34Be It Enacted by the Legislature of the State of Florida:
35
36     Section 1.  Section 874.01, Florida Statutes, is amended to
37read:
38     874.01  Short title.--This chapter may be cited as the
39"Organized Crime Group Criminal Street Gang Prevention Act of
402007 1996."
41     Section 2.  Section 874.02, Florida Statutes, is amended to
42read:
43     874.02  Legislative findings and intent.--
44     (1)  The Legislature finds that it is the right of every
45person, regardless of race, color, creed, religion, national
46origin, sex, age, sexual orientation, or handicap, to be secure
47and protected from fear, intimidation, and physical harm caused
48by the activities of organized crime groups criminal street
49gangs and their members. It is not the intent of this chapter to
50interfere with the exercise of the constitutionally protected
51rights of freedom of expression and association. The Legislature
52recognizes the constitutional right of every citizen to harbor
53and express beliefs on any lawful subject whatsoever, to
54lawfully associate with others who share similar beliefs, to
55petition lawfully constituted authority for a redress of
56perceived grievances, and to participate in the electoral
57process.
58     (2)  The Legislature finds, however, that the state is
59facing a mounting crisis caused by organized crime groups
60criminal street gangs whose members threaten and terrorize
61peaceful citizens and commit a multitude of crimes. These
62organized crime group criminal street gang activities, both
63individually and collectively, present a clear and present
64danger. Street gangs, in particular, have evolved into
65increasingly sophisticated and complex organized crime groups
66both in their criminal tactics, their schemes, and their
67brutality. The state has a compelling interest in preventing
68organized crime group criminal street gang activity and halting
69the real and present danger posed by the proliferation of
70organized crime groups and the graduation from more primitive
71forms of criminal organizations to highly sophisticated criminal
72organizations. For these reasons, and the Legislature finds that
73the provisions of this chapter act are essential necessary to
74maintain the public order and safety.
75     (3)  It is the intent of the Legislature to outlaw certain
76conduct associated with the existence and proliferation of
77organized criminal activity, provide eradicate the terror
78created by criminal street gangs and their members by providing
79enhanced criminal penalties, and eliminate and by eliminating
80the patterns, profits, proceeds, instrumentalities, and property
81facilitating organized criminal street gang activity, including
82organized crime group criminal street gang recruitment.
83     Section 3.  Section 874.03, Florida Statutes, is amended to
84read:
85     874.03  Definitions.--As used in this chapter:
86     (1)  "Electronic communication" has the meaning provided in
87s. 934.02 and includes, but is not limited to, photographs,
88video, telephone communications, text messages, facsimile,
89electronic mail messages as defined in s. 668.602, and instant
90message real-time communications with other individuals through
91the Internet or other means.
92     (2)(1)  "Organized crime group Criminal street gang" means
93a formal or informal ongoing organization, association, or group
94that has as one of its primary activities the commission of
95criminal or delinquent acts, and that consists of three or more
96persons who have a common name or common identifying signs,
97colors, or symbols and have two or more members who,
98individually or collectively, engage in or have engaged in a
99pattern of organized criminal street gang activity, including,
100but not limited to, organized criminal syndicates, street gangs,
101and terrorist organizations.
102     (3)(2)  "Organized crime Criminal street gang member" is a
103person who is a member of an organized crime group a criminal
104street gang as defined in this section subsection (1) and who
105meets two or more of the following criteria:
106     (a)  Admits to organized crime group criminal street gang
107membership.
108     (b)  Is identified as an organized crime group a criminal
109street gang member by a parent or guardian.
110     (c)  Is identified as an organized crime group a criminal
111street gang member by a documented reliable informant.
112     (d)  Resides in or frequents a particular organized crime
113group's criminal street gang's area and adopts their style of
114dress, their use of hand signs, or their tattoos, and associates
115with known organized crime group criminal street gang members.
116     (e)  Is identified as an organized crime group a criminal
117street gang member by an informant of previously untested
118reliability and such identification is corroborated by
119independent information.
120     (f)  Has been arrested more than once in the company of
121identified organized crime group criminal street gang members
122for offenses that which are consistent with usual organized
123crime group criminal street gang activity.
124     (g)  Is identified as an organized crime group a criminal
125street gang member by physical evidence such as photographs or
126other documentation.
127     (h)  Has been stopped in the company of known organized
128crime group criminal street gang members four or more times.
129     (i)  Has authored any communication indicating
130responsibility for the commission of any crime by the organized
131crime group.
132     (4)(3)  "Pattern of organized crime group criminal street
133gang activity" means the commission or attempted commission of,
134or solicitation or conspiracy to commit, as an organized crime
135group member, two or more felony or three or more misdemeanor
136offenses, or one felony and two misdemeanor offenses, or the
137comparable number of delinquent acts or violations of law which
138would be felonies or misdemeanors if committed by an adult, on
139separate occasions within a 3-year period, excluding any period
140of incarceration.
141     (5)(4)  For purposes of law enforcement identification and
142tracking only:
143     (a)  "Organized crime group Criminal street gang associate"
144means a person who:
145     1.  Admits to organized crime group criminal street gang
146association; or
147     2.  Meets any single defining criterion for organized crime
148group criminal street gang membership described in subsection
149(3) (2).
150     (b)  "Organized crime-related Gang-related incident" means
151an incident where that, upon investigation, meets any of the
152following conditions:
153     1.  The participants are identified as organized crime
154group criminal street gang members or organized crime group
155criminal street gang associates, acting, individually or
156collectively, to further any criminal purpose of the organized
157crime group gang; or
158     2.  The A reliable informant identifies an incident is
159identified as organized crime group criminal street gang
160activity by a reliable informant; or
161     3.  an informant of previously untested reliability who
162identifies an incident as criminal street gang activity and it
163is corroborated by independent information.
164     (6)  "Street gangs" are formal or informal ongoing
165organizations, entities, associations, or groups consisting of
166three or more persons with a common name or common identifying
167signs, colors, or symbols and two or more members who,
168individually or collectively, have as one of their primary
169activities the commission of criminal or delinquent acts and
170engage in or have engaged in a pattern of organized criminal
171activity.
172     (7)  "Terrorist organization" means any organized criminal
173group engaged in or organized for the purpose of engaging in
174terrorism as defined in s. 775.30. This definition shall not be
175construed to prevent prosecution of individuals acting alone
176under this chapter.
177     Section 4.  Section 874.04, Florida Statutes, is amended to
178read:
179     874.04  Organized criminal street gang activity; enhanced
180penalties.--Upon a finding by the court at sentencing that the
181defendant committed the charged offense for the purpose of
182benefiting, promoting, or furthering the interests of an
183organized crime group a criminal street gang, the penalty for
184any felony or misdemeanor, or any delinquent act or violation of
185law which would be a felony or misdemeanor if committed by an
186adult, may be enhanced. Penalty enhancement affects the
187applicable statutory maximum penalty only. Each of the findings
188required as a basis for such sentence shall be found by a
189preponderance of the evidence. The enhancement will be as
190follows:
191     (1)(a)  A misdemeanor of the second degree may be punished
192as if it were a misdemeanor of the first degree.
193     (b)  A misdemeanor of the first degree may be punished as
194if it were a felony of the third degree. For purposes of
195sentencing under chapter 921 and determining incentive gain-time
196eligibility under chapter 944, such offense is ranked in level 1
197of the offense severity ranking chart. The criminal street gang
198multiplier in s. 921.0024 does not apply to misdemeanors
199enhanced under this paragraph.
200     (2)(a)  A felony of the third degree may be punished as if
201it were a felony of the second degree.
202     (b)  A felony of the second degree may be punished as if it
203were a felony of the first degree.
204     (c)  A felony of the first degree may be punished as if it
205were a life felony.

207For purposes of sentencing under chapter 921 and determining
208incentive gain-time eligibility under chapter 944, such felony
209offense is ranked as provided in s. 921.0022 or s. 921.0023, and
210without regard to the penalty enhancement in this subsection.
211For purposes of this section, penalty enhancement affects the
212applicable statutory maximum penalty only.
213     Section 5.  Section 874.045, Florida Statutes, is created
214to read:
215     874.045  Arrest and prosecution under other
216provisions.--Nothing in this chapter shall prohibit the arrest
217and prosecution of an organized crime group member under chapter
218876, chapter 895, chapter 896, s. 893.20, or any other
219applicable provision of law except to the extent otherwise
220prohibited pursuant to a statutory or constitutional provision.
221     Section 6.  Section 874.05, Florida Statutes, is amended to
222read:
223     874.05  Causing, encouraging, soliciting, or recruiting
224organized crime group criminal street gang membership.--
225     (1)  Except as provided in subsection (2), a person who
226intentionally causes, encourages, solicits, or recruits another
227person to become an organized criminal group member where join a
228criminal street gang that requires as a condition of membership
229or continued membership is the commission of any crime commits a
230felony of the third degree, punishable as provided in s.
231775.082, s. 775.083, or s. 775.084.
232     (2)  A person who commits Upon a second or subsequent
233violation offense, the person commits a felony of the second
234degree, punishable as provided in s. 775.082, s. 775.083, or s.
235775.084.
236     Section 7.  Section 874.07, Florida Statutes, is created to
237read:
238     874.07  Communication among members or associates.--As a
239term and condition of probation, parole, conditional release, or
240community control, organized crime group members or associates
241shall not communicate with any other organized crime group
242members or associates through any means, except as authorized by
243law enforcement officials, prosecutorial authorities, or the
244court, for the purpose of aiding in the investigation of
245organized criminal activity. Organized crime group members or
246associates violating this section shall be deemed to have
247violated their probation, parole, community release, or
248community control, and the court shall revoke their probation,
249parole, conditional release, or community control.
250     Section 8.  Section 874.08, Florida Statutes, is amended to
251read:
252     874.08  Organized crime group activity and Profits,
253proceeds, and instrumentalities of criminal street gangs or
254criminal street gang recruitment; forfeiture.--All profits,
255proceeds, and instrumentalities of organized crime group
256criminal street gang activity and all property used or intended
257or attempted to be used to facilitate the criminal activity of
258any organized crime group criminal street gang or of any group
259criminal street gang member; and all profits, proceeds, and
260instrumentalities of organized crime group criminal street gang
261recruitment and all property used or intended or attempted to be
262used to facilitate organized crime group criminal street gang
263recruitment are subject to seizure and forfeiture under the
264Florida Contraband Forfeiture Act, s. 932.704.
265     Section 9.  Section 874.09, Florida Statutes, is amended to
266read:
267     874.09  Crime data information.--
268     (1)  The Department of Law Enforcement may:
269     (a)  Develop and manage a statewide organized crime group
270criminal street gang database to facilitate the exchange of
271information pursuant to the intent and purpose of this chapter.
272     (b)  Notify all law enforcement agencies that reports of
273arrested organized crime group members or associates shall be
274entered into the database as soon as the minimum level of data
275specified by the department is available to the reporting agency
276and no waiting period for the entry of that data exists.
277     (c)  Compile and retain information regarding organized
278crime groups and their members and associates in a manner that
279allows the information to be used by law enforcement and other
280agencies deemed appropriate for investigative purposes.
281     (d)  Compile and maintain a history data repository
282relating to organized crime groups and their members and
283associates in order to develop and improve techniques used by
284law enforcement agencies and prosecutors in the investigation,
285apprehension, and prosecution of members and affiliates of
286organized crime groups.     (2)  Local law enforcement agencies
287may:
288     (a)  After carrying out any arrest of any individual whom
289they believe to be a member or associate of an organized crime
290group, create or update that individual's electronic file within
291the system.
292     (b)  Notify the prosecutor of the accused individual's
293organized crime group membership or associate status.
294     Section 10.  Section 874.10, Florida Statutes, is created
295to read:
296     874.10  Electronic communication.--Any person who uses
297electronic communication to further any criminal purpose, to
298intimidate or harass other persons, or to advertise his or her
299presence in the community, including, but not limited to,
300videotaping criminal activity or threats of criminal activity,
301posting images or audio of criminal activity or threats of
302criminal activity on the Internet, or reproducing photographs or
303audio recordings of criminal activity commits a felony of the
304third degree, punishable as provided in s. 775.082, s. 775.083,
305or s. 775.084.
306     Section 11.  Section 874.11, Florida Statutes, is created
307to read:
308     874.11  Identification documents; unlawful possession or
309creation.--
310     (1)  For purposes of this section, the term "identification
311document" includes, but is not limited to, a social security
312card or number, a birth certificate, a driver's license, an
313identification card pursuant to s. 322.051, a naturalization
314certificate, an alien registration number, a passport, and any
315access credentials for a publicly operated facility or an
316infrastructure facility covered under 18 U.S.C. s. 2332f.
317     (2)  Any person possessing or manufacturing any blank,
318forged, stolen, fictitious, fraudulent, counterfeit, or
319otherwise unlawfully issued identification document in
320furtherance of a criminal activity commits a felony of the
321second degree, punishable as provided in s. 775.082, s. 775.083,
322or s. 775.084.     Section 12.  Section 874.12, Florida Statutes, is
323created to read:
324     874.12  Grants.--
325     (1)  The Department of Law Enforcement shall administer
326organized crime prevention and enforcement grants from funds
327specifically appropriated for this purpose. Grants shall be used
328solely for the purpose of funding prevention programs or
329strengthening enforcement activities. Funds shall be awarded on
330a competitive basis to applicants who meet department criteria.
331     (2)  The Department of Law Enforcement shall adopt rules
332pursuant to ss. 120.536(1) and 120.54 setting forth the grant
333application process, eligibility criteria, and performance
334standards.
335     Section 13.  Paragraph (nn) of subsection (2) of section
336435.04, Florida Statutes, is amended to read:
337     435.04  Level 2 screening standards.--
338     (2)  The security background investigations under this
339section must ensure that no persons subject to the provisions of
340this section have been found guilty of, regardless of
341adjudication, or entered a plea of nolo contendere or guilty to,
342any offense prohibited under any of the following provisions of
343the Florida Statutes or under any similar statute of another
344jurisdiction:
345     (nn)  Section 874.05(1), relating to encouraging or
346recruiting another to join an organized crime group a criminal
347gang.
348     Section 14.  Paragraph (d) of subsection (2) of section
349893.138, Florida Statutes, is amended to read:
350     893.138  Local administrative action to abate drug-related,
351prostitution-related, or stolen-property-related public
352nuisances and criminal street gang activity.--
353     (2)  Any place or premises that has been used:
354     (d)  By a criminal street gang for the purpose of
355conducting a pattern of organized crime group criminal street
356gang activity as defined by s. 874.03; or
357
358may be declared to be a public nuisance, and such nuisance may
359be abated pursuant to the procedures provided in this section.
360     Section 15.  Paragraph (a) of subsection (1) and subsection
361(3) of section 895.02, Florida Statutes, are amended to read:
362     895.02  Definitions.--As used in ss. 895.01-895.08, the
363term:
364     (1)  "Racketeering activity" means to commit, to attempt to
365commit, to conspire to commit, or to solicit, coerce, or
366intimidate another person to commit:
367     (a)  Any crime that is chargeable by indictment or
368information under the following provisions of the Florida
369Statutes:
370     1.  Section 210.18, relating to evasion of payment of
371cigarette taxes.
372     2.  Section 403.727(3)(b), relating to environmental
373control.
374     3.  Section 409.920 or s. 409.9201, relating to Medicaid
375fraud.
376     4.  Section 414.39, relating to public assistance fraud.
377     5.  Section 440.105 or s. 440.106, relating to workers'
378compensation.
379     6.  Section 443.071(4), relating to creation of a

458illicit as well as licit enterprises and governmental, as well
459as other, entities. An organized crime group A criminal street
460gang, as defined in s. 874.03, constitutes an enterprise.

659Legal status points are assessed when any form of legal status
660existed at the time the offender committed an offense before the
661court for sentencing. Four (4) sentence points are assessed for
662an offender's legal status.

665community sanction violation is before the court for sentencing.
666Six (6) sentence points are assessed for each community sanction
667violation, and each successive community sanction violation;
668however, if the community sanction violation includes a new
669felony conviction before the sentencing court, twelve (12)

679level 10, and one or more prior serious felonies, a single
680assessment of 30 points shall be added. For purposes of this
681section, a prior serious felony is an offense in the offender's
682prior record that is ranked in level 8, level 9, or level 10
683under s. 921.0022 or s. 921.0023 and for which the offender is
684serving a sentence of confinement, supervision, or other
685sanction or for which the offender's date of release from
686confinement, supervision, or other sanction, whichever is later,
687is within 3 years before the date the primary offense or any
688additional offense was committed.

690Prior capital felony points: If the offender has one or more
691prior capital felonies in the offender's criminal record, points
692shall be added to the subtotal sentence points of the offender
693equal to twice the number of points the offender receives for
694the primary offense and any additional offense. A prior capital
695felony in the offender's criminal record is a previous capital
696felony offense for which the offender has entered a plea of nolo
697contendere or guilty or has been found guilty; or a felony in
698another jurisdiction which is a capital felony in that
699jurisdiction, or would be a capital felony if the offense were
700committed in this state.

702Possession of a firearm, semiautomatic firearm, or machine gun:
703If the offender is convicted of committing or attempting to
704commit any felony other than those enumerated in s. 775.087(2)
705while having in his or her possession: a firearm as defined in
706s. 790.001(6), an additional 18 sentence points are assessed; or
707if the offender is convicted of committing or attempting to
708commit any felony other than those enumerated in s. 775.087(3)

713Sentencing multipliers:

715Drug trafficking: If the primary offense is drug trafficking
716under s. 893.135, the subtotal sentence points are multiplied,
717at the discretion of the court, for a level 7 or level 8
718offense, by 1.5. The state attorney may move the sentencing
719court to reduce or suspend the sentence of a person convicted of
720a level 7 or level 8 offense, if the offender provides
721substantial assistance as described in s. 893.135(4).

723Law enforcement protection: If the primary offense is a
724violation of the Law Enforcement Protection Act under s.
725775.0823(2), the subtotal sentence points are multiplied by 2.5.
726If the primary offense is a violation of s. 775.0823(3), (4),
727(5), (6), (7), or (8), the subtotal sentence points are
728multiplied by 2.0. If the primary offense is a violation of s.
729784.07(3) or s. 775.0875(1), or of the Law Enforcement
730Protection Act under s. 775.0823(9) or (10), the subtotal
731sentence points are multiplied by 1.5.

733Grand theft of a motor vehicle: If the primary offense is grand
734theft of the third degree involving a motor vehicle and in the
735offender's prior record, there are three or more grand thefts of
736the third degree involving a motor vehicle, the subtotal
737sentence points are multiplied by 1.5.

739Offense related to an organized crime group a criminal street
740gang: If the offender is convicted of the primary offense and
741committed that offense for the purpose of benefiting, promoting,
742or furthering the interests of an organized crime group a
743criminal street gang as prohibited under s. 874.04, the subtotal
744sentence points are multiplied by 1.5.

746Domestic violence in the presence of a child: If the offender is
747convicted of the primary offense and the primary offense is a
748crime of domestic violence, as defined in s. 741.28, which was
749committed in the presence of a child under 16 years of age who
750is a family or household member as defined in s. 741.28(3) with
751the victim or perpetrator, the subtotal sentence points are
752multiplied by 1.5.
753     Section 18.  Paragraph (n) of subsection (5) of section
754921.141, Florida Statutes, is amended to read:
755     921.141  Sentence of death or life imprisonment for capital
756felonies; further proceedings to determine sentence.--
757     (5)  AGGRAVATING CIRCUMSTANCES.--Aggravating circumstances
758shall be limited to the following:
759     (n)  The capital felony was committed by an organized crime
760group a criminal street gang member, as defined in s. 874.03.
761     Section 19.  Subsection (30) of section 984.03, Florida
762Statutes, is amended to read:
763     984.03  Definitions.--When used in this chapter, the term:
764     (30)  "Juvenile justice continuum" includes, but is not
765limited to, delinquency prevention programs and services
766designed for the purpose of preventing or reducing delinquent
767acts, including criminal activity by organized crime groups
768youth gangs and juvenile arrests, as well as programs and
769services targeted at children who have committed delinquent
770acts, and children who have previously been committed to
771residential treatment programs for delinquents. The term
772includes children-in-need-of-services and families-in-need-of-
773services programs; conditional release; substance abuse and
774mental health programs; educational and vocational programs;
775recreational programs; community services programs; community
776service work programs; and alternative dispute resolution
777programs serving children at risk of delinquency and their
778families, whether offered or delivered by state or local
779governmental entities, public or private for-profit or not-for-
780profit organizations, or religious or charitable organizations.
781     Section 20.  Paragraph (c) of subsection (15) and
782subsection (29) of section 985.03, Florida Statutes, are amended
783to read:
784     985.03  Definitions.--As used in this chapter, the term:
785     (15)
786     (c)  "Delinquency prevention programs" means programs
787designed for the purpose of reducing the occurrence of
788delinquency, including organized crime group youth and street
789gang activity, and juvenile arrests. The term excludes
790arbitration, diversionary or mediation programs, and community
791service work or other treatment available subsequent to a child
792committing a delinquent act.
793     (29)  "Juvenile justice continuum" includes, but is not
794limited to, delinquency prevention programs and services
795designed for the purpose of preventing or reducing delinquent
796acts, including criminal activity by organized crime groups
797youth gangs, and juvenile arrests, as well as programs and
798services targeted at children who have committed delinquent
799acts, and children who have previously been committed to
800residential treatment programs for delinquents. The term
801includes children-in-need-of-services and families-in-need-of-
802services programs; conditional release; substance abuse and
803mental health programs; educational and career programs;
804recreational programs; community services programs; community

810     Section 21.  Paragraph (c) of subsection (1) of section
811985.047, Florida Statutes, is amended to read:
812     985.047  Information systems.--
813     (1)
814     (c)  As used in this section, "a juvenile who is at risk of
815becoming a serious habitual juvenile offender" means a juvenile
816who has been adjudicated delinquent and who meets one or more of
817the following criteria:
818     1.  Is arrested for a capital, life, or first degree felony
819offense or sexual battery.
820     2.  Has five or more arrests, at least three of which are
821for felony offenses. Three of such arrests must have occurred
822within the preceding 12-month period.
823     3.  Has 10 or more arrests, at least 2 of which are for
824felony offenses. Three of such arrests must have occurred within
825the preceding 12-month period.
826     4.  Has four or more arrests, at least one of which is for
827a felony offense and occurred within the preceding 12-month
828period.
829     5.  Has 10 or more arrests, at least 8 of which are for any
830of the following offenses:
831     a.  Petit theft;
832     b.  Misdemeanor assault;
833     c.  Possession of a controlled substance;
834     d.  Weapon or firearm violation; or
835     e.  Substance abuse.

837Four of such arrests must have occurred within the preceding 12-
838month period.
839     6.  Meets at least one of the criteria for organized crime
840group youth and street gang membership.
841     Section 22.  Paragraph (a) of subsection (6) and subsection
842(7) of section 985.433, Florida Statutes, are amended to read:
843     985.433  Disposition hearings in delinquency cases.--When a
844child has been found to have committed a delinquent act, the
845following procedures shall be applicable to the disposition of
846the case:
847     (6)  The first determination to be made by the court is a
848determination of the suitability or nonsuitability for
849adjudication and commitment of the child to the department. This
850determination shall include consideration of the recommendations
851of the department, which may include a predisposition report.
852The predisposition report shall include, whether as part of the
853child's multidisciplinary assessment, classification, and
854placement process components or separately, evaluation of the
855following criteria:
856     (a)  The seriousness of the offense to the community. If
857the court determines under chapter 874 that the child was a
858member of an organized crime group a criminal street gang at the
859time of the commission of the offense, the seriousness of the
860offense to the community shall be given great weight.
861
862It is the intent of the Legislature that the criteria set forth
863in this subsection are general guidelines to be followed at the
864discretion of the court and not mandatory requirements of
865procedure. It is not the intent of the Legislature to provide
866for the appeal of the disposition made under this section.
867     (7)  If the court determines that the child should be
868adjudicated as having committed a delinquent act and should be
869committed to the department, such determination shall be in
870writing or on the record of the hearing. The determination shall
871include a specific finding of the reasons for the decision to
872adjudicate and to commit the child to the department, including
873any determination that the child was a member of an organized
874crime group a criminal street gang.
875     (a)  The juvenile probation officer shall recommend to the
876court the most appropriate placement and treatment plan,
877specifically identifying the restrictiveness level most
878appropriate for the child. If the court has determined that the
879child was a member of an organized crime group a criminal street
880gang, that determination shall be given great weight in
881identifying the most appropriate restrictiveness level for the
882child. The court shall consider the department's recommendation
883in making its commitment decision.
884     (b)  The court shall commit the child to the department at
885the restrictiveness level identified or may order placement at a
886different restrictiveness level. The court shall state for the
887record the reasons that establish by a preponderance of the
888evidence why the court is disregarding the assessment of the
889child and the restrictiveness level recommended by the
890department. Any party may appeal the court's findings resulting
891in a modified level of restrictiveness under this paragraph.
892     (c)  The court may also require that the child be placed in
893a probation program following the child's discharge from
894commitment. Community-based sanctions under subsection (8) may
895be imposed by the court at the disposition hearing or at any
896time prior to the child's release from commitment.
897     Section 23.  The Division of Statutory Revision is directed
898to redesignate the title of chapter 874, Florida Statutes, as
899"Organized Criminal Activity Enforcement and Prevention."
900     Section 24.  This act shall take effect July 1, 2007.
