  1                      A bill to be entitled

  2         An act relating to trust funds; terminating a

  3         specified trust fund within the Department of

  4         Veterans' Affairs; providing for disposition of

  5         balances in and revenues of such trust fund;

  6         prescribing procedures for the termination of

  7         the trust fund; amending s. 17.61, F.S.,

  8         relating to investments of trust fund moneys;

  9         deleting obsolete provisions; amending s.

10         20.435, F.S.; removing provisions providing for

11         the future repeal of the Biomedical Research

12         Trust Fund; providing an effective date.

14  Be It Enacted by the Legislature of the State of Florida:

15  

16         Section 1.  (1)  The Florida World War II Veterans

17  Memorial Matching Trust Fund within the Department of

18  Veterans' Affairs, FLAIR number 50-2-755, is terminated. The

19  current balance remaining in, and all revenues of, the trust

20  fund shall be transferred to the Grants and Donations Trust

21  Fund, FLAIR number 50-2-339.

22         (2)  The Department of Veterans' Affairs shall pay any

23  outstanding debts and obligations of the terminated fund as

24  soon as practicable, and the Chief Financial Officer shall

25  close out and remove the terminated fund from the various

26  state accounting systems using generally accepted accounting

27  principles concerning warrants outstanding, assets and

28  liabilities.

29         Section 2.  Paragraph (c) of subsection (3) of section

30  17.61, Florida Statutes, is amended to read:

 1         17.61  Chief Financial Officer; powers and duties in

 2  the investment of certain funds.--

 3         (3)

 4         (c)  Except as provided in this paragraph and except

 5  for moneys described in paragraph (d), the following agencies

 6  shall not invest trust fund moneys as provided in this

 7  section, but shall retain such moneys in their respective

 8  trust funds for investment, with interest appropriated to the

 9  General Revenue Fund, pursuant to s. 17.57:

10         1.  The Agency for Health Care Administration, except

11  for the Tobacco Settlement Trust Fund.

12         2.  The Agency for Persons with Disabilities, except

13  for:

14         a.  The Federal Grants Trust Fund.

15         b.  The Tobacco Settlement Trust Fund.

16         3.  The Department of Children and Family Services,

17  except for:

18         a.  The Alcohol, Drug Abuse, and Mental Health Trust

19  Fund.

20         b.  The Community Resources Development Trust Fund.

21         b.c.  The Refugee Assistance Trust Fund.

22         c.d.  The Social Services Block Grant Trust Fund.

23         d.e.  The Tobacco Settlement Trust Fund.

24         e.f.  The Working Capital Trust Fund.

25         4.  The Department of Community Affairs, only for the

26  Operating Trust Fund.

27         5.  The Department of Corrections.

28         6.  The Department of Elderly Affairs, except for:

29         a.  The Federal Grants Trust Fund.

30         b.  The Tobacco Settlement Trust Fund.

31         7.  The Department of Health, except for:

23         Section 3.  Paragraph (h) of subsection (1) of section

24  20.435, Florida Statutes, is amended to read:

25         20.435  Department of Health; trust funds.--

26         (1)  The following trust funds are hereby created, to

27  be administered by the Department of Health:

28         (h)  Biomedical Research Trust Fund.

29         1.  Funds to be credited to the trust fund shall

30  consist of funds deposited pursuant to s. 215.5601 and any

31  other funds appropriated by the Legislature. Funds shall be

 1  used for the purposes of the James and Esther King Biomedical

 2  Research Program and the William G. "Bill" Bankhead, Jr., and

 3  David Coley Cancer Research Program as specified in ss.

 4  215.5602, 288.955, and 381.922. The trust fund is exempt from

 5  the service charges imposed by s. 215.20.

 6         2.  Notwithstanding the provisions of s. 216.301 and

 7  pursuant to s. 216.351, any balance in the trust fund at the

 8  end of any fiscal year shall remain in the trust fund at the

 9  end of the year and shall be available for carrying out the

10  purposes of the trust fund. The department may invest these

11  funds independently through the Chief Financial Officer or may

12  negotiate a trust agreement with the State Board of

13  Administration for the investment management of any balance in

14  the trust fund.

15         3.  Notwithstanding s. 216.301 and pursuant to s.

16  216.351, any balance of any appropriation from the Biomedical

17  Research Trust Fund which is not disbursed but which is

18  obligated pursuant to contract or committed to be expended may

19  be carried forward for up to 3 years following the effective

20  date of the original appropriation.

21         4.  The trust fund shall, unless terminated sooner, be

22  terminated on July 1, 2008.

23         Section 4.  This act shall take effect July 1, 2007.
