Subsection (1) of section 1001.02, Florida 3 Statutes, is amended to read: 4 1001.02 General powers of State Board of Education.-- 5 (1) The State Board of Education is the chief 6 implementing and coordinating body of public education in 7 Florida, and it shall focus on high-level policy decisions. 8 The state board It has authority to adopt rules under pursuant 9 to ss. 120.536(1) and 120.54 to implement the provisions of 10 law conferring duties upon the State Board of Education, the 11 Commissioner of Education, and the Department of Education it 12 for the improvement of the state system of K-20 public 13 education. Except as otherwise provided by law herein, the 14 State Board of Education it may, as it finds appropriate, 15 delegate its general powers to the Commissioner of Education 16 or the directors of the divisions of the department. 17 Section 7. Subsection (8) of section 1001.215, Florida 18 Statutes, is amended to read: 19 1001.215 Just Read, Florida! Office.--There is created 20 in the Department of Education the Just Read, Florida! Office. 21 The office shall be fully accountable to the Commissioner of 22 Education and shall: 23 (8) Periodically review the World Class Education 24 Sunshine State Standards for reading at all grade levels. 25 Section 8. The standards and policies 7 must emphasize integration and reinforcement of reading, 8 writing, and mathematics skills across all subjects, including 9 career awareness, career exploration, and career and technical 10 education. 11 Section 9. Paragraph (a) of subsection (16) of section 12 1001.42, Florida Statutes, is amended to read: 13 1001.42 Powers and duties of district school 14 board.--The district school board, acting as a board, shall 15 exercise all powers and perform all duties listed below: 16 (16) IMPLEMENT SCHOOL IMPROVEMENT AND 17 ACCOUNTABILITY.--Maintain a system of school improvement and 18 education accountability as provided by statute and State 19 Board of Education rule. This system of school improvement and 20 education accountability shall be consistent with, and 21 implemented through, the district's continuing system of 22 planning and budgeting required by this section and ss. 23 1008.385, 1010.01, and 1011.01. This system of school 24 improvement and education accountability shall include, but is 25 not limited to, the following: 26 (a) School improvement plans.--Annually approve and 27 require implementation of a new, amended, or continuation 28 school improvement plan for each school in the district. Florida Senate - 2007 COMMITTEE AMENDMENT Bill No. CS for SB 1238 Barcode 911348 1 youth in Department of Juvenile Justice programs. The school 2 improvement plan shall be designed to achieve the state 3 education priorities pursuant to s. 1000.03(5) and student 4 proficiency on the World Class Education Sunshine State 5 Standards under pursuant to s. 1003.41. Each plan shall 6 address student achievement goals and strategies based on 7 state and school district proficiency standards. The plan may 8 also address issues relative to other academic-related 9 matters, as determined by district school board policy, and 10 shall include an accurate, data-based analysis of student 11 achievement and other school performance data. Beginning with 12 plans approved for implementation in the 2007-2008 school 13 year, each secondary school plan must include a redesign 14 component based on the principles established in s. 1003.413. 15 For each school in the district that earns a school grade of 16 "C" or below, or is required to have a school improvement plan 17 under federal law, the school improvement plan shall, at a 18 minimum, also include: 19 1. Professional development that supports enhanced and 20 differentiated instructional strategies to improve teaching 21 and learning. 22 2. Continuous use of disaggregated student achievement 23 data to determine effectiveness of instructional strategies. 24 3. Ongoing informal and formal assessments to monitor 25 individual student progress, including progress toward mastery 26 of the World Class Education Sunshine State Standards, and to 27 redesign instruction if needed. 28 4. Alternative instructional delivery methods to 29 support remediation, acceleration, and enrichment strategies. 30 Section 10. Florida Senate - 2007 COMMITTEE AMENDMENT Bill No. CS for SB 1238 Barcode 911348 1 1002.20 K-12 student and parent rights.--Parents of 2 public school students must receive accurate and timely 3 information regarding their child's academic progress and must 4 be informed of ways they can help their child to succeed in 5 school. K-12 students and their parents are afforded numerous 6 statutory rights including, but not limited to, the following: 7 (6) EDUCATIONAL CHOICE.-- 8 (a) Public school choices.--Parents of public school 9 students may seek whatever public school choice options that 10 are applicable to their students and are available to students 11 in their school districts. These options may include 12 controlled open enrollment, lab schools, charter schools, 13 charter technical career centers, magnet schools, alternative 14 schools, special programs, advanced placement, dual 15 enrollment, International Baccalaureate, International General 16 Certificate of Secondary Education (pre-AICE), Advanced 17 International Certificate of Education, early admissions, 18 credit by examination or demonstration of competency, the New 19 World School of the Arts, the Florida School for the Deaf and 20 the Blind, the Governor's School for Science and Technology, 21 and the Florida Virtual School. These options may also include 22 the public school choice options of the Opportunity 23 Scholarship Program and the McKay Scholarships for Students 24 with Disabilities Program. 25 Section 11. Paragraph (a) of subsection (6) and 26 paragraph (a) of subsection (7) of section 1002.33, Florida 27 Statutes, are amended to read: 28 1002.33 Charter schools.-- 29 (6) APPLICATION PROCESS AND REVIEW.--Charter school 30 applications are subject to the following requirements: 31 (a) A person or entity wishing to open a charter 5 5:01 PM 04/23/07 s1238c1c-ea05-s17

Demonstrates how the school will use the guiding 3 principles and meet the statutorily defined purpose of a 4 charter school. 5 2. Provides a detailed curriculum plan that 6 illustrates how students will be provided services to attain 7 the World Class Education Sunshine State Standards. 8 3. Contains goals and objectives for improving student 9 learning and measuring that improvement. These goals and 10 objectives must indicate how much academic improvement 11 students are expected to show each year, how success will be 12 evaluated, and the specific results to be attained through 13 instruction. 14 4. Describes the reading curriculum and differentiated 15 strategies that will be used for students reading at grade 16 level or higher and a separate curriculum and strategies for 17 students who are reading below grade level. A sponsor shall 18 deny a charter if the school does not propose a reading 19 curriculum that is consistent with effective teaching 20 strategies that are grounded in scientifically based reading 21 research. 22 5. Contains an annual financial plan for each year 23 requested by the charter for operation of the school for up to 24 5 years. This plan must contain anticipated fund balances 25 based on revenue projections, a spending plan based on 26 projected revenues and expenses, and a description of controls 27 that will safeguard finances and projected enrollment trends. 28 (7) CHARTER.--The major issues involving the operation 29 of a charter school shall be considered in advance and written 30 into the charter. Florida Senate - 2007 COMMITTEE AMENDMENT Bill No. CS for SB 1238 Barcode 911348 1 hearing to ensure community input. 2 (a) The charter shall address, and criteria for 3 approval of the charter shall be based on: 4 1. The school's mission, the students to be served, 5 and the ages and grades to be included. 6 2. The focus of the curriculum, the instructional 7 methods to be used, any distinctive instructional techniques 8 to be employed, and identification and acquisition of 9 appropriate technologies needed to improve educational and 10 administrative performance which include a means for promoting 11 safe, ethical, and appropriate uses of technology which comply 12 with legal and professional standards. The charter shall 13 ensure that reading is a primary focus of the curriculum and 14 that resources are provided to identify and provide 15 specialized instruction for students who are reading below 16 grade level. The curriculum and instructional strategies for 17 reading must be consistent with the World Class Education 18 Sunshine State Standards and grounded in scientifically based 19 reading research. 20 3. The current incoming baseline standard of student 21 academic achievement, the outcomes to be achieved, and the 22 method of measurement that will be used. The criteria listed 23 in this subparagraph shall include a detailed description for 24 each of the following: 25 a. How the baseline student academic achievement 26 levels and prior rates of academic progress will be 27 established. 28 b. How these baseline rates will be compared to rates 29 of academic progress achieved by these same students while 30 attending the charter school. 31 c. Florida Senate - 2007 COMMITTEE AMENDMENT Bill No. CS for SB 1238 Barcode 911348 1 will be evaluated and compared with rates of progress of other 2 closely comparable student populations. 3 4 The district school board is required to provide academic 5 student performance data to charter schools for each of their 6 students coming from the district school system, as well as 7 rates of academic progress of comparable student populations 8 in the district school system. 9 4. The methods used to identify the educational 10 strengths and needs of students and how well educational goals 11 and performance standards are met by students attending the 12 charter school. Included in the methods is a means for the 13 charter school to ensure accountability to its constituents by 14 analyzing student performance data and by evaluating the 15 effectiveness and efficiency of its major educational 16 programs. Students in charter schools shall, at a minimum, 17 participate in the statewide assessment program created under 18 s. 1008.22. 19 5. In secondary charter schools, a method for 20 determining that a student has satisfied the requirements for 21 graduation in s. 1003.43. 22 6. A method for resolving conflicts between the 23 governing body of the charter school and the sponsor. 24 7. The admissions procedures and dismissal procedures, 25 including the school's code of student conduct. 26 8. The ways by which the school will achieve a 27 racial/ethnic balance reflective of the community it serves or 28 within the racial/ethnic range of other public schools in the 29 same school district. 30 9. The financial and administrative management of the 31 school, including a reasonable demonstration of the 8 5:01 PM 04/23/07 s1238c1c-ea05-s17
Florida Senate - 2007 COMMITTEE AMENDMENT Bill No. CS for SB 1238 Barcode 911348 1 professional experience or competence of those individuals or 2 organizations applying to operate the charter school or those 3 hired or retained to perform such professional services and 4 the description of clearly delineated responsibilities and the 5 policies and practices needed to effectively manage the 6 charter school. A description of internal audit procedures and 7 establishment of controls to ensure that financial resources 8 are properly managed must be included. Both public sector and 9 private sector professional experience shall be equally valid 10 in such a consideration. 11 10. The asset and liability projections required in 12 the application which are incorporated into the charter and 13 which shall be compared with information provided in the 14 annual report of the charter school. The charter shall ensure 15 that, if a charter school internal audit or annual financial 16 audit reveals a state of financial emergency as defined in s. 17 218.503 or deficit financial position, the auditors are 18 required to notify the charter school governing board, the 19 sponsor, and the Department of Education. The internal auditor 20 shall report such findings in the form of an exit interview to 21 the principal or the principal administrator of the charter 22 school and the chair of the governing board within 7 working 23 days after finding the state of financial emergency or deficit 24 position. A final report shall be provided to the entire 25 governing board, the sponsor, and the Department of Education 26 within 14 working days after the exit interview. When a 27 charter school is in a state of financial emergency, the 28 charter school shall file a detailed financial recovery plan 29 with the sponsor. The department, with the involvement of both 30 sponsors and charter schools, shall establish guidelines for 31 developing such plans. 9 5:01 PM 04/23/07 s1238c1c-ea05-s17

A description of procedures that identify various 2 risks and provide for a comprehensive approach to reduce the 3 impact of losses; plans to ensure the safety and security of 4 students and staff; plans to identify, minimize, and protect 5 others from violent or disruptive student behavior; and the 6 manner in which the school will be insured, including whether 7 or not the school will be required to have liability 8 insurance, and, if so, the terms and conditions thereof and 9 the amounts of coverage. 10 12. The term of the charter which shall provide for 11 cancellation of the charter if insufficient progress has been 12 made in attaining the student achievement objectives of the 13 charter and if it is not likely that such objectives can be 14 achieved before expiration of the charter. The initial term of 15 a charter shall be for 4 or 5 years. In order to facilitate 16 access to long-term financial resources for charter school 17 construction, charter schools that are operated by a 18 municipality or other public entity as provided by law are 19 eligible for up to a 15-year charter, subject to approval by 20 the district school board. A charter lab school is eligible 21 for a charter for a term of up to 15 years. In addition, to 22 facilitate access to long-term financial resources for charter 23 school construction, charter schools that are operated by a 24 private, not-for-profit, s. 501(c)(3) status corporation are 25 eligible for up to a 15-year charter, subject to approval by 26 the district school board. Such long-term charters remain 27 subject to annual review and may be terminated during the term 28 of the charter, but only according to the provisions set forth 29 in subsection (8). 30 13. The governance structure of the school, including 4 the status of the charter school as a public or private 5 employer as required in paragraph (12)(i). 6 16. A timetable for implementing the charter which 7 addresses the implementation of each element thereof and the 8 date by which the charter shall be awarded in order to meet 9 this timetable. 10 17. In the case of an existing public school being 11 converted to charter status, alternative arrangements for 12 current students who choose not to attend the charter school 13 and for current teachers who choose not to teach in the 14 charter school after conversion in accordance with the 15 existing collective bargaining agreement or district school 16 board rule in the absence of a collective bargaining 17 agreement. However, alternative arrangements shall not be 18 required for current teachers who choose not to teach in a 19 charter lab school, except as authorized by the employment 20 policies of the state university which grants the charter to 21 the lab school. 22 Section 12. Section 1002.371, Florida Statutes, is 23 created to read: 24 1002.371 Governor's School for Science and 25 Technology.--The Governor's School for Science and Technology 26 is established within the Florida K-20 public education system 27 and shall be administratively housed within the Department of 28 Education. 29 (1) The mission of the Governor's School for Science 30 and Technology is to provide advanced educational 31 opportunities in the areas of science, mathematics, 11 5:01 PM 04/23/07 s1238c1c-ea05-s17
Florida Senate - 2007 COMMITTEE AMENDMENT Bill No. CS for SB 1238 Barcode 911348 1 engineering, and technology in a residential setting with 2 highly qualified scientists and instructors organized and 3 provided in short periods of intensive specialized real-life 4 learning experiences for highly motivated and talented 5 students in grades 9 through 12. 6 (2) The school shall be located in Brevard County and 7 be situated where a formal partnership between the school and 8 the Kennedy Space Center may readily be established and 9 maintained to provide real-life learning experiences for 10 students. The attendance area for the school is the entire 11 state; however, admission to the school is a privilege 12 reserved for those qualified students who are selected through 13 a statewide application and qualification system and is not a 14 right afforded to the general population of students in this 15 state. Students enrolled in the school must reside on the 16 school's premises and be under the control of the school. 17 (3) The board of trustees created in subsection (5) 18 shall take such actions as are necessary for planning and 19 establishing the Governor's School for Science and Technology 20 as provided in this section. The board shall submit a progress 21 report to the Commissioner of Education, the Governor, the 22 President of the Senate, and the Speaker of the House of 23 Representatives by January 1, 2008, which must include a 24 timeline for future actions to be completed and a summary of 25 the legislative budget request for the 2008-2009 fiscal year. 26 (4) It is the intent of the Legislature that existing 27 facilities be used for the school and that by the 2009-2010 28 school year the school begin offering: 29 (a) Advanced learning opportunities in the areas of 30 mathematics, science, engineering, and technology to qualified 31 students; and 12 5:01 PM 04/23/07 s1238c1c-ea05-s17
Florida Senate - 2007 COMMITTEE AMENDMENT Bill No. CS for SB 1238 Barcode 911348 1 (b) Summer programs for elementary, middle, and high 2 school teachers. 3 (5)(a) A board of trustees is created for the 4 Governor's School for Science and Technology which shall 5 consist of seven members. The trustees shall be appointed by 6 the Governor and are subject to confirmation by the Senate. 7 Trustees shall be appointed to 4-year terms, except that the 8 initial terms shall be staggered so that three members are 9 appointed to 4-year terms, two members are appointed to 3-year 10 terms, and two members are appointed to 2-year terms. The 11 Governor may remove any member for cause and shall fill all 12 vacancies that occur. 13 (b) The board of trustees shall elect a chair 14 annually. The trustees are entitled to reimbursement for 15 travel expenses as provided in s. 112.061, the accounts of 16 which shall be paid by the Chief Financial Officer upon 17 itemized vouchers duly approved by the chair. 18 (c) The board of trustees may adopt rules pursuant to 19 ss. 120.536(1) and 120.54 to implement provisions of law 20 relating to operation of the Governor's School for Science and 21 Technology. Such rules shall be submitted to the State Board 22 of Education for approval or disapproval. After a rule is 23 approved by the State Board of Education, the rule shall be 24 filed immediately with the Department of State. The board of 25 trustees shall act at all times in conjunction with the rules 26 of the State Board of Education. 27 (d) The board of trustees is a body corporate and 28 shall have a corporate seal. Unless otherwise provided by law, 29 all actions of the board of trustees shall be consistent with 30 all laws and rules applicable to state agencies. Title to all other property and other assets of the 3 Governor's School for Science and Technology shall vest in the 4 State Board of Education, but the board of trustees shall have 5 complete jurisdiction over the management of the school. 6 (e) The board of trustees has full power and authority 7 to: 8 1. Appoint or remove a director, faculty, teachers, 9 and other employees according to its best judgment and fix 10 their compensation. 11 2. Procure professional services such as architectural 12 and engineering services. 13 3. Procure legal services without the prior written 14 approval of the Attorney General. 15 4. Determine eligibility of students and procedure for 16 admission, including, but not limited to: 17 a. The requirements that an individual must meet in 18 order to be qualified for admission to the Governor's School 19 for Science and Technology and the standards by which 20 applicants will be selected for admission to the school. 21 Priority must be given to individuals who excel or demonstrate 22 interest in the areas of mathematics, science, engineering, or 23 technology. The requirements and standards may include, but 24 need not be limited to, scores on tests or favorable 25 recommendations from teachers or other school officials. 26 b. The number of students that may be enrolled at the 27 school based on the resources that are available. 28 c. The procedures by which an individual may apply for 29 admission to the school or appeal a decision concerning an 30 application to attend the school. 31 5. Provide for the proper keeping of accounts and 4 records and for budgeting of funds. 5 7. Enter into contracts. 6 8. Sue and be sued. 7 9. Secure public liability insurance. 8 10. Do and perform every other matter or thing 9 requisite to the proper management, maintenance, support, and 10 control of the school at the highest efficiency economically 11 possible, taking into consideration the purposes of the 12 school. 13 11. Receive gifts, donations, and bequests of money or 14 property, real or personal, tangible or intangible, from any 15 person, firm, corporation, or other legal entity. However, the 16 board of trustees may not obligate the state to any 17 expenditure or policy that is not specifically authorized by 18 law. If the bill of sale, will, trust indenture, deed, or 19 other legal conveyance specifies terms and conditions 20 concerning the use of such money or property, the board of 21 trustees shall observe such terms and conditions. 22 12. Sell or convey by bill of sale, deed, or other 23 legal instrument any property, real or personal, received as a 24 gift, donation, or bequest, upon such terms and conditions as 25 the board of trustees considers to be in the best interest of 26 the school and its students. 27 13. Invest such moneys in securities enumerated under 28 s. 215.47(1), (2)(c), (3), (4), and (9), and in The Common 29 Fund, an Investment Management Fund exclusively for nonprofit 30 educational institutions. 31 (f) The board of trustees shall: 15 5:01 PM 04/23/07 s1238c1c-ea05-s17

Annually prepare and submit a legislative budget 2 request for the Governor's School for Science and Technology. 3 The legislative budget request shall be prepared using the 4 same format, procedures, and timelines required for the 5 submission of the legislative budget of the Department of 6 Education. The legislative budget request shall be submitted 7 to the department for review and approval. Subsequent to the 8 department's approval, the commissioner shall include the 9 Governor's School for Science and Technology in the 10 department's legislative budget request to the State Board of 11 Education, the Governor, and the Legislature. The legislative 12 budget request and the appropriation for the Governor's School 13 for Science and Technology shall be a separate identifiable 14 sum in the public schools budget entity of the Department of 15 Education. The annual appropriation for the school shall be 16 distributed monthly in payments as nearly equal as possible. 17 2. Approve and administer an annual operating budget. 18 3. Require all funds received other than gifts, 19 donations, bequests, funds raised by or belonging to student 20 clubs or student organizations, and funds held for specific 21 students or in accounts for individual students to be 22 deposited in the State Treasury and expended as authorized in 23 the General Appropriations Act. 24 4. Require all purchases to be in accordance with the 25 provisions of chapter 287, except for purchases made with 26 funds received as gifts, donations, or bequests; funds raised 27 by or belonging to student clubs or student organizations; or 28 funds held for specific students or in accounts for individual 29 students. 30 5. Ensure that the Governor's School for Science and 11 Technology complies with s. 1013.351 concerning the 12 coordination of planning between the school and local 13 governing bodies. 14 (6) If the Board of Trustees for the Governor's School 15 for Science and Technology determines that a specific 16 requirement of the School Code prohibits the implementation of 17 an innovative instructional practice by the Governor's School 18 for Science and Technology, the school shall provide a report 19 to the Legislature explaining the desired practice and the 20 statute that prohibits its implementation. 21 (7) Funding for instruction, room, board, and 22 transportation of students and for the operation of the 23 Governor's School for Science and Technology shall be as 24 authorized in the General Appropriations Act. Paragraph (b) of subsection (2) of section 6 1002.415, Florida Statutes, is amended to read: 7 1002.415 K-8 Virtual School Program.--Subject to 8 annual legislative appropriation, a kindergarten through grade 9 8 virtual school program is established within the Department 10 of Education for the purpose of making academic instruction 11 available to full-time students in kindergarten through grade 12 8 using on-line and distance learning technology. The 13 department shall use an application process to select schools 14 to deliver program instruction. 15 (2) APPLICATION.-- 16 (b) In addition to a completed application form, each 17 applicant must provide the department with: 18 1. A detailed plan describing how the school 19 curriculum and course content will conform to the World Class 20 Education Sunshine State Standards; and 21 2. An annual financial plan for each year of operation 22 of the school for a minimum of 3 years. The plan must contain 23 anticipated fund balances based on revenue projections, a 24 spending plan based on projected revenues and expenses, and a 25 description of controls that will safeguard finances and 26 projected enrollment trends. 27 Section 14. The district school boards must establish, organize, 4 and operate their public K-12 schools and educational 5 programs, employees, and facilities. Their responsibilities 6 include staff development, public K-12 school student 7 education including education for exceptional students and 8 students in juvenile justice programs, special programs, adult 9 education programs, and career education programs. 10 Additionally, district school boards must: 11 (1) Provide for the proper accounting for all students 12 of school age, for the attendance and control of students at 13 school, and for proper attention to health, safety, and other 14 matters relating to the welfare of students in the following 15 fields: 16 (i) Parental notification of acceleration 17 mechanisms.--At the beginning of each school year, notify 18 parents of students in or entering high school of the 19 opportunity and benefits of advanced placement, International 20 Baccalaureate, Advanced International Certificate of 21 Education, dual enrollment, the Governor's School for Science 22 and Technology, and Florida Virtual School courses. 23 Section 15. Section 1003.41, Florida Statutes, is 24 amended to read: 25 1003.41 World Class Education Sunshine State 26 Standards.--Public K-12 educational instruction in Florida is 27 based on the World Class Education "Sunshine State Standards 28 as defined in s. 1001.03(1)."
