| 8 | Be It Enacted by the Legislature of the State of Florida: |
| 9 |
|
| 10 | Section 1. Subsections (19) through (32) of section 5 of |
| 11 | chapter 2000-445, Laws of Florida, are renumbered as subsections |
| 12 | (20) through (33), respectively, and a new subsection (19) is |
| 13 | added to that section, to read: |
| 14 | Section 5. Definitions.--As used in this act: |
| 15 | (19) "Information technology professional" means a |
| 16 | position designated by an appointing authority after July 1, |
| 17 | 2007, for which a qualified applicant would have demonstrable |
| 18 | and creditable experience in the development or management of |
| 19 | computer, telecommunication, or data-sharing systems and |
| 20 | generally including graduation from an accredited college or |
| 21 | university in an appropriately related field or recognized |
| 22 | industry standard certification and excluding, notwithstanding |
| 23 | any other provision of law, any information technology position |
| 24 | in the classified service as of January 1, 2007, except and |
| 25 | unless that position is vacant at the time a designation is made |
| 26 | or an incumbent in any such position concurs with a transfer to |
| 27 | the exempt service as a designated information technology |
| 28 | professional. |
| 29 | Section 2. Paragraphs (e) and (f) of subsection (2) of |
| 30 | section 6 of chapter 2000-445, Laws of Florida, are redesignated |
| 31 | as paragraphs (f) and (g), respectively, and a new paragraph (e) |
| 32 | is added to that subsection, to read: |
| 33 | Section 6. Classes of employees.-- |
| 34 | (2) The following classes of employment are exempt from |
| 35 | the classified service and are subject to any rights provided by |
| 36 | their appointing authority. The exempt service includes: |
| 37 | (e) Information technology professionals; |
| 38 | Section 3. This act shall take effect July 1, 2007. |
