  2         An act relating to trust funds; terminating a

  3         specified trust fund within the Department of

  4         Veterans' Affairs; providing for disposition of

  5         balances in and revenues of such trust fund;

  6         prescribing procedures for the termination of

  7         the trust fund; repealing ss. 295.18, 295.181,

  8         295.182, 295.183, 295.185, F.S., relating to

  9         the Florida World War II Veterans Memorial Act;

10         amending s. 17.61, F.S., relating to

11         investments of trust fund moneys; deleting

12         obsolete provisions; amending s. 20.435, F.S.;

13         removing provisions providing for the future

14         repeal of the Biomedical Research Trust Fund;

15         providing an effective date.

17  Be It Enacted by the Legislature of the State of Florida:

18  

19         Section 1.  (1)  The Florida World War II Veterans

20  Memorial Matching Trust Fund within the Department of

21  Veterans' Affairs, FLAIR number 50-2-755, is terminated. The

22  current balance remaining in, and all revenues of, the trust

23  fund shall be transferred to the Grants and Donations Trust

24  Fund, FLAIR number 50-2-339.

25         (2)  The Department of Veterans' Affairs shall pay any

26  outstanding debts and obligations of the terminated fund as

27  soon as practicable, and the Chief Financial Officer shall

28  close out and remove the terminated fund from the various

29  state accounting systems using generally accepted accounting

30  principles concerning warrants outstanding, assets and

31  liabilities.

 1         Section 2.  Sections 295.18, 295.181, 295.182, 295.183,

 2  and 295.185, Florida Statutes, are repealed.

 3         Section 3.  Paragraph (c) of subsection (3) of section

 4  17.61, Florida Statutes, is amended to read:

 5         17.61  Chief Financial Officer; powers and duties in

 6  the investment of certain funds.--

 7         (3)

 8         (c)  Except as provided in this paragraph and except

 9  for moneys described in paragraph (d), the following agencies

10  shall not invest trust fund moneys as provided in this

11  section, but shall retain such moneys in their respective

12  trust funds for investment, with interest appropriated to the

13  General Revenue Fund, pursuant to s. 17.57:

14         1.  The Agency for Health Care Administration, except

15  for the Tobacco Settlement Trust Fund.

16         2.  The Agency for Persons with Disabilities, except

17  for:

18         a.  The Federal Grants Trust Fund.

19         b.  The Tobacco Settlement Trust Fund.

20         3.  The Department of Children and Family Services,

21  except for:

22         a.  The Alcohol, Drug Abuse, and Mental Health Trust

23  Fund.

24         b.  The Community Resources Development Trust Fund.

25         b.c.  The Refugee Assistance Trust Fund.

26         c.d.  The Social Services Block Grant Trust Fund.

27         d.e.  The Tobacco Settlement Trust Fund.

28         e.f.  The Working Capital Trust Fund.

29         4.  The Department of Community Affairs, only for the

30  Operating Trust Fund.

31         5.  The Department of Corrections.

27         Section 4.  Paragraph (h) of subsection (1) of section

28  20.435, Florida Statutes, is amended to read:

29         20.435  Department of Health; trust funds.--

30         (1)  The following trust funds are hereby created, to

31  be administered by the Department of Health:

 1         (h)  Biomedical Research Trust Fund.

 2         1.  Funds to be credited to the trust fund shall

 3  consist of funds deposited pursuant to s. 215.5601 and any

 4  other funds appropriated by the Legislature. Funds shall be

 5  used for the purposes of the James and Esther King Biomedical

 6  Research Program and the William G. "Bill" Bankhead, Jr., and

 7  David Coley Cancer Research Program as specified in ss.

 8  215.5602, 288.955, and 381.922. The trust fund is exempt from

 9  the service charges imposed by s. 215.20.

10         2.  Notwithstanding the provisions of s. 216.301 and

11  pursuant to s. 216.351, any balance in the trust fund at the

12  end of any fiscal year shall remain in the trust fund at the

13  end of the year and shall be available for carrying out the

14  purposes of the trust fund. The department may invest these

15  funds independently through the Chief Financial Officer or may

16  negotiate a trust agreement with the State Board of

17  Administration for the investment management of any balance in

18  the trust fund.

19         3.  Notwithstanding s. 216.301 and pursuant to s.

20  216.351, any balance of any appropriation from the Biomedical

21  Research Trust Fund which is not disbursed but which is

22  obligated pursuant to contract or committed to be expended may

23  be carried forward for up to 3 years following the effective

24  date of the original appropriation.

25         4.  The trust fund shall, unless terminated sooner, be

26  terminated on July 1, 2008.

27         Section 5.  This act shall take effect July 1, 2007.
