2An act relating to the Constitutional Charter County
3Discretionary Surtax Trust Fund; creating s. 201.032,
4F.S.; creating the Constitutional Charter County
5Discretionary Surtax Trust Fund within the Florida Housing
6Finance Corporation; providing for administration of the
7fund; providing for the use of moneys in the fund;
8requiring balances in the fund to remain in the fund for
9certain purposes; providing for future review and
10termination or re-creation of the fund; providing a
11contingent effective date.

13Be It Enacted by the Legislature of the State of Florida:

15     Section 1.  Section 201.032, Florida Statutes, is created
16to read:
17     201.032  Constitutional Charter County Discretionary Surtax
18Trust Fund.--
19     (1)  The Constitutional Charter County Discretionary Surtax
20Trust Fund is created within the Florida Housing Finance
21Corporation. The moneys credited to the fund consist of revenues
22collected from the discretionary surtax on documents under ss.
23125.0167 and 201.031. The fund shall be administered by the
24board of directors of the corporation, with the assistance of
25the Department of Revenue. The fund shall be a separate account
26held in trust and maintained by the corporation. The fund shall
27be used by the corporation to receive revenues from the
28discretionary surtax on documents levied under ss. 125.0167 and
29201.031 and to make disbursements to each county levying the
30surtax to provide local housing assistance as provided in s.
31201.031(2)(b). Moneys may be disbursed from the fund to the
32county only on a matching basis with respect to moneys provided
33by the county for local housing assistance as provided in s.
34201.031(2)(b).
35     (2)  Notwithstanding the provisions of s. 216.301 and
36pursuant to s. 216.351, any balance in the fund at the end of
37any fiscal year shall remain in the fund at the end of that year
38and shall be available for carrying out the purposes of the
39fund.
40     (3)  Pursuant to the provisions of s. 19(f)(2), Art. III of
41the State Constitution, the fund shall, unless terminated
42sooner, be terminated July 1, 2011. Prior to its scheduled
43termination, the fund shall be reviewed as provided in s.
44215.3206(1) and (2).
45     Section 2.  This act shall take effect July 1, 2007, if HB
461357 is enacted in the same legislative session or an extension
47thereof and becomes law.
