11  The Committee on Agriculture (Peaden) recommended the
12  following amendment:

14         Senate Amendment (with title amendment) 
15         On page 16, between lines 24 and 25,

17  insert:  
18         Section 11.  Paragraph (e) is added to subsection (2)
19  of section 570.07, Florida Statutes, and subsection (6) of
20  that section is amended, to read:
21         570.07  Department of Agriculture and Consumer
22  Services; functions, powers, and duties.--The department shall
23  have and exercise the following functions, powers, and duties:
24         (2)  To perform all regulatory and inspection services
25  relating to agriculture except agricultural education,
26  demonstration, research, and those regulatory functions
27  assigned by law to other state agencies.  In doing this, the
28  department may:
29         (e)  Except as expressly prohibited by law, use any of
30  the trained personnel in the various divisions of the
31  department in performing the regulatory and inspection

Florida Senate - 2007 COMMITTEE AMENDMENT Bill No. SB 1372 Barcode 452774 1 services relating to agriculture. 2 (6) To foster and encourage the standardizing, 3 grading, inspection, labeling, handling, storage, and 4 marketing of agricultural products; to enhance the food safety 5 of tomatoes and, after investigation and public hearings, to 6 cooperate with the United States Department of Agriculture, to 7 establish and promulgate standard grades and other standard 8 classifications of and for agricultural products; and to 9 establish and adopt requirements for enhancing food safety, in 10 cooperation with appropriate agencies. 11 Section 12. Present paragraph (e) of subsection (2) of 12 section 570.48, Florida Statutes, is redesignated as paragraph 13 (f), and a new paragraph (e) is added to that subsection, to 14 read: 15 570.48 Division of Fruit and Vegetables; powers and 16 duties; records.--The duties of the Division of Fruit and 17 Vegetables include, but are not limited to: 18 (2) 19 (e) Performing tomato food safety inspections on 20 tomato farms, in tomato greenhouses, and in tomato 21 packinghouses and repackers. 22 Section 13. Subsections (1) and (2) of section 23 570.481, Florida Statutes, are amended to read: 24 570.481 Fruit and vegetable inspection fees; 25 penalty.-- 26 (1)(a) Each person receiving inspection services 27 pursuant to s. 570.48 shall pay to the department an 28 inspection fee. This fee shall cover the cost of providing 29 the inspection service and shall be set annually by the 30 department by rule. 31 (b) All fees collected by the department to cover the 2 10:05 AM 02/20/07 s1372.ag02.jb5
Florida Senate - 2007 COMMITTEE AMENDMENT Bill No. SB 1372 Barcode 452774 1 cost of providing the inspection service for farms or 2 greenhouses growing tomatoes or for tomato packinghouses shall 3 be deposited into the General Inspection Trust Fund and shall 4 be used for tomato-related inspections, education, and 5 research. 6 (2) All fees collected by the department under this 7 section shall be deposited into the Citrus Inspection Trust 8 Fund, except that fees collected pursuant to paragraph (1)(b) 9 and s. 570.48(4) shall be deposited in the General Inspection 10 Trust Fund. 11 12 (Redesignate subsequent sections.) 13 14 15 ================ T I T L E A M E N D M E N T =============== 16 And the title is amended as follows: 17 On page 2, line 15, after the semicolon, 18 19 insert: 20 amending s. 570.07, F.S.; authorizing personnel 21 within the various divisions of the department 22 to perform regulatory and inspection services 23 relating to agriculture; requiring that the 24 department adopt requirements for enhancing 25 food safety; amending s. 570.48, F.S.; 26 authorizing the Division of Fruit and 27 Vegetables to perform food safety inspections 28 with respect to tomatoes; amending s. 570.481, 29 F.S.; requiring that fees collected by the 30 department to cover the costs of tomato-related 31 inspections be deposited into the General 3 10:05 AM 02/20/07 s1372.ag02.jb5
