1 A bill to be entitled
2 An act relating to motor vehicles; amending s.
3 320.0863, F.S.; providing definitions;
4 providing for the registration of custom
5 vehicles and street rods; providing
6 registration and equipment requirements for
7 such vehicles; exempting such vehicles from
8 certain equipment and inspection requirements;
9 providing an effective date.

11 Be It Enacted by the Legislature of the State of Florida:
12
13 Section 1. Section 320.0863, Florida Statutes, is
14 amended to read:
15 (Substantial rewording of section. See
16 s. 320.0863, F.S., for present text.)
17 320.0863 Custom vehicles and street rods; registration
18 and license plates.--
19 (1) As used in this section, the term:
20 (a) "Blue dot tail light" means a red lamp that
21 contains a blue or purple insert that is not more than one
22 inch in diameter and is installed in the rear of a motor
23 vehicle.
24 (b) "Custom vehicle" means a motor vehicle that:
25 1. Is 25 years old or older and of a model year after
26 1948 or was manufactured to resemble a vehicle that is 25
27 years old or older and of a model year after 1948; and
28 2. Has been altered from the manufacturer's original
29 design or has a body constructed from nonoriginal materials.
30 (c) "Street rod" means a motor vehicle that:

1 1. Is of a model year of 1948 or older or was
2 manufactured after 1948 to resemble a vehicle of a model year
3 of 1948 or older; and
4 2. Has been altered from the manufacturer's original
5 design or has a body constructed from nonoriginal materials.
6 (2) The model year and year of manufacture which the
7 body of a custom vehicle or street rod resembles is the model
8 year and year of manufacture listed on the certificate of
9 title, regardless of when the vehicle was actually
10 manufactured.
11 (3) To register a street rod or custom vehicle, the
12 owner shall apply to the department by submitting a completed
13 application form and providing:
14 (a) The license tax prescribed by s. 320.08(2)(a) and
15 a processing fee of $3;
16 (b) A written statement that the vehicle will not be
17 used for general daily transportation but will be maintained
18 for occasional transportation, exhibitions, club activities,
19 parades, tours, or other functions of public interest and
20 similar uses; and
21 (c) A written statement that the vehicle meets state
22 equipment and safety requirements for motor vehicles. However,
23 the vehicle must meet only the requirements that were in
24 effect in this state as a condition of sale in the year listed
25 as the model year on the certificate of title.
26 (4) The registration numbers and special license
27 plates assigned to such vehicles shall run in a separate
28 series, commencing with "Custom Vehicle 1" or "Street Rod 1,"
29 respectively, and the plates shall be of a distinguishing
30 color and design.

1 (5)(a) A vehicle registered under this section is
2 exempt from any law or local ordinance that requires periodic
3 vehicle inspections or the use and inspection of emission
4 controls.
5 (b) Such vehicle may also be equipped with blue dot
6 tail lights for stop lamps, rear turning indicator lamps, rear
7 hazard lamps, and rear reflectors.
8 Section 2. This act shall take effect July 1, 2007.

13 This CS requires a written statement the vehicle meets state
equipment and safety requirements for the year listed as the
14 model year on the certificate of title. This CS also requires
the model year and year of manufacture which the body of a
15 custom vehicle or street rod resembles be listed on the
certificate of title, regardless of when the vehicle was
16 actually manufactured.
