6 | family child care home; requiring the Department of Health |
7 | to establish rules and protocols; requiring facilities and |
8 | homes to furnish proof of compliance to the department; |
9 | providing an effective date. |

11 | WHEREAS, the State of Florida recognizes the importance of |
12 | pneumococcal conjugate vaccine for children enrolled or |
13 | enrolling in child care programs, and |
14 | WHEREAS, the Florida Department of Health, Bureau of |
15 | Immunization, acknowledges that vaccines, including pneumococcal |
16 | conjugate vaccine, focus on disease prevention and are the most |
17 | cost-effective medical intervention, and |
18 | WHEREAS, the Centers for Disease Control and Prevention, |
19 | through the Advisory Committee on Immunization Practices, |
20 | recommends that children be administered age-appropriate four- |
21 | dose series of pneumococcal conjugate vaccine, and |
22 | WHEREAS, pneumococcal conjugate vaccine, which is licensed |
23 | by the United States Food and Drug Administration, is effective |
24 | in preventing invasive pneumococcal disease, and |
25 | WHEREAS, a recent study published in the Journal of the |
26 | American Medical Association reveals that pneumococcal conjugate |
27 | vaccine, when administered to children, has significantly |
28 | reduced the number of invasive pneumococcal disease cases and |
29 | deaths in the adult population, NOW, THEREFORE, |
30 |

31 | Be It Enacted by the Legislature of the State of Florida: |

33 | Section 1. Paragraphs (b) and (c) of subsection (9) of |
34 | section 402.305, Florida Statutes, are redesignated as |
35 | paragraphs (c) and (d), respectively, and a new paragraph (b) is |
36 | added to that subsection, to read: |
37 | 402.305 Licensing standards; child care facilities.-- |
38 | (9) ADMISSIONS AND RECORDKEEPING.-- |
39 | (b) Beginning July 1, 2007, the age-appropriate series of |
40 | pneumococcal conjugate vaccine, as recommended by the Advisory |
41 | Committee on Immunization Practices of the Centers for Disease |
42 | Control and Prevention, shall be administered to a child younger |
43 | than 2 years of age who is enrolled or enrolling in a child care |
44 | facility. The department shall implement rules to add |
45 | pneumococcal conjugate vaccine to the current list of required |
46 | vaccines and establish protocols for children younger than 2 |
47 | years of age to catch up on missed doses. A child care facility |
48 | must be able to furnish proof to the department of pneumococcal |
49 | conjugate vaccine compliance for all children receiving care at |
50 | the facility by December 1, 2007. |
51 | Section 2. Subsection (14) is added to section 402.313, |
52 | Florida Statutes, to read: |
53 | 402.313 Family day care homes.-- |
54 | (14) Beginning July 1, 2007, the age-appropriate series of |
55 | pneumococcal conjugate vaccine, as recommended by the Advisory |
56 | Committee on Immunization Practices of the Centers for Disease |
57 | Control and Prevention, shall be administered to a child younger |
58 | than 2 years of age who is enrolled or enrolling in a family day |
59 | care home. The department shall implement rules to add |
60 | pneumococcal conjugate vaccine to the current list of required |
61 | vaccines and establish protocols for children younger than 2 |
62 | years of age to catch up on missed doses. A family day care home |
63 | must be able to furnish proof to the department of pneumococcal |
64 | conjugate vaccine compliance for all children receiving care at |
65 | the home by December 1, 2007. |

68 | 402.3131 Large family child care homes.-- |
69 | (9) Beginning July 1, 2007, the age-appropriate series of |
70 | pneumococcal conjugate vaccine, as recommended by the Advisory |
71 | Committee on Immunization Practices of the Centers for Disease |
72 | Control and Prevention, shall be administered to a child younger |
73 | than 2 years of age who is enrolled or enrolling in a large |
74 | family child care home. The department shall implement rules to |
75 | add pneumococcal conjugate vaccine to the current list of |
76 | required vaccines and establish protocols for children younger |
77 | than 2 years of age to catch up on missed doses. A large family |
78 | child care home must be able to furnish proof to the department |
79 | of pneumococcal conjugate vaccine compliance for all children |
80 | receiving care at the home by December 1, 2007. |
81 | Section 4. This act shall take effect July 1, 2007. |
