| 5 | Section 3. Subsection (7) is added to section 717.124, |
| 6 | Florida Statutes, to read: |
| 7 | 717.124 Unclaimed property claims.-- |
| 8 | (7) Any person who is entitled to the part of the |
| 9 | intestate estate not passing to the surviving spouse under s. |
| 10 | 732.102, or the entire intestate estate if there is no surviving |
| 11 | spouse; if there are no lineal descendants of the decedent as |
| 12 | described in s. 732.103(1)-(5), and if the person is a lineal |
| 13 | descendant of the decedent's great-grandparents who were |
| 14 | Holocaust victims as defined in s. 626.9543(3)(a), including |
| 15 | such victims in countries cooperating with the discriminatory |
| 16 | policies of Nazi Germany; and the property is presumed unclaimed |
| 17 | property under this chapter may claim an interest in the |
| 18 | unclaimed property pursuant to subsection (1). The court shall |
| 19 | allow any such descendant to meet a reasonable, not unduly |
| 20 | restrictive, standard of proof to substantiate his or her |
| 21 | lineage. |
