40 | Section 25. Sergeant Nicholas Sottile honored; Department |

42 | (1) That portion of State Road 70 near U.S. Highway 27 in |
43 | Highlands County is dedicated to the memory of Highway Patrol |
44 | Sergeant Nicholas Sottile. |
45 | (2) The Department of Transportation is directed to erect |
46 | suitable signage, pursuant to subsection (1), bearing the |
47 | inscription, "In Memory of Sergeant Nicholas Sottile of the |
48 | Florida Highway Patrol, who was killed in the line of duty |
49 | during a traffic stop." |
50 | Section 26. (1) That portion of Brickell Avenue situated |
51 | within the corporate limits of the City of Miami and lying |
52 | between S.E. 25th Street and the south shoreline of the Miami |
53 | River is designated as a state historic road. No state funds |
54 | shall be expended by any public body or agency to alter its |
55 | location whether by extension of its boundaries or the extension |
56 | of the name Brickell Avenue. |
57 | (2) Nothing in this section shall be construed to prevent |
58 | the ordinary maintenance and repair of that portion of Brickell |
59 | Avenue situated within the corporate limits of the City of Miami |
60 | and lying between S.E. 25th Street and the south shoreline of |
61 | the Miami River, provided the location of the historic road is |
62 | preserved; to prevent the removal or replacement of any |
63 | landscaping, including any hammock, banyan, or mahogany trees |
64 | located on either side of the paved surface of the road or in |
65 | the central media of the road; to prevent any work that is |
66 | necessary for the public health or safety as determined by the |
67 | agency having jurisdiction over that portion of Brickell Avenue |
68 | described in subsection (1); to prevent the removal of invasive |
69 | plant species on the roadway or right-of-way; to prevent such |
70 | action deemed necessary to clear or maintain the road subsequent |
71 | to a natural disaster such as a hurricane; to limit widening or |
72 | physical changes to Brickell Avenue to improve vehicular or |
73 | pedestrian movement; or to limit the commercial development |
74 | adjacent to the roadway. The term "ordinary maintenance" means |
75 | those activities necessary to preserve the existing traffic |
76 | patterns and to accommodate the volume of traffic operating on |
77 | that portion of Brickell Avenue described in subsection (1) as |
78 | of July 1, 2007. However, the preservation of that portion of |
79 | Brickell Avenue described in subsection (1) takes priority over |
80 | considerations of traffic management, and the public safety |
81 | shall not be construed to require alterations in that portion of |
82 | Brickell Avenue described in subsection (1) or its landscaping |
83 | when alternative means of promoting safety, including more |
84 | restrictive regulations, are available. |
85 | Section 27. Subsection (26) of section 334.044, Florida |
86 | Statutes, is amended to read: |
87 | 334.044 Department; powers and duties.--The department |
88 | shall have the following general powers and duties: |
89 | (26) To provide for the conservation of natural roadside |
90 | growth and scenery and for the implementation and maintenance of |
91 | roadside beautification programs. To accomplish this, for fiscal |
92 | years 1999-2000, 2000-2001, and 2001-2002 no less than 1 |
93 | percent, and for subsequent fiscal years no less than 1.5 |
94 | percent of the amount contracted for construction projects shall |
95 | be allocated by the department to beautification programs. |
96 | Except where prohibited by federal law or federal regulation and |
97 | to the extent practical, a minimum of 50 percent of these funds |
98 | shall be used to purchase large plant materials, and with the |
99 | remaining funds shall be used for the purchase of other plant |
100 | materials. All such plant and these materials shall be purchased |
101 | from a Florida-based nurseryman of commercially grown nursery |
102 | stock on a uniform competitive bid basis pursuant to which |
103 | project-specific landscaping contracts are awarded directly by |
104 | the department on a project-specific basis in compliance with |
105 | the terms and conditions of competitive solicitation as set |
106 | forth in chapter 287. The cost of the program shall be paid by |
107 | vendors. The department will develop grades and standards for |
108 | landscaping materials purchased through this process. To |
109 | accomplish these activities, the department may contract with |
110 | nonprofit organizations having the primary purpose of developing |
111 | youth employment opportunities. |
