9 1002.335, F.S., relating to the Florida Schools
10 of Excellence Commission; conforming a
11 reference; repealing ss. 1010.72, 1010.76,
12 1010.78, and 1012.72(5), F.S., relating to the
13 Dale Hickam Excellent Teaching Program Trust
14 Fund, the Educational Aids Trust Fund, and the
15 Projects, Contracts, and Grants Trust Fund
16 within the department; providing effective
17 dates.

19 Be It Enacted by the Legislature of the State of Florida:
20
21 Section 1. (1) The following trust funds within the
22 Department of Education are terminated:
23 (a) Effective July 1, 2008, the Projects Contracts and
24 Grants Trust Fund, FLAIR number 48-2-552. Current balances
25 from General Education Development (GED) testing and the
26 leasing of available transponder time from the state's
27 satellite transponder resources in the Projects, Contracts,
28 and Grants Trust Fund, and all revenues from GED testing and
29 the leasing of available transponder time from the state's
30 satellite transponder resources shall be transferred to the
31 Operating Trust Fund within the Department of Education, FLAIR

1 number 48-2-510. Current balances from donations remaining in
2 the Projects, Contracts, and Grants Trust Fund and all
3 revenues from donations shall be transferred to the Grants and
4 Donations Trust Fund within the Department of Education, FLAIR
5 number 48-2-339.
6 (b) The Dale Hickam Excellent Teaching Program Trust
7 Fund, FLAIR number 48-2-206. All current balances remaining in
8 the Dale Hickam Excellent Teaching Program Trust Fund and all
9 revenues of the fund shall be transferred to the General
10 Revenue Fund.
11 (2) The Department of Education shall pay any
12 outstanding debts and obligations of the terminated funds as
13 soon as practicable, and the Chief Financial Officer shall
14 close out and remove the terminated funds from various state
15 accounting systems using generally accepted accounting
16 principles concerning warrants outstanding, assets, and
17 liabilities.
18 Section 2. The Educational Aids Trust Fund, FLAIR
19 number 48-2-180, within the Department of Education is renamed
20 the Federal Grants Trust Fund, FLAIR number 48-2-261.
21 Section 3. Paragraph (a) of subsection (3) of section
22 1002.335, Florida Statutes, is amended to read:
23 1002.335 Florida Schools of Excellence Commission.--
24 (3) FLORIDA SCHOOLS OF EXCELLENCE COMMISSION.--
25 (a) The Florida Schools of Excellence Commission is
26 established as an independent, state-level charter school
27 authorizing entity working in collaboration with the
28 Department of Education and under the supervision of the State
29 Board of Education. Startup funds necessary to establish and
30 operate the commission may be received through private
31 contributions and federal and other institutional grants

1 through the Grants and Donations Trust Fund and the Federal
2 Grants Educational Aids Trust Fund housed within the
3 department in addition to funds provided in the General
4 Appropriations Act. The department shall assist in securing
5 federal and other institutional grant funds to establish the
6 commission.
7 Section 4. Sections 1010.72 and 1010.76, Florida
8 Statutes, are repealed.
9 Section 5. Effective July 1, 2008, section 1010.78,
10 Florida Statutes, is repealed.
11 Section 6. Subsection (5) of section 1012.72, Florida
12 Statutes, is repealed.
13 Section 7. Except as otherwise expressly provided in
14 this act, this act shall take effect July 1, 2007.
