14 On page 264, between lines 2 and 3,
15
16 insert:
17 Section 190. Subsection (14) of section 112.061,
18 Florida Statutes, is amended to read:
19 112.061 Per diem and travel expenses of public
20 officers, employees, and authorized persons.--
21 (14) APPLICABILITY TO COUNTIES, COUNTY OFFICERS,
22 DISTRICT SCHOOL BOARDS, AND SPECIAL DISTRICTS, COMMUNITY
23 COLLEGE DISTRICTS, AND STATE UNIVERSITIES.--
24 (a) The following entities may establish rates that
25 vary from the per diem rate provided in paragraph (6)(a), the
26 subsistence rates provided in paragraph (6)(b), or the mileage
27 rate provided in paragraph (7)(d) if those rates are not less
28 than the statutorily established rates that are in effect for
29 the 2005-2006 fiscal year:
30 1. The governing body of a county by the enactment of
31 an ordinance or resolution;

1 2. A county constitutional officer, pursuant to s.
2 1(d), Art. VIII of the State Constitution, by the
3 establishment of written policy;
4 3. The governing body of a district school board by
5 the adoption of rules; or
6 4. The governing body of a special district, as
7 defined in s. 189.403(1), except those special districts that
8 are subject to s. 166.021(10), by the enactment of a
9 resolution;.
10 5. The district board of trustees of a community
11 college by the adoption of rules; or
12 6. The board of trustees of a state university by the
13 adoption of rules.
14 (b) Rates established pursuant to paragraph (a) must
15 apply uniformly to all travel by the county, county
16 constitutional officer and entity governed by that officer,
17 district school board, or special district, community college
18 district board of trustees, or state university board of
19 trustees.
20 (c) Except as otherwise provided in this subsection,
21 counties, county constitutional officers and entities governed
22 by those officers, district school boards, and special
23 districts, other than those subject to s. 166.021(10), remain
24 subject to the requirements of this section.
