9 | 849.086 Cardrooms authorized.-- |
10 | (2) DEFINITIONS.--As used in this section: |
11 | (a)1. "Authorized game" means a game or series of games of |
12 | poker which are played in a nonbanking manner. |
13 | 2. "Authorized game facilitated by certified electronic |
14 | gaming equipment" means an authorized game as defined in |
15 | subparagraph 1. which is played on an electronic poker table |
16 | that shuffles, deals, pays pots, and otherwise conducts the game |
17 | electronically so that players can play the game without a human |
18 | dealer. The electronic gaming equipment must be certified by a |
19 | department-approved, independent testing laboratory as providing |
20 | a mathematically random shuffle and deal process with an equal |
21 | probability of occurrence for each card. |
22 | (4) AUTHORITY OF DIVISION.--The Division of Pari-mutuel |
23 | Wagering of the Department of Business and Professional |
24 | Regulation shall administer this section and regulate the |
25 | operation of cardrooms under this section and the rules adopted |
26 | pursuant thereto, and is hereby authorized to: |
27 | (a) Adopt rules, including, but not limited to: the |
28 | issuance of cardroom and employee licenses for cardroom |
29 | operations; the operation of a cardroom; procedures for and |
30 | operation of authorized games facilitated by certified |
31 | electronic gaming equipment; recordkeeping and reporting |
32 | requirements; and the collection of all fees and taxes imposed |
33 | by this section. |
34 | (7) CONDITIONS FOR OPERATING A CARDROOM.-- |
35 | (c) Except for authorized games facilitated by certified |
36 | electronic gaming equipment, a cardroom operator must at all |
37 | times employ and provide a nonplaying dealer for each table on |
38 | which authorized card games which traditionally utilize a dealer |
39 | are conducted at the cardroom. Such dealers may not have any |
40 | participatory interest in any game other than the dealing of |
41 | cards and may not have an interest in the outcome of the game. |
42 | The providing of such dealers by a licensee shall not be |
43 | construed as constituting the conducting of a banking game by |
44 | the cardroom operator. |
45 | (12) PROHIBITED ACTIVITIES.-- |
46 | (c) No electronic or mechanical devices, except mechanical |
47 | card shufflers or authorized games facilitated by certified |
48 | electronic gaming equipment, may be used to conduct any |
49 | authorized game in a cardroom. |
