to commit, any of the criminal
721offenses proscribed in the following statutes in this state or

736control, parole, conditional release, control release, or
737incarceration in a state prison, federal prison, private
738correctional facility, or local detention facility;
739     2.  Establishes or maintains a residence in this state and
740who has not been designated as a sexual predator by a court of
741this state but who has been designated as a sexual predator, as
742a sexually violent predator, or by another sexual offender
743designation in another state or jurisdiction and was, as a
744result of such designation, subjected to registration or
745community or public notification, or both, or would be if the
746person were a resident of that state or jurisdiction, without
747regard to whether the person otherwise meets the criteria for
748registration as a sexual offender; or
749     3.  Establishes or maintains a residence in this state who
750is in the custody or control of, or under the supervision of,
751any other state or jurisdiction as a result of a conviction for
752committing, or attempting, soliciting, or conspiring to commit,
753any of the criminal offenses proscribed in the following
754statutes or similar offense in another jurisdiction: s. 787.01,
755s. 787.02, or s. 787.025(2)(c), where the victim is a minor and
756the defendant is not the victim's parent; chapter 794, excluding
757ss. 794.011(10) and 794.0235; s. 796.03; former s. 796.035; s.
758796.045(2)(b); s. 800.04; s. 825.1025; s. 827.071; s. 847.0133;
