13 | Be It Enacted by the Legislature of the State of Florida: |
14 |

15 | Section 1. Section 201.032, Florida Statutes, is created |
16 | to read: |
17 | 201.032 Constitutional Charter County Discretionary Surtax |
18 | Trust Fund.-- |
19 | (1) The Constitutional Charter County Discretionary Surtax |
20 | Trust Fund is created within the Florida Housing Finance |
21 | Corporation. The moneys credited to the fund consist of revenues |
22 | collected from the discretionary surtax on documents under ss. |
23 | 125.0167 and 201.031. The fund shall be administered by the |
24 | board of directors of the corporation, with the assistance of |
25 | the Department of Revenue. The fund shall be a separate account |
26 | held in trust and maintained by the corporation. The fund shall |
27 | be used by the corporation to receive revenues from the |
28 | discretionary surtax on documents levied under ss. 125.0167 and |
29 | 201.031 and to make disbursements to each county levying the |
30 | surtax to provide local housing assistance as provided in s. |
31 | 201.031(2)(b). Moneys may be disbursed from the fund to the |
32 | county only on a matching basis with respect to moneys provided |
33 | by the county for local housing assistance as provided in s. |
34 | 201.031(2)(b). |
35 | (2) Notwithstanding the provisions of s. 216.301 and |
36 | pursuant to s. 216.351, any balance in the fund at the end of |
37 | any fiscal year shall remain in the fund at the end of that year |
38 | and shall be available for carrying out the purposes of the |
39 | fund. |
40 | (3) Pursuant to the provisions of s. 19(f)(2), Art. III of |
41 | the State Constitution, the fund shall, unless terminated |
42 | sooner, be terminated July 1, 2011. Prior to its scheduled |
43 | termination, the fund shall be reviewed as provided in s. |
44 | 215.3206(1) and (2). |
45 | Section 2. This act shall take effect July 1, 2007, if HB |
46 | 1357 is enacted in the same legislative session or an extension |
47 | thereof and becomes law. |
