A bill to be entitled
2An act relating to immunizations; amending ss. 402.305,
3402.313, and 402.3131, F.S.; adding pneumococcal conjugate
4vaccine to the list of required vaccines for enrollment in
5a child care facility, a family day care home, or a large
6family child care home; requiring the Department of Health
7to establish rules and protocols; requiring facilities and
8homes to furnish proof of compliance to the department;
9providing an effective date.

11     WHEREAS, the State of Florida recognizes the importance of
12pneumococcal conjugate vaccine for children enrolled or
13enrolling in child care programs, and
14     WHEREAS, the Florida Department of Health, Bureau of
15Immunization, acknowledges that vaccines, including pneumococcal
16conjugate vaccine, focus on disease prevention and are the most
17cost-effective medical intervention, and
18     WHEREAS, the Centers for Disease Control and Prevention,
19through the Advisory Committee on Immunization Practices,
20recommends that children be administered age-appropriate four-
21dose series of pneumococcal conjugate vaccine, and
22     WHEREAS, pneumococcal conjugate vaccine, which is licensed
23by the United States Food and Drug Administration, is effective
24in preventing invasive pneumococcal disease, and
25     WHEREAS, a recent study published in the Journal of the
26American Medical Association reveals that pneumococcal conjugate
27vaccine, when administered to children, has significantly
28reduced the number of invasive pneumococcal disease cases and
29deaths in the adult population, NOW, THEREFORE,

31Be It Enacted by the Legislature of the State of Florida:
32
33     Section 1.  Paragraphs (b) and (c) of subsection (9) of
34section 402.305, Florida Statutes, are redesignated as
35paragraphs (c) and (d), respectively, and a new paragraph (b) is
36added to that subsection, to read:
37     402.305  Licensing standards; child care facilities.--
38     (9)  ADMISSIONS AND RECORDKEEPING.--
39     (b)  Beginning July 1, 2007, the age-appropriate series of
40pneumococcal conjugate vaccine, as recommended by the Advisory
41Committee on Immunization Practices of the Centers for Disease
42Control and Prevention, shall be administered to a child younger
43than 2 years of age who is enrolled or enrolling in a child care
44facility. The department shall implement rules to add
45pneumococcal conjugate vaccine to the current list of required
46vaccines and establish protocols for children younger than 2
47years of age to catch up on missed doses. A child care facility
48must be able to furnish proof to the department of pneumococcal
49conjugate vaccine compliance for all children receiving care at
50the facility by December 1, 2007.
51     Section 2.  Subsection (14) is added to section 402.313,
52Florida Statutes, to read:
53     402.313  Family day care homes.--
54     (14)  Beginning July 1, 2007, the age-appropriate series of
55pneumococcal conjugate vaccine, as recommended by the Advisory
56Committee on Immunization Practices of the Centers for Disease
57Control and Prevention, shall be administered to a child younger
58than 2 years of age who is enrolled or enrolling in a family day
59care home. The department shall implement rules to add
60pneumococcal conjugate vaccine to the current list of required
61vaccines and establish protocols for children younger than 2
62years of age to catch up on missed doses. A family day care home
63must be able to furnish proof to the department of pneumococcal
64conjugate vaccine compliance for all children receiving care at

67Florida Statutes, to read:
68     402.3131  Large family child care homes.--
69     (9)  Beginning July 1, 2007, the age-appropriate series of
70pneumococcal conjugate vaccine, as recommended by the Advisory
71Committee on Immunization Practices of the Centers for Disease
72Control and Prevention, shall be administered to a child younger
73than 2 years of age who is enrolled or enrolling in a large
74family child care home. The department shall implement rules to
75add pneumococcal conjugate vaccine to the current list of
76required vaccines and establish protocols for children younger
77than 2 years of age to catch up on missed doses. A large family
78child care home must be able to furnish proof to the department
79of pneumococcal conjugate vaccine compliance for all children
80receiving care at the home by December 1, 2007.
81     Section 4.  This act shall take effect July 1, 2007.
